Westhampton Beach Village Mayor Expects New Eruv Proposal

A group has taken initial steps to put up a Jewish religious boundary, known as an eruv, that would encircle almost all of Westhampton Beach Village and the hamlet of Quiogue, as well as parts of Quogue Village and the hamlet of Westhampton, according to Westhampton Beach Village Mayor Conrad Teller.

The Westhampton Beach Village Board held a special executive session on Wednesday to discuss the possible eruv, a designated area in which Orthodox Jews would be allowed to push and carry objects on the Sabbath, activities that are normally prohibited on their holy day. In past years, an application by the Hampton Synagogue to create a smaller eruv inside Westhampton Beach sparked a political fire storm in the village. Houses as Mechitzos: Exclusive to the Chazon Ish?

I am sure that the majority of my readership is familiar with the Chazon Ish’s shita regarding mechitzos habatim [houses] and is also familiar with the allegation that his shita is a chiddush that is not shared by any poskim. However, these assertions are generally incorrect.

To begin with, I would like to clarify that, l’kol hadeios, batim are no different than mechitzos (see for instance: Mabit, 1:48; Magen Avraham, 358:5; Ginas V'radin, klal 3:22; Mayim Rabim, siman 38, and the Bais Ephraim, Teshuvos HaBach HaChadashos, siman 3, p. 258). The only contention is regarding the efficacy of mechitzos habatim when enclosing a reshus harabbim.

I am sure that many of my readers do not realize that there are poskim prior to the Chazon Ish who allowed for mechitzos habatim to enclose an area on three sides that would otherwise be classified as a reshus harabbim. In order to make use of batim as mechitzos, these poskim needed to employ two out of the three fundaments that the Chazon Ish made use of: 1) That we pasken lo asu rabbim u’mevatlei mechitzta. 2) That we maintain pirtzos esser is d’rabbanan. It is important to note that these two fundaments are really not a chiddush but have been accepted as halachah pesukah (see The Overwhelming Majority of Achronim Maintain Lo Asu Rabbim U’Mevatlei Mechitzta and Pirtzos, Biblical or Rabbinical proscription?). [I will soon address the third fundament, which is the Chazon Ish’s chiddush.]

The following poskim maintain that batim are qualified as mechitzos when encompassing a reshus harabbim:

ז"ל הבית אפרים (סימן כ"ו דף ל"ז ע"ב ומ"ט ע"א):

תשובה הנה בנדן הלז יש בזה שני אופנים האחד אם דרך עובר באמצע העיר ממש כזה ב C והשני אם הדרך המפולש הוא מפסיק בסוף הרחוב היינו בין שלשה מחיצות הבתים המקיפות הרחוב ובין המחיצה הרביעית כזה ב ו ... ועתה אלכה ואשובה אל מקומי הראשון לברר שאלתינו והנה באופן הא' שהדרך עובר באמצע העיר נראה ברור דמועיל צורת הפתח כאשר בררתי הדברים כשמלה שאף בשם ד' מחיצות לבד דעת כל הפוסקים כרבנן דלא אתו רבים ומבטלי מחיצתא ומכ"ש בזה שיש כאן מחיצות גמורות וד"מ המקיפים מכל צד דאף דבאמצע המחיצה מזה ומזה בקעי רבים לא מבטלי וכיון דלענין פסי ביראות מהני כה"ג שיש שם ד"מ אף על פי שלא התירו אלא לעולי רגלים היינו שאין שם רק פסין טפח ופרוץ באמצע לגמרי ובזה שיש מחיצות שלימות וגם עושין צורת הפתח במקום בקיעת הרבים הוי רה"י גמור לטלטל בו אף מדרבנן ... ובאופן הב' שהדרך המפולש הוא בסוף הרחוב ויש ג' מחיצות מעב' אחד של הדרך ומחיצה ד' מעב' השני מכל מקום נראה דגם בכה"ג כיון שיש כאן ג' מחיצות שלימות שאין בטלים משום בקיעת הרבים אף שבקיעת הרבים מפסקת בין מחיצות אלו למחיצה שבעב' שכנגדה מכל מקום שוב מועיל בזה צוה"פ ואמרינן פתחא היא ושרי ומכ"ש אם ממחיצה הד' יוצאין גפופין ובליטות כרוחב אמה ויותר ולא גרע מפסי ביראות ועמש"ל מדברי רבינו יהונתן אם בנה לו עמוד מכאן הוי כחצר שיש לו ד"מ כו'.


וז"ל הבית שלמה (סימן נ"א):

אמנם אחת ראיתי להעיר אשר לא עלה ולא יעלה על לב המערער. שכיון שרוצה להעמיד צוה"פ לרוחב הדרך סמוך אל ההרים, א"כ אם הדרך רחב ט"ז אמה י"ל דהוי רה"ר ... ולרה"ר עצמו אינו מועיל צוה"פ כמבואר בשס דף ו' [דצריך דלתות] ... ובשלמא בכל העיירות שדרך המלך הולך באמצע כיון שיש עכ"פ בתים גם בהצדדים שדרך המלך ביניהם א"כ עכ"פ יש שם ד' מחיצות ובכה"ג לרבנן דף כ"ב דקי"ל כוותיהו לא אתי רבים ומבטלי מחיצות, אבל בניד"ד שנראה שאין בתים ... א"כ יש חשש בזה להסוברים דגם עכשיו יש רה"ר. וכבר האריך הרחיב בזה בתשובת בית אפרים. ע"כ מהראוי לעשות לשתי הרוחות עמוד מכאן ועמוד מכאן רחב אמה, וא"כ הוי נמי כשם ד' מחיצות ... ובזה כבר יצאו מחשש זה.


וז"ל הנפש חיה (סימן ל):

דהנ' יש לספק על כל ההיתר צוה"פ הנהוג בינינו כיון דהדרך רחב ט"ז אמה והוי כרה"ר ולא מהני צוה"פ ... וצ"ל דאנו סומכין על דיעה זו דלא הוי רה"ר רק בס' רבוא בוקעין בו. ועוד הטעם דלרבנן כל היכא דאיכא שם ד' מחיצו' היינו דאיכא בכל צד מחיצה לא אמרינן אתי רבים ומבטלי מחיצתא, ומשו"ה מהני לדידן צוה"פ דאיכא שם ד' מחיצות שישנו מחיצה בכל צד ... אך בנ"ד שכבר נבנה בתים ויהי' שם שם ד' מחיצו' ממחיצו' העשיות בידי אדם ושפיר מהני צורת הפתח.

Additionally, there are poskim who argue that batim are sufficient to encompass an area otherwise classified as a reshus harabbim, but for an alternative reason. They maintain that since the streets are lined on two sides by batim, the streets would need to be mefulash m’shaar l’shaar in order to be classified as a reshus harabbim.

The following poskim maintain that batim are sufficient to encompass a reshus harabbim if they break the streets’ requirement of mefulash:

ז"ל השער הזקנים [להגאון בעל שמלת בנימין מהאמבורג] (דף קט"ז):

ומיהו י"ל כדפרש"י בפ"ק דעירובין באין מחיצה ברוחב י"ו אמה הוי רה"ר וביש מחיצה בעי מפולש משער לשער, וכן כתב הטור וש"ע בסי' שמ"ה דשווקים ורחובות בעינן מפולש משער לשער ואם אינו מפולשים אע"ג דאינם מתוקנים בצוה"פ אין כאן רה"ר דאוריי' דמכ"מ יש היקף מחיצות [כוונתו דהפירצות אע"פ שאינו מתוקנות בצוה"פ אינו מבטל שם מחיצה מן העומד] וה"נ איכא מחיצה דבתים משני צדדים א"כ אפילו הוי רחב י"ו אמה מ"מ בזמנינו ליכא מפולש משער לשער כמו שכתבו הפוסקים ואין לו דין רה"ר.


וז"ל הביאור הגר"א (סימן שמה):

ואין לו חומה – זהו סרטיא: ופירש בדמשק אליעזר "דהיא מסלה ואין לה חומה משום צד." ואפי' יש להם חומה – זהו פלטיא: ופירש בדמשק אליעזר "שהיא רחובה של עיר ויש לה חומות משני צדדים, ומשני צדדים מכוונים שערי העיר זה כנגד זה" [כוונתו דבתוך העיר בכל ענין יש לו חומה ע"י הבתים שבשני צדדים, ועל אותן הבתים התנה המחבר שיהא מפולש ומכוון א"כ מבואר דאם יש בתים נגד הפילוש מבטל מינה שם מפולש].

In the same vein, I came across a fascinating teshuvah in Shu”t Rabi Akiva Yosef (from Rav Akiva Yosef Schlesinger) where he says that he had a dream why we are lenient today regarding reshus harabbim:

ז"ל השו"ת רבי עקיבה יוסף (סי' צ"ב):

ע"ד אשר נהגו להקל ברה"ר בזמן הזה, כמו שכ' בשו"ע (או"ח סי' ש"ג סע' ח"י) ובכמה מקומות, משם דבזה"ז ליכא רה"ר דאורייתא, ומצינן כרכים גדולים אשר להם שווקים רחובים, ומהיכי תיתי להקל בספק דאורייתא... אמנם העירוני ע"י כי כל עיר יש בה בתים סביב סביב, לא יגרעו הבתים האלו מן חומה המקפת סביב, וכמו שאמרי' (עירובין ו:) ירושלם אילמלא דלתותיה ננעלות בלילה (ה"נ) חייבין עליה ופרש"י התם דוקא אם הרשות הרבים מפולש מכוון משער אל שער אז צריך נעילה, או ראוי' לנעול, וכן נכפל התם בפרש"י (שם ע"ו ד"ה ר"ה) דוקא במפולש לרה"ר, משא"כ בעיירות שלנו בתוך העיר ליכא פילוש לרה"ר לעולם, כי אם הבתים הולכים סביב סביב במבואות, על כן בתוך העיר לעולם לא נחשב כי אם כמו כרמלית, ועל כן שפיר אמרו בזה"ז ליכא רה"ר דאורייתא, שאין לו מציאות אם לא לחוץ לעיר בצידיה...

Furthermore, I would also add the Mayim Rabim to the list of poskim who allow batim to encompass a reshus harabbim if they break the streets’ requirement of mefulash. However, even though in a few teshuvos he did mention batim in regards to mechitzos, he did not remark on their efficacy in a reshus harabbim. Nevertheless, it is clear from the teshuvah, which the following quote was excerpted from, that he would uphold that batim have the same halachic ramifications for a reshus harabbim as do mechitzos:

ז"ל המים רבים (סימן ל"ח):

דין העיר שהיא ר"ה הוא היכא שאין לה חומה או אם יש לה חומה היכא שר"ה שלה מכוון משער לשער ומפולש כלומר ... ר"ה בתרי גווני או כשאין לה חומה או כשר"ה שלה מכוון משער לשער ... אין לשום אחת מהן דין רה"ר עד שיהיו רחבים ט"ז אמה ומבלי היקף ואם יהיו להם חומה שלפחות יהיו מפולשין, כי הר"ה צריך להיות דומה לדגלי מדבר הרחב ט"ז אמה שהוא מקום הילוך רבים ומבלי חומה, וכשהוא מפולש ג"כ משער לשער אין בו חומה קרינן בי כי שני מחיצות לאו כלום הוא.

I would also like to point out that Rav Yonasan Stief who was a contemporary of the Chazon Ish independently argued for the use of batim as mechitzos in a reshus harabbim:

ז"ל המהר"י שטייף (סימן ס"ח):

שהעיר מסובבת במחיצות של הבתים והבנינים מכל ד' רוחותיה והמחיצות נעשים ע"י בנ"א ואין רבים מבטלין אותן המחיצות ... ובס' שו"ת בית אפרים סימן כ"ו אחרי שהאריך בגדר ר"ה כ' כל שיש כאן ד' מחיצות הנראים לעומדים בתוכן לא אתי רבים לבטלם, א"כ כשנערב שכונות שכונות יש באפשרות לתקן אותם שיהיה באפשרות לראות השווקים שיבואו לתוך העירוב והו"ל רואין את המחיצות ומהני צוה"פ.

Referring back to the Chazon Ish (O.C. 74:10, 107:5-7), his chiddush further extended the use of mechitzos habatim by adding a third element ― that the din of omed creates a mechitzah.

The Chazon Ish argues: Since, me’d’Oraysa, a break in an enclosure that is omed merubeh does not negate the enclosure, when a street which continues through a city ends, either with houses or a dead end, the whole length of that street with the mechitzos habatim on both sides and its dead end would be considered omed merubeh on three sides, and me’d’Oraysa, a reshus hayachid. As a result, the intersections of that street, which were pirtzos, would halachically be termed k’omed dami, closed. Consequently, all streets that run perpendicular through this street ― which now has three mechitzos and halachically closed intersections ― would in turn be surrounded by three mechitzos themselves, their own mechitzos habatim on both sides of the street and a third wall, the omed of the intersection. This creates a spiraling effect throughout the entire city. The Chazon Ish concludes that there never would be in large cities a reshus harabbim because we would always find one street that is enclosed by three walls.

The halachic ramification of the difference between the Chazon Ish’s chiddush and the above mentioned poskim is as follows: According to these poskim in order that the street/area be classified as a reshus hayachid, we would need, at the minimum, for the mechitzos habbatim to enclose the street/area on three sides. However, according to the Chazon Ish, as long as one street in a city is encompassed by three mechitzos, all the intersecting streets which are only lined with two mechitzos would be classified as halachically enclosed with three mechitzos, as well. Given that in most cities today all the streets/areas are enclosed on all [and not just two] sides by mechitzos habatim, there is no need to only rely on the Chazon Ish’s chiddush since we can rely on all the above mentioned poskim, as well.

In His Own Words: HaRav Wosner Shlita Clarifies His Position on Eruvin

This past 14 Shevat, HaRav Hagaon Shmuel HaLevi Wosner shlita in his regular Thursday night shiur on hilchos Shabbos mentioned eruvin in Brooklyn. Following this, the anti-eruv cabal disseminated a transcription of the shiur which seemed to indicate that Rav Wosner did not subscribe to an eruv in Brooklyn. However, as we will hear, Rav Wosner declared to his son and grandson that he did not, in fact, issue a p’sak regarding the eruv. Rav Wosner added that many times he had been involved in an issue, albeit l’halachah, only to realize that 70 percent of the times the petitioner had not fully articulated the facts on the ground. Consequentially, Rav Wosner expressed regret for his involvement in such matters. [Note that this only concerns Rav Wosner issuing a public p’sak. I know countless talmidim who asked Rav Wosner privately if they could make use of the Boro Park eruv and he answered in the affirmative.]

Note in this recording the discussion regarding mechitzos and city eruvin. Rav Benzion Wosner was the original Baal Machsher of the Chicago (West Rogers Park) eruv and was instrumental in obtaining his father’s approval of the said eruv. As the elder Rav Wosner states in this recording, he readily consented to the Chicago eruv because [as relayed to him by his son] it consisted of mechitzos. In this recording Rav Benzion expressed to his father his confidence regarding the mechitzos encompassing the Boro Park eruv, as well.

Cong. Beth El is the only synagogue in Rutherford, tucked away on a residential stretch of Montross Avenue. Since the 1950s, the formerly Conservative shul has been housed in the same tree-shaded Queen Anne mansion — inconspicuous behind shade trees on a street lined with spacious, well maintained homes.
