Primer on Hilchos Reshuyos and Eruvin: Part 2

What Is a Reshus HaYachid


The Shulchan Aruch (O.C. 345:2) defines a reshus hayachid as an area that is enclosed by walls [mechitzos] that are at least ten tefachim high and encompass an area that is at the minimum four tefachim by four tefachim. These mechitzos can also encircle an area that is ten tefachim deep or an elevated area that is ten tefachim high.

Me’d’oraysa, if the mechitzos only enclose an area on three sides the area is still classified as a reshus hayachid (Tur and Shulchan Aruch, O.C. 363:1). At the minimum, each of the three sides must be omed merubeh al haparutz [that is, more than 50 percent of the length of each side must actually consist of a wall] for it to be considered whole for halachic purposes (ibid., 362:9-10, 363:1).[2]

However, me’d’rabbanan, until the area is entirely enclosed it is classified as a karmelis. Therefore, in order that the area be reclassified, me’d’rabbanan, as a reshus hayachid we are required to rectify the fourth side of the enclosure ― and the pirtzos in the three sides ― with, at the minimum, a tzuras hapesach.[3] Only then would it be permissible to carry therein.

It should be noted that had the Mishnah Berurah who paskens asu rabbim u’mevatlei mechitzta (Bi’ur Halachah 364:2) seen the Bais Ephraim (O.C. 26) in conjunction with the Mishkenos Yaakov (O.C. 120-122), there is a possibility he would have agreed with the Bais Ephraim that lo asu rabbim u’mevatlei mechitzta (see Part 1: According to the Mishnah Berurah, May a Baal Nefesh Carry in an Eruv of Tzuras HaPesachim?). See Bi’ur Halachah (208:9, s.v. Eino M’Vorech), where he states that he does not have the sefer Bais Ephraim (see also Toldos Shmuel, 3:81:7, 3:86:8; Bais Av, 2:5:2, and Even Yisroel, 8:36).
[3] The pirtzos in the mechitzos which are usually ten amos wide ― such as the streets running through the mechitzos ― would require at the minimum a tzuras hapesach; merely a post [lechi] would not suffice (Shulchan Aruch, O.C. 363:26). It is important to note that the tzuras hapesach can be utilized, me’d’rabbanan, to encircle a smaller part of the area enclosed by the mechitzos instead of closing the fourth side of the mechitzos themselves since the tzuras hapesach is being erected in a reshus hayachid d’oraysa.

איזהו רה"ר רחובות ושווקים הרחבים ט"ז אמה ואינם מקורים, ואין להם חומה, ואפילו יש להם חומה אם הם מפולשים משער לשער (ואין דלתותיו נעולות בלילה) הוי רה"ר, וי"א שכל שאין ששים רבוא עוברים בו בכל יום אינו רה"ר. (שו"ע סי' שמ"ה סעיף ז')

ואמנם הבית אפרים בסי' כ"ו האריך לסתור דברי המשכנ"י, והצדיק מנהג העולם, והראה לדעת כי נכונים דברי הטו"ז והמג"א, ואדרבה רוב ראשונים ס"ל כדעת רש"י, ועיי"ש שמנה למעלה מעשרים ראשונים הסוברים כן, (ובספר תולדות שמואל הפליג עוד יותר וסופר ומונה לערך ששים ראשונים דאין רה"ר בזה"ז משום דבעינן ס"ר בוקעין), וכתב "אשר אין כח ביד שום אדם לערער על המנהג אשר נתיסד עפ"י גדולי עולם חכמי צרפת ואשכנז אשר אנו מבני בניהם ומימיהם אנו שותים".

ולמעשה לפי המשכנ"י אין היתר לערב בצוה"פ אפילו בעיירות קטנות שאין בהם ס"ר, כל שהדרכים רחבים ט"ז אמות, וכבר כתבו הפוסקים שהמנהג הפשוט שנתפשט ברוב ערי ישראל לערב בצוה"פ אפילו ברחובות רחבים ט"ז דנקטינן להלכה כדעת הי"א, וזהו שכתבנו בפנים סעיף א', וסעיף ב'.

ואמנם בצמח צדק מס' עירובין פ"ה מ"ו כתב להדיא שיר"ש יחמיר גם לענין שלא לסמוך על העירוב, [אע"ג דהוא ס"ל שם דאנן קיי"ל לא ארומ"מ], ועיי"ש שכ"כ מכח ג' טעמים, א' לחוש לדעת הפוסקים דקיי"ל אתי רומ"מ, ב' גם לפי מאי דקיי"ל לא ארומ"מ "אין ראי' גמורה דגם בצוה"פ אמרינן כן", ועוד דגם בדרבנן באיסור שבת יש לחוש לדעת הפוסקים דלא בעינן ס"ר, הרי לנו להדיא שיר"ש נכון שיחמיר גם במקום שיש עירוב שלא לטלטל, ואמנם ראוי לציין, שהצ"צ לא כתב כן משמי' דהרב שכתב להדיא בסי' שמ"ה שיר"ש יחמיר, ומשמע משום דלא ברירא לי' בכוונת הרב אי קאי גם במקום שיש עירוב וכשנ"ת, ולכן כתב כן מסברא דנפשי', וצ"ע.

שו"ר בקצות השלחן בקונטרס השלחן שהעלה שתיבות אלו "וכל יר"ש יחמיר לעצמו" אינם מהרב, וז"ל: "גם בדפוס קאפוסט תיבת "וכל יר"ש יחמיר לעצמו" נדפסו בחצאי עיגול מאמר מוסגר, וכן בדפוס טשערנאוויץ נדפס ממש כמו קאפוסט, ולפי זה אפשר שמאמר זה אינו מרבינו ז"ל אלא הוספה. ולכן אין עליו ציון במראה מקום, בין כל המ"מ, אלא ציון מיוחד בכוכב שהוסיפו אח"כ המאמר והציון, והנה מקור דברים אלו הוא בט"ז ס"ק ו' וז"ל וע"כ "המחמיר יחמיר לעצמו" ואין בידו למחות למה שנוהגין עכשיו כאותן הרבים שמקילין, עכ"ל, ולא כתב שכל יר"ש יחמיר לעצמו, אלא המחמיר יחמיר, ובקו"א ב' סי' רנ"ב כ' רבינו בזה"ל ואף מי שירצה להחמיר ברה"ר שלנו כהאומרים שיש לו דין רה"ר, ולא כ' ואף שיש ליר"ש להחמיר כו', מכ"ז נראה דמש"כ כאן וכל יר"ש יחמיר לעצמו הוא מאמר מוסגר כמו שנדפס בקאפוסט, והוא הוספת מהרי"ל עפ"י מה שראה בבית רבינו שמחמירין בזה, ולא באנו כאן להקל ליר"ש בר"ה שלנו, אלא לברר הגירסא בשו"ע רבינו" עכ"ל. ועפ"י דברי הקצוה"ש ניחא בפשיטות שלא הביא הצ"צ בשם הרב שיר"ש יחמיר אפילו בצוה"פ שבאמת לא כ"כ הרב כלל.

והנה דברי הצ"צ והמ"ב, אמורים אפילו בעיירות קטנות כל שהרחובות רחבות ט"ז אמה, ויש בהם כל תנאי רה"ר. ואמנם פשיטא דאם חסר א' מתנאי רה"ר, אשר אפילו לפי דעה קמייתא אינו רה"ר, בזה לא אמרו כלל שיר"ש יחמיר, שהרי בזה לכו"ע אינו רה"ר מה"ת, ולזאת צריך לדעת בכל מקום על מה אדני ההיתר הוטבעו ואם יש היתר שהוא גם לפי דעה קמייתא, הנה בזה לא אמרו כלל שיר"ש יחמיר.

בתשובת אדמו"ר ממונקאטש שליט"א בענין היתר טלטול בבארא פארק, הביא מבעל מנחת אלעזר (בנימוקי או"ח סי' שצ"ט סוף סק"א) שהקפיד נגד מי שהחמיר בזה אפילו לעצמו, כי ס"ל שכיון שעירובין הוא מהדברים שאין הצדוקים מודים בו, חייבין אנו שלא להחמיר בכל מקום המותר להלכתא עיי"ש, ולפי"ז חייב דוקא לטלטל בעירוב ושלא להחמיר בזה כלל.

Where We May Carry on Shabbos


Min haTorah the prohibition against carrying is from a reshus hayachid [private domain] to a reshus harabbim [public domain] and vice versa or the moving of an object four amos in a reshus harabbim.

Chazal added a prohibition against carrying in a domain known as a karmelis [an area that cannot be classified as a reshus hayachid, since it does not have the required mechitzos or as a reshus harabbim, because it does not meet the necessary criteria]. Since there are similarities between a reshus harabbim and a karmelis, Chazal prohibited carrying between any two domains as well as within any domain other then a reshus hayachid itself [1] in order to prevent any inadvertent transgression of the laws of carrying in a reshus harabbim (Shabbos, 6a see Rashi ad loc. and Shulchan Aruch, Orach Chaim 346:1).

Since the only domain in which carrying remains permissible is a reshus hayachid, our primary concern when planning the construction of an eruv is that we be able to classify the area under consideration as a reshus hayachid.

[1] Me’d’rabbanan, even after determining that a halachically enclosed area is a reshus hayachid, the ability to carry therein is contingent on the residents forming a unified entity or eruvei chatzeiros. Since this requirement is me’d’rabbanan, Chazal were lenient and only necessitated a symbolic unified ownership. Depending on who joins this symbolic partnership, one or two methods must be employed: eruvei chatzeiros or sechiras reshus.
Eruvei chatzeiros, the merging of two or more courtyards or apartments ― used when dealing with Shomer Shabbos residents ― works in the following manner: Pieces of bread or matzoh that were contributed by all those residing within the eruv are placed in one of the enclosed houses, or alternatively one resident may take his own matzoh and grant the other residents ownership of it [zechiah]. These methods enable us to symbolically view all the residents who reside within this eruv as having united to dwell in the house in which the matzoh is kept (Tur and Shulchan Aruch, O.C. 366:1, 7).
Sechiras reshus, the rental of a domain ― usually used when dealing with neighbors who are not Shomrei Shabbos, either because they are not observant or not Jewish. Through the symbolic rental from the owners of dwellings in an enclosed area, one can acquire the right to carry therein. So too, in public areas ― such as when enclosing a city that has numerous private residences and public streets ― one can acquire the right to carry through the rental of these privileges from city officials (ibid., 382:1, 391:1).
Related to the forming of eruvei chatzeiros is the issue of being mocheh. Some claim that when a frum yid is mocheh it disrupts the unity needed for eruvei chatzeiros. However most poskim maintain that this does not create a problem (U’Bacharta B’Chaim, siman 123; Taanugei Yisroel, 2:42:7; Tzitz Eliezer, 19:17; Emek HaTeshuvah, 4:21-23, and Kovetz Ohr Yisroel, vol. 18, 21). Additionally, since we contract sechiras reshus from the city and state governments, even those poskim who have a problem with sechiras reshus when a frum yid is mocheh would allow carrying based on the power of eminent domain (Kovetz Ohr Yisroel vol. 32-33; and read carefully Divrei Yatziv 2:173:6).
Besides for which, all are in agreement that regarding eruvei chatzeiros we maintain halachah k’divrei hameikil (Eruvin, 46a, 80a). Therefore, there is no reason to acknowledge someone who is mocheh since there are many reasons to be lenient. [Actually, there are many poskim who posited that we pasken halachah k’divrei hameikil even in issues regarding mechitzos (see Part 1: Halachah K’Divrei Hameikil B'Eruvin).]
To include sechiras reshus among Rav Moshe Feinstein zt”l’s issues with reshus harabbim is disingenuous because the Klausenberg Rebbe zt”l (Divrei Yatziv, 2:173:5), who is the one who took issue with sechiras reshus ― when a frum yid is mocheh ― stated clearly that today there is no reshus harabbim. So of course his position on the issue of reshus harabbim would be that there is no reason to be mocheh. These detractors of eruvin, however, claim that they are mocheh because according to the way they understand Rav Moshe there is a reshus harabbim today; but Rav Moshe never had a problem with sechiras reshus. When the Manhattan eruv was established a frum yid was mocheh (Divrei Menachem, O.C. vol. 2, p. 95), and neither Rav Moshe nor anyone else had a problem with sechiras reshus in that situation. For that matter Rav Moshe never had a problem with sechiras reshus when a frum yid is mocheh. Rabbi Shlomo Pearl shlita stated (in a shiur he gave in Agudath Israel Bais Binyomin, Nov. 14, 1999 tape #325) that he had spoken with Rav Dovid Feinstein shlita about being mocheh against the eruv [in Boro Park]. Rav Dovid made it clear that no one should be mocheh. הנה יש לעיין דבזמנינו יש הרבה שאין צריכים לפרוע מס, כגון מקומות הציבור וכיו"ב, דלפי החוק אינם צריכין לשלם את המס, וכמה פעמים יש בתוכם בית דירה, א"כ לכאורה נפל היתר הע"א של ארעא לטסקא
משתעבד בבירא, דבתים שלהם לכאורה אין שייך להמלך, ודומה להא שכתבו התוס' חולין בשם ר"ת דארעא דאינו צריך ליתן טסקא, מחויב בתרו"מ דאינו שייך להמלך, א"כ ה"ה לגבי שכירות הם אוסרים את כל העיר, כיון שלא שכרו מהם.

אמנם נראה דזה אינו, דלפי מה שביארתי דלאו המס קובע דהוי של המלך, דהרי אפי' לאחר שנתנו את המס אכתי הוי של המלך, והמס אינו אלא ראיה שהוא של המלך, שהרי יכול ליטלו כשאינן פורעין, ע"כ נראה דזה שכתבו התוס' בחולין דארעא שאינו פורע המס לא הוי של המלך, אינו אלא אם פטור מן המס מחמת שאין להמלך שליטה עליו לגבות מס ממנו, מחמת איזה טעם, ולהכי לא הוי של המלך, אבל אם המלך יכול לגבות ממנו מס אם רוצה, רק שפוטרו ליתן את המס מרצונו, א"כ מהיכי תיתי דנימא משום זה דגם גוף הקרקע אינו של המלך, וכי משום שויתר לו את המס, נימא שויתר לו גם את הקרקע להיות שלו, זה אינו עולה על הדעת, ע"כ אף שאינו צריך לפרוע את המס והוי מוחזק בהשדה, לענין ירושת הבכור, דהוי כמו לאחר
שיהבי טסקא, מ"מ לענין תרו"מ ולענין שכירות, הוי של המלך.

לכן מטעם זה נראה פשוט, דבמדינתנו המקומות שפטורים לשלם את המס, אינו משום שיש להם איזה זכות בהבתים, מה שלא שייך להממשלה, יותר משאר בני אדם, ומה שאינם משלמים את המס, אינו אלא
משום שהממשלה רוצה לסייע בעד הציבור וכיו"ב, ע"כ פוטרם מלתת המס, וזאת עושה הממשלה מצד נדבת לבם, ולא מחמת שאין להם זכות בהבתים לגבות המס. ואות לזה שהרי אם ימכרו הציבור הבית הזה לאיש פרטי, או שישנו את הבית ויעשו אותו לבית דירה, שוב יהיו חייבים לשלם המס, משום שהממשלה מעולם לא ויתרה על זכותם בהבית.

ובאמת מעיקר הדין, אי לאו דינא דמלכותא דינא, היה חשש גזל במה שהמלך פוטרם מהמס, ודומה להא דמבואר בב"ב שם (דף נ"ה) ואמר ר' אשי פרדכתי מסייע מתא, וה"מ דאצילתיה מתא אבל אנדוסקין סיעתא דשמיא. מבואר מזה דאף שפוטרו המלך מן המס, אינו פטור לגמרי ונתחייב לשלם לבני העיר, מה שנתרבה המס שלהם, הרי דנחשב כאילו פרעו המס בשבילו, הרי דאף שהמלך מחל את המס, עדיין הוא בכלל
החיוב, אלא שהמלך נוטל מאחרים בשבילו, רק אנדוסקין כיון דהמלך עשה כן מאליו, וסיעתא דשמיא הוא לא נחשב ממש כערבות בשבילו, אלא שפוטר לזה ומחייב לזה, מ"מ מוכח מזה דאף כשפוטר המלך ממס מחמת מחילה, אין הכונה שאינו בתוך שעבוד המלך, אלא באמת גם הוא משועבד להמלך, אלא שפטר אותו מן המס, וכן מבואר בתרוה"ד (סימן שמ"א) שביאר את דברי מהר"ם דאם ביקש מהשר שימחול לו המס קודם שנתפשרו חייב לשלם המס להקהל, כיון שהשר מכביד לאחרים מה שמיקל לאחד הוי גזילה ממש, רק אם השר אומר מעצמו קודם הפשרה פלוני לא יתן עמכם, שאז הוא פטור מטעם דינא דמלכותא דינא, ודרך המלכים והשרים להיות להם אהובים ובני פלטין שמחבבין אותן יותר משאר בני המדינה וכו', וכיוצא בזה אזלינן בתר צווי המושל, עיי"ש.

ומזה מבואר דגם כאשר פוטרו מהמס
מחמת שהוא אוהבו, נחשב באמת כגזילה משאר בני העיר, כמו כשפוטרו מחמת בקשתו, דבאמת גם הוא בכלל הגזירה של נתינת המס, אלא שמ"מ כיון דדינא דמלכותא דינא יכול המלך לעשות כן ואינו גזילה. וכן מבואר בפתחי תשובה חו"מ סימן שס"ט א' בשם תשובת שבות יעקב, דאם מוותר השר המס מאדם שלא כדת, לכאורה הוא בכלל גזילה, שעי"ז הוא מכביד לאחרים, ודחה דאינו גזל דדינא דמלכותא כן הוא, עכ"פ מבואר מזה דבמה שוויתר לו המס אינו מופקע מהגזירה מעיקרא, והוי רק מחילה בעלמא.



סימן ג'




אם מהני שכירו ולקיטו גבי ישראל ובדין תינוקות שנשבו



יש לבאר אם הני קולות של שכירות שייך גם גבי ישראל, ונוגע בזמנינו משום שיש בינינו הרבה תינוקות שנשבו מחללי שבתות בעוה"ר, ונפסק בשו"ע סימן שפ"ה, דתינוק שנשבה דינו כישראל ומבטל רשות, וחמיר הרבה מדירת נכרי דחשוב כדירת בהמה, אבל תינוק שנשבה כיון דדינו כישראל לכל דבר, א"כ רשותו אוסר מעיקר הדין, ואי אפשר לזכות עירוב עבורו, דסוף סוף אינו מודה בעירוב, ומבואר בסימן שפ"ה סעיף א' דצדוקי אע"פ שדינו כישראל, מ"מ כיון שאינו מכיר בעירוב אינו מועיל, א"כ ה"ה בתינוק שנשבה אף שדינו כישראל. וראיתי בחזו"א (סימן פ"ז ס"ק י"ג) שכתב דהמכחישים אין להם חלק באמונה ודינם כעכו"ם, דמהני שכירות רעועה, ובס"ק י"ד כתב דתינוק שנשבה אותן שדיינינן ליה כאנוס, זוכין עירוב בעבורו, וזה תימה מאד, דהרי כתב הב"י והמ"א והט"ז דצדוקים דהאידנא הוי כתינוקות שנשבו, ואפ"ה פסקו דלא מהני אלא ביטול ולא עירוב, דסוף סוף אינו מודה בעירוב, וכן כתב באבנ"ז סימן מ"ה אות י' דאנשים שאינם מודים בעירוב אוסרים מדינא, ולא מהני הקולות שהקילו גבי נכרי, וכ"כ בשו"ת משיב דבר (סימן כ"ו) וכ"כ בשו"ת שו"מ (מהדורה תנינא חלק ב' סימן ס"ב) והנה הם לא הזכירו כלל מחמת דין תינוקות
שנשבו.

ואפשר דטעמם מחמת דס"ל כהאבהעו"ז
המובא בחידושי רע"א סימן שפ"ה, דמומר אין דינו כעכו"ם אלא לחומרא דצריך שכירות דוקא, אבל לקולא לענין יחיד במקום עכו"ם, כיון דמ"מ ישראל הוא ודירתו דירה אוסר, ובזה יש חולקין ה"ה הקרבן נתנאל פרק הדר סימן י"ג אות מ' דדעתו דדינם כעכו"ם אף לקולא, אבל מצד תינוקות שנשבו אין שום חולק דדינם כישראל, כמ"ש הב"י והמ"א והט"ז סימן שפ"ה ואף הקרבן נתנאל שם אות נ' שחולק, היינו דוקא בצדוקים שאינן דינם כתינוקות שנשבו, מחמת שקלקלו מעשיהם ביותר, כמ"ש הש"ך יו"ד סימן ב' ס"ק כ"ד, אבל כשיש תינוקות שנשבו ממש, אין מי חולק דדינו כישראל, ומה שכתב בשער הציון אות ב' כבר תמה עליו בחזו"א.

וראיתי בשו"ת מהרש"ם חלק ה' (סימן
ל"ו) שכתב להקל במומר דמהני שכירות כמו בנכרי, והביא מתשובות גינת ורדים כלל ג' סימן כ"ב, שכתב להקל בפשיטות גבי צדוקי, והוסיף דבלא"ה גזירה זו רפויה הוא שאנו דרים יחד עם הנכרים, יש להקל הרבה עיי”ש. ולאחר העיון בתשובת גינת ורדים שם, ראיתי שכתב להיפך, דגבי צדוקי החמיר מאד דדינו כישראל, ולא מהני שכירות לגביה לדעת הרמב"ם דלא מהני שכירות גבי ישראל, (והוצרך לשכור דוקא אצל גזבר המלך, ואבאר לקמן דבריו) רק לגבי ישראל שהמיר שדינו כעכו"ם, ע"ז כתב דיש להקל הרבה מאחר שבלא"ה אנו דרים בין העכו"ם, ונראה שמש"כ מהרש"ם בשם גור"ד צדוקי, לאו דוקא הוא, וכונתו להביא לענין מומר שדינו כעכו"ם אף לקולא כדעת הק"נ, אבל מתינוק שנשבה לא דיבר מהרש"ם ובודאי מודה שדינו כישראל, וכן ס"ל להגור"ד לענין צדוקי.

וע"כ צריך להתבונן אם הני קולות של
שכירות שייך גם גבי ישראל, שאוסרים מדינא, וממילא יצא לנו מזה גם לענין אנשים שומרי תו"מ שמוחים בעירוב ואינם רוצים לזכות בפת, דכל הקולות שצריך לומר על תינוקות שנשבו שדינם כישראל, יש לסמוך עליהם גם לענין המוחים בעירוב דשניהם דין אחד להם.

Eruvin in the News: Saint Brice, France


A first in France: A “Erouv” will be installed soon in Saint Brice!

At a time when there are still acts of anti-Semitism in France, witness the dispatches of Samy Gozlan chair of the National Office of Vigilance against anti-Semitism. It is necessary to note the gestures of sympathy of the municipal officials of the country towards the Community.

On this subject it is useful and necessary for us to mention an issue which is worth its weight in gold, because of it’s extreme rarity, which is worthy of a grand announcement.

Indeed like Philadelphia whose Mayor John Street signed an agreement so that the city has an “Erouv”, a small locality of the Northern suburbs of Paris, located between Teals-the village and Montmorency, of approximately 13.000 inhabitants called Saint Brice has, according to its Mayor Alain Lorrand, accepted the installation of an “Erouv” in the town. Why Construct an Eruv?

The Chasam Sofer (Orach Chaim 99) states that it is not possible for an individual to ensure that all the members of his household do not carry on Shabbos inadvertently, and therefore, the construction of an eruv is the obligation of every rav. Consequently, according to this Chasam Sofer it follows that one cannot assert that there is no need for an eruv. [It is important to note, even if the heter to permit an eruv is not a clear one, the Aishel Avraham states (siman 363) that nevertheless an eruv should be erected in order to save people from chilul Shabbos beshogeg (see also Kriena D’Igrasa, p. 106 and Oim Ani Chomah, p. 136).]

Additionally, just as it is the responsibility of each individual rav to insure that there be a kosher mikveh in his community, it is incumbent on each rav to erect an eruv as well (Teshuvos V’Hanhagos, 1:844; see also the above mentioned Chasam Sofer). In light of this responsibility, even if only one rav would want to erect an eruv, he has the right to construct an eruv even without a consensus of all the rabbanim.

Furthermore, establishing an eruv accomplishes the following:

  • It is a mitzvah to erect an eruv (Tur, and Shulchan Aruch, O.C. 366:13, 395:1; for proof that it’s a requirement for a city as well, see BeHag, Perek Hador and Chasam Sofer, O.C. 99).
  • An eruv helps minimize chilul Shabbos by our Jewish brethren who are unfortunately not religious and carry on Shabbos without an eruv (Nefesh Chayah, siman 25 and Bais Av, 2:1:25).
  • An eruv helps to increase our oneg Shabbos, e.g., families with young children, the elderly, and the infirm are no longer confined to their homes (Perishah, O.C. 395:1).
  • An eruv is also invaluable on Yom Tov, as it allows us to carry items that are not needed for Yom Tov e.g. extra keys on a key chain (Shulchan Aruch, O.C. 518:1).
  • It helps al pi Kabbalah to increase the kedushah of a neighborhood (Shaar HaMitzvos, parshas Beshalach).

Hagaon Harav Moshe Feinstein zt”l, when he recognized that an eruv could be erected, saw a great need for one as well (Igros Moshe, O.C. 1:139:5, 4:86, 5:29).

Since it is a mitzvah to erect an eruv, it is unjust to request that those establishing an eruv refrain from doing so, particularly when it does not negatively affect those who do not wish to partake in this mitzvah. For generations in Europe, even in large cities such as Warsaw (which had shishim ribo on the larger side from at least the year 1900; Rocznik Statystyczny Warszawy 1921 i 1922, 1924 p. 14) and Lodz (which had shishim ribo from the year 1931; Encyclopedia Judaica, 1996 vol. 11 p. 426), our ancestors practiced the mitzvah of eruvin and there is no reason that American cities should be any different.

באיזה ענין אפשר להתיר רה"ר ע"י צורת הפתח



א. בשו"ע סימן שס"ד סעיף ב' רשות הרבים עצמה אינה ניתרת אלא בדלתות, פירוש דכדי להתיר רשות הרבים דאורייתא,[1] לא מהני שיעשה צורת הפתח, אלא בעינן דלתות דוקא, ורק ברה"ר דרבנן מהני צורת הפתח להתירו.

ב. ונחלקו הפוסקים בדבר, י"א דהא דלא מהני צוה"פ ברה"ר דאורייתא, אינו אלא מדרבנן, אבל מן התורה מהני שפיר צוה"פ להתיר רה"ר גמור, וי"א דמדאורייתא לא מהני צוה"פ להתיר רה"ר.[2]


ג. ומעתה כאשר באנו לדון על איזה רחוב אם אפשר לתקנו ע"י עירוב של צורת הפתח, הרי לפי דעת הפוסקים הנ"ל (סעיף ב) שמן התורה מהני צוה"פ ברה"ר, נמצא שכל עיקר הנידון הזה הוא באיסור דרבנן,[3] שהרי מן התורה בודאי מהני צוה"פ, וממילא אין כאן שום חשש איסורא דאורייתא, אבל לפי הפוסקים הנ"ל (שם), הסוברים שמן התורה לא מהני צוה"פ ברה"ר, נמצא שאנו דנין באיסורא דאורייתא.

אבל עי' בשו"ע הרב סי' שס"ד סעי' ד' שכתב להדיא דרק ברה"ר גמורה שיש בו כל תנאי רה"ר בעינן דלתות וז"ל: "מד"ס אין צוה"פ מועלת לר"ה גמורה אם נשלמו בה כל תנאי רה"ר שנת' בסי' שמ"ה, הרי להדיא דאם חסר א' מתנאי רה"ר, ואינו רה"ר מה"ת מהני שפיר צוה"פ ולא בעינן דלתות, וכן כתב להדיא גם במ"ב סי' שס"ד ס"ק ה', וכן נקט בפשיטות בשו"ת אחיעזר ח"ד, עיי"ש שכתב אודות עיר פאריז, דאע"ג שיש בו בקיעת ס"ר מ"מ כיון שמוקף בג' מחיצות יכולים לערב ע"י צוה"פ, וכן הוא להדיא בשו"ת בית אפרים דף מ"ט ד"ה ועתה, דאם העיר מוקף מחיצות אפילו רחב ט"ז ויש בקיעת ס"ר דרך המחיצות, מ"מ מותר לערב ע"י צוה"פ במקום בקיעת הרבים עיי"ש, וכן משמע שם גם לענין תנאי מפולש משעל"ש עי' דף מ"ה בד"ה ולפי"ז [דרק בפלטיא נתקשה שם איך מערבין בצוה"פ כיון דבפלטיא לא בעינן מפולש משעל"ש, אבל בדרכים שאין בנ"א מתקבצים שם אלא עוברים, ובעינן מפולש משעל"ש, בזה משמע דאתי שפיר דמערבין בצוה"פ אפילו להפוסקים דלא בעינן ברה"ר ס"ר, ומוכח דכיון דחסר תנאי מפולש משעל"ש יכולים לערב בצוה"פ עיי"ש ודו"ק], והיוצא לנו מכל הנך פוסקים דאם אינו רה"ר גמור מה"ת מהני שפיר צוה"פ ולא בעינן דלתות.

ושורש מחלקותם בזה נחלקת לתרתי: חדא אי קיי"ל כרבנן (עירובין כ"ב ע"א) דלא אתי רבים ומבטלי מחיצתא, או דקיי"ל כרבי יהודה דאתי רבים ומבטלי מחיצתא, וכהא דאמר רבי יוחנן [אליבא דרבי יהודה] ירושלים אלמלא דלתותי' ננעלות בלילה חייבין עלי' משום רה"ר, דאי קיי"ל כרבי יוחנן בודאי דלא מהני צוה"פ להתיר רה"ר מה"ת, דאתי רבים ומבטלי מחיצתא, ואכן הרבה ראשונים העתיקו כרבי יוחנן, וכתב המשכנ"י בסי' ק"כ דכן נקטינן להלכה, וזהו מה שכתב המ"ב בסי' שס"ד [בביה"ל ד"ה ואחר] דרוב פוסקים העתיקו כרבי יוחנן, והכוונה רוב הראשונים, והיינו לפימ"ש המשכנ"י בביאור דעת הראשונים, ולפי דעה זו מן התורה לא מהני צוה"פ להתיר רה"ר.
ואמנם דעת רוב גדולי הפוסקים האחרונים דאנן קיי"ל כרבנן דלא אתי רבים ומבטלי מחיצתא, ועי' בשו"ת בית אפרים שהאריך להוכיח אשר כן הוא דעת הרמב"ם הרי"ף והרא"ש, ואשר כן הוא שיטת רוב ראשונים דקיי"ל כרבנן, וכתב הב"א דהכי נקטינן, וכ"כ החזו"א, וכ"כ הדרכי משה בסי' שס"ד ס"ק א, וכן נקט בפשיטות הח"ס בשו"ת חאו"ח סי' פ"ט, וכ"כ השו"ע הרב בסי' שס"ג סעי' מ"ב, ובסעי' מ"ד, ובסי' שס"ד סעי' א', וכן מוכח דעת המג"א בסי' שס"ג ס"ק ל' ובס"ק ל"ד ובס"ק מ', וכ"כ הנוב"י מובא בשו"ת תשובה מאהבה סי' קי"ב, והאבני נזר בסי' רע"ג ורע"ו, וכ"כ בישועת מלכו סי' כ"א, ועוד הרבה אחרונים.

ואמנם עוד נחלקו האחרונים לפי מאי דקיי"ל כרבנן דלא אתי רבים ומבטלי מחיצות, אי מהני צוה"פ להתיר רה"ר מה"ת, דהשו"ע הרב [בסי' שס"ד סעי' ד'], והמ"ב [בסי' שס"ד סעי' ד' בביה"ל ד"ה ואחר, ובסי' שס"ב בביה"ל ד"ה כשכל הרוחות ע"י צוה"פ], והערוה"ש [בסי' שס"ד], והאשל אברהם [בסי' שמ"ה בסו"ד], והאבני נזר [בסי' רס"ה , רע"ג, ורע"ו], והישועת מלכו [בסי' כ"א] וכן בשו"ת דברי נחמי' [סי' כ"ג], והצמח צדק [מס' עירובין פ"ה מ"ו בסופו] כולם תפסו בפשיטות, דלמ"ד לא אתי רומ"מ ממילא מהני צוה"פ להתיר רה"ר גמור מה"ת, ורק מדרבנן לא מהני, [אך דעת הדברי נחמי', וכן המ"ב, דקיי"ל כר"י דאתי רומ"מ, אבל עכ"פ מוכח בדבריהם דלרבנן מהני צוה"פ].

אבל החזו"א כתב דאפי' לרבנן לא מהני צוה"פ להתיר רה"ר מה"ת, דס"ל דצוה"פ גרוע מפסי ביראות [שם במתני'], ובזה אתי רומ"מ גם לרבנן, וכ"כ המשכנ"י [בסי' קכ"א] דכל שיש רחב ט"ז אמה גם לרבנן בעינן דוקא הדלתות, וכן יוצא לפי מש"כ הגר"ח הלוי בביאור שיטת הרמב"ם.

והפרמ"ג סי' שס"ג במשבצות זהב מספקא לי' אי צוה"פ נחשב מחיצה מה"ת להתיר רה"ר עיי"ש, ועי' ביאור הלכה סי' שס"ב בד"ה כשכל הרוחות ע"י צוה"פ, שהביא דברי הפרמ"ג, ומוכיח מהתוס' דף י"א דהוי מחיצה להתיר רה"ר.

The Washington Heights Eruv Controversy

Part of an ongoing commentary on the bias against city eruvin.

The Washington Heights eruv controversy has created a need to set the record straight regarding Rav Shimon Schwab zt”l’s objection to eruvin. [I plan a full post in the future about the underpinnings of the Frankfort 1914 eruv controversy, which no doubt Rav Schwab carried over with him to America.]

One of the primary reasons for establishing an eruv in Manhattan in 1962 was because an eruv helps to minimize chilul Shabbos by those who are unfortunately not religious (Divrei Menachem, O.C. vol. 2, p. 9-10, 13). Rav Schwab agreed that minimizing chilul Shabbos was a noble concern. However, he objected to an eruv because he maintained that the main difference at the time between the few who observed Shabbos and the majority who were lax in shmiras Shabbos was that the observant were careful not to carry. Therefore, Rav Schwab stated it is incumbent on the rabbanim to maintain this separation (Maayan Beis HaSho’eivah, p. 233). Additionally, he objected because the Manhattan eruv did not require any physical rectification (since they were not erecting tzuras hapesachim and only relying on the existing structures such as sea walls). This, Rav Schwab declared, would create a problem since there was no noticeable difference to the enclosed area, Manhattan. He believed that some would therefore claim that the same way rabbanim had found a way to allow carrying on Shabbos, they could find a way around other Shabbos stringencies as well (Maayan Beis HaSho’eivah, p. 233). This is in contrast to today where the majority of the community is fully observant and if an eruv was erected, it would add to their oneg shabbos. Additionally, since a tzuras hapesach has been erected, the other objection does not concern us as well.

More so, Rav Schwab agreed to an eruv in theory and he even posited that hopefully the future generations would be strong in Torah and at that point, with great joy, everyone would take part in erecting eruvin in Manhattan and in all cities (Maayan Beis HaSho’eivah, pp. 232, 234). The Breuer kehilla should realize that Rav Schwab’s hashkafic objections are not eternal and the time has come to move on and support an eruv (Rav Moshe Feinstin zt”l states that rabbanim may enact a takanah only for a short period of time; Igros Moshe, O.C. 4:49).

The fact that the Breuer kehilla is asserting that there are halachic issues that would preclude the establishment of an eruv proves that their concern has strayed from its roots. Rav Schwab’s issue was only hashkafah and not halachah. Why are they hindering the establishment of an eruv for reasons that are not their own. More so, the reason they give not to erect an eruv such as Rav Moshe zt"l's rulings against an eruv in Manhattan, does not prohibit this eruv. A tzuras hapesach encompassing only a small neighborhood has been erected, and Rav Moshe would not require delasos since the tzuras hapesach is erected in a reshus hayachid (see Part 4b: The Permissibility of a Brooklyn Eruv According to Rav Moshe Feinstein zt”l). [Regarding Manhattan, Rav Moshe had other issues besides for the requirement of delasos. There is no doubt though that his main issue was delasos and therefore it is very questionable if he would have opposed an eruv consisting of tzuras hapesachim (see Part 4c: The Permissibility of a Brooklyn Eruv According to Rav Moshe Feinstein zt”l; see also Would Rav Moshe Feinstein zt”l Allow an Eruv for the Lower East Side of Manhattan?).]

Extension of existing 'eruv' will allow simple tasks to get done

For more than 30 years now, Norm Garfield has not been able to retrieve his Saturday morning paper from the front lawn of his Wynnewood home. In fact, during Shabbat, he’s never been able to take advantage of a warm spring afternoon by lounging with a book in his own backyard.

“You couldn’t have lunch outside either,” said the 63-year-old Garfield, who is Orthodox, adding that when any of his six grandchildren come to visit, he’s never even been able to push them in a stroller to synagogue or the park.

That’s because Garfield’s home does not fall inside an eruv, a symbolic barrier surrounding an area within which Jewish law permits the observant to carry such things as keys, books, blankets, food ─ even children ─ outside of homes and synagogues come Shabbat. Even when his family’s synagogue, Congregation Beth Hamedrosh, created its own eruv in the mid-1990s that encompassed parts of Overbrook and Wynnewood, Garfield’s property was not included inside the boundaries. (I would like to point out two issues regarding this article that one should ask his rav about. 1) The issue of reading a newspaper on Shabbos, which some poskim consider it to be shtarei hedyotos. 2) The issue of having a newspaper delivered on Shabbos. Newspapers are usually delivered from outside the techum and it maybe also considered [maris ayin] amira l’akum.)

Part 4: Misconceptions in the Los Angeles Eruv Guidebook

The LA Eruv Guidebook:
Historically, the type of Eruvin constructed in the small towns …; the general public practiced leniency while the “Baal Nefesh” (those seeking a higher level of observance) were recommended to be Machmir.

This statement that historically only the, “general public practiced leniency,” is patently false. In some towns, even the rav carried (some even declared that one must carry; see Part 6: Meoz U’Mekedem – Exploring the Historical Roots of the Machlokas Regarding Eruvin) and the fact is, most people utilized their town’s eruv. This is even more so in regards to the LA eruv, where even a baal nefesh can rely on it since it consists of mechitzos.


The LA Eruv Guidebook:
Los Angeles, a city with a population of a few million, with streets that are relatively straight and extend for miles and service 600,000 people is unique. On the one hand, as stated clearly in the Responsa of R’ Chaim Ozer Grodzenski ZT”L, Los Angeles is definitely considered a Reshus HaRabim of 600,000 making our city more stringent than the small towns in Europe. On the other hand, the construction of an Eruv utilizing “walls” is better than the European Eruv which consisted solely of a Tzuras HaPesach.

How does one weigh the efficacy of an Eruv built with three walls with its breaches closed with a Tzuras HaPesach in a city with 600,000 people …? How would our contemporary Poskim classify the proposed Eruv in Paris?

This question was submitted to leading Poskim of our generation: Their response ranged from: “The Eruv should be relied upon only in case of true necessity” [רק יסמוך על העירוב בשעת הדחק, ואף בשעת הדחק המחמיר תבא עליו ברכה.] to “The decision to act stringently is one’s own private decision.”[[ הרוצה להחמיר יחמיר לעצמו

The RCC accepted to supervise the construction and maintenance of the Eruv and to certify it as Kosher, within the abovementioned parameters.


It is important to note again that there were European cities such as Warsaw and Lodz that contained population’s greater then 600,000 and nevertheless erected eruvin (see The Requirement of Shishim Ribo: Is It Conditional on a City or a Street). There is no question that until now the general consensus was that shishim ribo is conditional of a street (see The Overwhelming Majority of Achronim Maintain That the Shishim Ribo Has to Traverse the Street Itself). To reiterate, this is a simplistic and erroneous reading of the Achiezer’s teshuvah (4:8). Rav Chaim Ozer Grodzenski zt”l maintained that at least one street of the city would require shishim ribo traversing it before the entire city would be classified as a reshus harabbim (see Part 1: The Achiezer Explained). Additionally, it is interesting that the author writes, “with streets that are relatively straight,” alluding to LA meeting the criterion of mefulash, while never actually explaining why it does so. One has to wonder if the author inquired of the gedolim what their stance was regarding LA meeting the criterion of mefulash.

This claim in the name of gedolim, that the eruvin of yesteryear relied on the fact that the city did not contain shishim ribo and were therefore preferable to our mechitzos eruvin, is just not credible. We do not pasken that a baal nefesh should be stringent in an area enclosed by three mechitzos omed merubeh al haparutz. In contrast, regarding relying on shishim ribo, there are Achronim who maintain that a baal nefesh should be stringent. Therefore, it is unconscionable to make such statements in the name of gedolim when anyone who learned hilchos eruvin knows that an eruv consisting of mechitzos can be relied upon by all. More so, there are Achronim who clearly state that an area enclosed by mechitzos is superior to one relying on the criterion of shishim ribo alone (Bais Ephraim, p. 49b; Bais Shlomo, siman 51; Avnei Nezer, O.C. 279:2, and Chazon Ish, siman 107:7). In light of this, it is very doubtful that any posek would assert that the proposed eruv in Paris supported by the Achiezer is worse then the European small town eruvin.

Most importantly, it is a well known fact that when the issue is eruvin, statements said in the name of gedolim are deliberately misconstrued. Therefore, these declarations should be discounted. Let us see their opinions in writing! Additionally, it is interesting how when the subject is eruvin, so many people would like us to believe that they are baalei nefesh.

In closing this series, what can be gleaned from this guidebook is that even those rabbanim who are obligated to establish an eruv because of community demands go on to create difficulties with their eruv in order to satisfy their anti-eruv leanings and also those of their yeshivaleit constituents. It is unfortunate that some yeshivaleit have a misplaced antipathy towards city eruvin, believing that being machmer in eruvin is a lofty goal. Some yeshivaleit even learn hilchos eruvin with one goal in mind ─ to unearth as many chumros in eruvin conceivable. I find what Rav Yisroel Yaakov Fisher zt”l wrote to a group of yeshivaleit who were trying to implement chumros in eruvin (such as establishing small local eruvin) very refreshing. He wrote that the Yerushalayim eruv is just fine and does not require their rectifications (Even Yisroel, 8:37).

While there are some excellent passages in the guidebook (particularly regarding Rav Moshe zt”l’s shita in eruvin) much of it is typical rhetoric fostered by those who feel a need to promote hilchos issurei eruvin.

אם שייך ארעא לטסקא משתעבד בזמן הזה


יש להתבונן, אם הא דארעא לטסקא משתעבד שייך גם בזמן הזה. דהנה כבר הבאתי משו"ת עצי אלמוגים דכתב כן גם על זמן הזה, וכן כתב בשו"ת שואל ומשיב מהדורא תנינא (חלק ב' סימן ס"ב בסופו) דגם בזמה"ז יש להתיר מטעם דארעא לטסקא משתעבד, וכ"כ בשו"ת דברי חיים יו"ד (סימן מ"ב), וכ"כ בשו"ת נשמת חיים להגאון ר' חיים בערלין סי' ל' וסי' ל"א, ועיי"ש שכתב שלפי דברי העצי אלמוגים מהני אף בישראל ועדיף משכירו ולקיטו.

אמנם לכאורה יש להעיר מדברי הסמ"ע
(סימן שס"ט ס"ק י"ד) שכתב אהא דכתב המחבר (שם) דכשהמלך גוזר דכשאינו נותן המס, שאחר יאכל הפירות דינא דמלכותא דינא, זה דוקא בימיהם שגוף השדות היה שייך להמלך, והעכו"ם והישראל היה מנהגם רק להחזיק בהם לחרוש ולזרוע וכו', ובאופן כזה אין בו דין גזל, אבל אם גוף השדה שייך להישראל, אין המלך יכול להפקיע כל פירותיו בשביל המס. והט"ז שם תמה עליו מנין לו זאת. גם מצד הסברה נראה כן דכל הארץ של המלך ורשות בידו לקחתה ממי שאינו נותן המס, עיי”ש. ולכאורה לדעת הסמ"ע יש לעיין אם שייך ההיתר שכתבנו, אמנם לענ"ד ודאי מודה הסמ"ע לדברי הט"ז שהרי בסימן רע"ח שכתב רמ"א דיכול המלך ליקח הקרקע ממי שאינו משלם המס, לא פליג הסמ"ע דבזה"ז אינו כן, והרי הוא עצמו העתיק שם את דברי הנמ"י, דהקרקע עיקרו של המלך, אלא נראה דוקא בעובדא דסימן שס"ט, דהמלך לא לקח הקרקע מיד בעליו, אלא שצוה שאחר יאכל הפירות, אבל הקרקע ישאר מוחזק ביד בעליו הראשון, לאחר שיעבור השנה, א"כ הפירות באמת שייך לבעליו הראשון, דארעיה אשבח, ולפי"ז כשאחר אוכל הפירות ששייך להראשון, הוי גזל גמור, דמטלטלי אין ביד המלך ליקח מאחד וליתן להשני. אבל אם המלך לוקח עצם הקרקע מאחד ונותנו לאחר, מודה הסמ"ע שאינו גזילה כיון שהקרקע של המלך.




ביאר דברי התוספות דנוטל קרקע שוה אלף זוז בעד דבר מועט


ראיתי בפתחי תשובה (חושן משפט סימן רע"ח ס"ק ט') שהביא מתשובת קהלת יעקב, באחד שנתחייב להממשלה והעמיד בית אחד עבור הפרעון, אם בכור נוטל בה פי שנים, מאחר שמשועבד להמלך והוי ראוי, שהשיב דמיקרי מוחזק ונוטל בה פי שנים, דהרי כתבו התוס' דוקא משום שנוטל קרקע שוה אלף זוז בשביל דבר מועט, ואינו צריך אדרכתא ואכרזתא ושומא, ואינו מחוסר גביינא, אבל כהיום שגם חק המלך לגבות עפ"י שומא בדקדוק כפי דמי החוב המגיע להמלך, פשוט שאין זה רק כגבית חוב בעלמא, וקודם גבייה ברשותא דמרא קיימא, עיי"ש.

ונראה דמודה שגם בזמן הזה עיקר הקרקע של המלך הוא כמ"ש בסימן רע"ח, והוא עצמו ציין למש"כ הסמ"ע סימן שס"ט ס"ק י"ד וט"ו, והרי שם דמבואר להדיא דהקרקע של המלך הוא, ואפ"ה משכחת לה שהמלך לא נתן רשות להאחר שנותן המס, לאכול הפירות אלא עד שיחזרו הבעלים, ורק אם הגזבר מכר ממכר עולם מהני, הרי דהא דהקרקע הוא של המלך אינו מחייב שהמלך יקח יותר מחוב המגיע לו, משום דאינו רוצה
ליקח יותר מחובו אף שהוא שלו.

אלא נראה דהא דכתבו התוס' דנוטל
קרקע שוה אלף זוז בעד דבר מועט, אינו אלא ראיה דהקרקע שלו הוא, וכן מבואר להדיא בדברי הרשב"א שם וז"ל, ותדע לך וכו' ואי אפשר לבע"ח ליפרע אלא בב"ד ובשומא והכרזה וכדי חובו בלבד, אלמא לית ליה בגופן של נכסים כלום אלא שעבוד בעלמא, עכ"ל. הרי שזה אינו אלא ראיה שהקרקע של המלך, וודאי אף כשהמלך מוותר ואינו גובה יותר מכדי חובו, אכתי הוי של המלך, אבל הקהלת יעקב הבין כוונת התוס' דכיון דאינו מחוסר גביינא דהרי אינו צריך שומא, משו"ה הוי ראוי. ונראה כוונתו לפי מה שכתבנו לעיל, דבאמת זכות לאכול הפירות יש להבע"ב אף קודם שיהב הטסקא, ואפ"ה הוי ראוי דהוי כמשכנתא באתרא דמסלקי, ע"כ ס"ל להתוס' דאם צריך שומא והוי מחוסר גביינא, מיקרי מוחזק בהזכות לאכול הפירות, כמו אחר דיהבי טסקא, וזה לענין ירושת הבכור, אבל לענין לשכור מהמלך דהעלינו דתלוי למי ששייך גוף הקרקע, יודה הקהלת יעקב דגם בזמן הזה הוי של המלך.

שוב ראיתי בתשובת תורת אמת למהר"א ששון סימן קמ"ט שביאר, דהתוס' כתב שני דברים נפרדים, דמש"כ דלמס המלך אפילו קרקע שוה אלף זוז משעובדת לדבר מועט, ואין צריך אדרכתא ואכרזתא ושומא, זה שייך אף בדבר שאין עיקרו של המלך אלא אף שמשועבד לחוב אחר של המלך, והביא ראיה לזה דהרי קאמר ר' הונא בריה דר' יהושע שם דאפילו שערי דכדא משתעבד לכרגא, והרי מטלטלי דעלמא ודאי לא היה של המלך מעיקרא, ואפ"ה אמרינן שם דבטלה ירושת הבכור, אלא כונת התוס' לשני דברים, בתחילה כתבו דעצם שעבוד המלך עדיף משאר שעבודים, משום דא"צ שומא וכגבוי דמי, ואח"כ הוסיפו דגבי קרקע יש עוד טעם נוסף דהרי הוא עיקרן של המלך, וא"כ ודאי הוא מוחזק במה שהוא שלו, עיי”ש. ובאמת ברמב"ן ונמו"י שם לא הזכירו דברים אלו דהקרקע עיקרן של המלך, משום דמיירי שם אף משאר מסים שאינן
מכח הקרקע.

ולענ"ד גם דברי הרשב"א יתפרש כמ"ש מהר"א ששון בדברי התוס', דבתחילה כתב וז"ל וי"ל דלא דמי שעבוד חוב דעלמא לשעבודו של מלך, דאי מדינא שערי דכדא משתעבדא לכרגא, הלכך הוי מלכא כמאן דמוחזק בכלהו דמי, וזה שייך אף בכרגא, ואח"כ הוסיף הרשב"א ומוכר כל הקרקע על דבר מועט של טסקא שיש לו עליו, לפי שגוף הקרקע למלך הוא וכל שאין פורעין לו חקו נוטלו, וזה שייך רק על מס שעל הקרקע אבל
בשאר מסים לא שייך.

והנה בגוונא דהקהלת יעקב הנ"ל לא היה
השעבוד מחמת המס, אלא מחמת חובות אחרים שהיה לו להמלך, א"כ ודאי לענין זה לא שייך הא דקרקע של המלך, ולא שייך אלא טעם הראשון של התוס', דא"צ שומא ולא הוי מוחסר גביינא, וא"כ בעובדה שלו דהמלכות היה גובה רק ע"י שומא, ע"כ היה מחוסר גביינא ולא היה המלך מוחזק בהן, אבל בגוונא דמשעבד מחמת המס דשייך טעם הראשון של התוס', לא איכפת לן אם המלך גובה כדי חובו או לא, דהרי סו"ס עיקרו הוא של המלך.

ועיין ביד רמ"ה (ב"ב דף נ"ה) דברים המסייעים לדברינו, דביאר החילוק בין חיוב טסקא לחיוב שעבוד דעלמא, וז"ל (בד"ה והני) ועיקר הא מילתא משום דטסקא חיובא דארעא גופא הוא, וכו' ואשתכח דטסקא מנתא בעלמא הוא דאית ליה למלכא בגופא דארעא, ואמטול להכי כי מטו זמן מפרע טסקא ולא פרע מריה עילויה טסקא לגבאה דמלכא, לא צריכי גבאי למתבעיה וכו' דכי קא מזבני, ארעא דמלכא קא מזבני, ואילו כרגא וכו' אישתכח דחיובא דכרגא לאו גבי גופא דארעא הוא ואקרקפתא גברי מונח, כהודאות והלואות ואמטל להכי לית להו רשותא לגבאי לזבוני לארעא לכרגא, אלא אפומא דבי דינא עכ"ל. הרי דעיקר החילוק בין טסקא לכרגא הוא דא"צ לגבותו בבי דינא דאינו כמשועבד על חוב אחר, דכיון דצריך לשלם המס משום שיש להמלך חלק בהקרקע, ע"כ כשאינו פורע, ממילא נוטל
המלך חלקו בקרקע שהוא שלו.

ועיין בשו"ע הרב (הלכות גזלה ואבידה
סעיף ט"ו) וז"ל ועוד שהמלך מוחזק הוא במה שמגיע לו מעבדיו וכו' לפיכך כל הסחורה שמגיע ממנה המכס וכו' וכאילו הוא ברשותו ממש, כיון שהוא בארצו וכו' והמבריחה גוזל מנת המלך שבה מרשות המלך, עכ"ל. וזהו כדברי היד רמ"ה דאינו כשעבוד על חוב אחר, אלא יש לו חלק באותו הדבר עצמו, ואינו כהפקעת הלוואתו, אלא גזילה ממש.

ובאמת בדברי היד רמ"ה מבואר דלא היו
רגילים ליקח מן הקרקע יותר מן שיעור המס הקצוב, ואפ"ה ס"ל דאית להמלך בגופו של קרקע, וז"ל (שם בד"ה אמר ר' אשי) דכיון דאית ליה לשליחא דמלכא לזביניה מיניה כשיעור טסקא דמלכא מקמי דליתבעה למרה, כולה ראוי הוא, דכל פורתא ופורתא הוי חזי לזבוניה לטסקא, ואיכא למימר דהיא ניהו מזדבן עכ"ל. הרי דאף שאין לוקחין יותר מן שיעור הקצוב, אינו מגרע, דמ"מ עצם הקרקע שייך להמלך. [ומה שכתבו התוס' דנוטל כל הקרקע אינו אלא לראיה דהקרקע הוא של המלך, ועוד אפשר לומר דאין כוונת התוס' דבאמת נוטל המלך יותר משיעור המס, ולא כתבו אלא דקרקע אלף זוז משועבד לדבר מועט, ומשו"ה א"צ שומא דהרי אפשר לו לימכר כל הקרקע בעד השעבוד, אבל יתכן דמעות המכירה הנשאר יותר משיעור המס הוא מחזירו להבעה"ב, ומ"מ הוא מוחזק בכל הקרקע, אחר דאפשר למכרו כולו, וא"צ שומא בתחילה, כן נלע"ד לומר כדי להשוות דברי התוס' עם דברי הרמ"ה.]

ונראה דאף בגוונא דהיד רמ"ה כל הקרקע באמת שייך להמלך ולא שיעור המס לבד, דהרי ביד המלך להרבות ולהמעיט שיעור המס, כדמוכח שם מהא דאמר ר' אשי פרדכתא מסייע מתא וכו' עיי”ש. ואם נימא דיש לו בהקרקע רק שיעור המס, איך יכול להוסיף עליו יותר ממה שיש לו בהקרקע, אע"כ דכל הקרקע שייך להמלך, ומש"כ הרמ”ה דכל פורתא ופורתא הוי ראוי משום דאיכא למימר האי ניהו מזדבן, משמע דבלא זה לא הוי ראוי, היינו משום דאי היה ודאי שהמלך לא יקח חלק זה, הוי ככבר יהיב טסקא על חלק זה והוי מוחזק. ואמנם אף אם נימא בכוונת הרמ”ה דרק סכום מס הקצוב שייך להמלך בהקרקע, מ"מ מהני לשכור לענין שבת מן המלך את רשותם, דהוי כשני שותפים דמהני לשכור מאחד מן השותפים, כמו שביאר היטב בתשובת אבקת רוכל סימן
מ"ז שהבאתי.

Part 4c: The Permissibility of a Brooklyn Eruv According to Rav Moshe Feinstein zt”l

The only issue Rav Moshe zt”l had with the Brooklyn mechitzos was that he required delasos (Igros Moshe, O.C. 5:28:5) and as stated above, since we are erecting the tzuras hapesachim in a reshus hayachid, Rav Moshe would not have required delasos. However, regarding Manhattan, Rav Moshe stated that, based on additional shitos yechidaos (shitas haRashbah and Rabeinu Ephraim), even with mechitzos and delasos at the pirtzos, Manhattan would not be classified as a reshus hayachid (ibid., 1:39:5-6).

Even these shitos yachidaos would not affect an eruv in a Brooklyn neighborhood for the following reasons:

  • Rav Moshe only utilized these shitos in conjunction with his chiddushim regarding delasos and the similarities he noted between Manhattan and Yerushalayim (see Yerushalayim of Old and Brooklyn: A Common Thread?) to nullify the benefit the mechitzos surrounding Manhattan would have provided (ibid., 1:39:6). However, since Rav Moshe would concur that delasos are not necessary when a tzuras hapesach is established in a reshus hayachid and the issue of Yerushalayim does not concern us in Brooklyn as well (see Yerushalayim of Old and Brooklyn: A Common Thread?), there is no question that Rav Moshe would have allowed an eruv in Brooklyn in its current construction. Therefore, in regards to Brooklyn’s mechitzos, Rav Moshe only refers to his requirement of delasos and not to these shitos yachidaos (ibid., 5:28:5).
  • Rav Moshe at first stated in a teshuvah regarding Manhattan (ibid., 1:140) that he was unclear whether mefulash is considered a criterion of a reshus harabbim. On the other hand, according to those who do regard mefulash as a criterion of a reshus harabbim, since the streets of Manhattan were not mefulash the mechitzos would classify Manhattan as a reshus hayachid ― or me’d’rabbanan as a karmelis. In which case, notwithstanding these shitos yachidaos, Rav Moshe allowed that delasos at the pirtzos would be the only requirement. However, in a later teshuvah regarding Brooklyn (ibid., 5:28:7) Rav Moshe does accept that for a walled city to be classified as a reshus harabbim there is a requirement that its streets ― to be analogous to the diglei hamidbar ― would need to be mefulash u’mechuvanim m’shaar l’shaar, a criterion of a reshus harabbim (see Part 1: Why Brooklyn Is Not a Reshus HaRabbim). [This is contrary to Rav Aharon Kotler’s zt”l’s understanding of the criterion mefulash u’mechuvanim m’shaar l’shaar as being dependent solely on mechitzos and not a criterion of a reshus harabbim (see Mishnas Rav Aharon, 6:2).] Therefore, given the fact that Brooklyn is enclosed by mechitzos and its streets are not mefulash u’mechuvanim m’shaar l’shaar, Brooklyn would not be classified as a reshus harabbim at all, and Rav Moshe would agree, that these mechitzos would classify Brooklyn as a reshus hayachid, notwithstanding these shitos yachidaos. Consequently, in regards to Brooklyn, Rav Moshe only mentions that there is a requirement of delasos if Brooklyn is enclosed by mechitzos (Igros Moshe, O.C. 5:28:5). However, as explained previously, since we are erecting a tzuras hapesach only around a section of Brooklyn, delasos would not be required as well.

History of City Eruvin − Part 2: The Eruv in St. Louis

Introduction

The Jewish Community of St. Louis

Most of St. Louis’s Jews up until the 1920’s, lived in an area referred to in the press as the Jewish Ghetto. This crowded rectangular area in the near north side of St. Louis, was roughly bounded on the east side by the Mississippi River, on the west side by Grand Avenue, on the north side by Cass Avenue, and on the south side by Delmar Boulevard. By the 1930’s, most Jews had already abandoned the Ghetto by migrating westward, forming an area called the “central corridor.”[43]

From the year 1807, when the first Jew settled in St. Louis until 1925, St. Louis’s Jewish population grew to approximately 55,000.[44] At the time, it had the tenth largest concentration of Jews in the United States.[45] The Jewish population has held steady at fifty-five to sixty thousand since then.[46] The general population in 1890 stood at approximately 452,000 and reached its peak by 1950 at about 857,000; it has since declined considerably.[47]


An Overview of the Controversies

When Rav Rosenfeld came to St. Louis in late 1893, his first order of business was eruvin and mikvaos.[48] He ruled that the area in St. Louis where the Jews lived was encompassed by mechitzos, and that it was permissible to carry therein. Additionally, Rav Rosenfeld published his first kuntres, Tikvas Zechariah, where he declared that the manner in which the existing mikveh was constructed made it unkosher.[49] In his sefer Sho’el Ka’inyan, Rav Jaffe, the baal machsher of the mikveh, lashed out and declared that Rav Rosenfeld’s eruv was not kosher[50] and also refuted the charges leveled against his mikveh.[51] Sometime later, Rav Rosenfeld published a second kuntres also called Tikvas Zechariah elucidating his heter for the eruv.[52] Rav Jaffe then published a rebuttal, Teshuvah KaHalachah VeDivrei Shalom.[53] Judah David Eisenstein wrote of two other halachic conflicts between Rav Jaffe and Rav Rosenfeld.[54] However, this is questionable since the dates of these controversies predate the year that Rav Rosenfeld came to St. Louis.[55]

Rav Jaffe wrote his defense of his mikveh in January of 1894 (ibid., p. {19} 37) but the sefer was not published until 1895 (see ibid., title page). The Kuntres Tikvas Zechariah, vol. 1 on the subject of mikveh could not have been written earlier then February of 1894 (see introduction, p. 7) but was published soon afterwards. Since the Tikvas Zechariah on the subject of mikveh was published first, Rav Jaffe was able to peruse it and insert in his Sho’el Ka’inyan (pp. 204-227) along with his earlier original defense, an actual word for word rebuttal.

Rav Jaffe maintained that St. Louis ended with a zayin instead of a samech, and that Mississippi was spelled without a double samech and peh. Eisenstein is in error since this conflict happened in 1892, and, as I will demonstrate later, Rav Rosenfeld did not come to St. Louis until late 1893 (see note 57). The date of this conflict can be discerned from a teshuvah regarding this issue in Rav Jaffe’s Sho’el Ka’inyan (Addendum p. {7} 13), which is dated the second day of parshas Sh’mini, 1892. [Since in 1892 the second day of parshas Sh’mini fell on Shvi’i shel Pesach, it is possible that the date of the teshuvah is a typo; however, I still maintain that this disagreement was with a different rav, as discussed further.] Rav Jaffe did comment in passing (Teshuvah KaHalachah VeDivrei Shalom, p. {14} 27) on the spelling of the Mississippi River in Rav Rosenfeld’s eruv teshuvah, and there is a letter from Rav Willovsky [Ridvaz] to Rav Jaffe dated September 1894 (ibid., p. 12) stating that Rav Jaffe is correct regarding the Hebrew spelling of the Mississippi River (see also ibid., p. 42, for Rav Jaffe’s remark dated December 12, 1894, in his correspondence to Rav Yosef Zechariah Stern that Rav Stern agreed with him regarding the Hebrew spelling of St. Louis). However, the fact that Rav Jaffe did not mention Rav Rosenfeld by name in his Sho’el Ka’inyan teshuvah regarding the Hebrew spellings for St. Louis and the Mississippi River when writing a get as he did by the mikveh and eruv conflicts where he ruthlessly condemned him, leads me to believe that Rav Jaffe had this conflict previously with a different rav.
In fact, there was a letter at Kestenbaum & Company’s Fine Judaica Auction (November 21st, 2006, lot number 227) regarding this issue. In the auction catalog they state “Jaffe, Shalom Elchanan (Chief Rabbi of St. Louis, 1858-1923). Autograph letter signed to R. Shmuel Salant, Chief Rabbi, Jerusalem. Concerning a judicial dispute Jaffe had with R. David Rudensky concerning the correct spelling of “St. Louis” in a bill of divorce (“Get”). Jaffe felt it should be spelled “Sant Louiz” with a “Zayin” as the final letter, rather than “Samach” as his opponent had written. St. Louis 1893.” In the catalog they added a bibliographical note, “Chief Rabbi of Saint Louis, Missouri, Jaffe’s vitriol, accusing his opponents as being “scornful jesters and liars,” even “full-fledged heretics.” R. Shmuel Salant had previously written Jaffe protesting his aggressive ways and Jaffe acknowledges here, he may have overstepped his bounds of decency in his tirade, however he unequivocally states he is more distinguished than any other American Rabbi and has no need to consult with them.” I will discuss at a later date my evidence that this argument with Rav Rudinsky started already in 1891 (there will be more about Rav Rudinsky when I write about the 1905 New York eruv).
To this day, the accepted way to spell St. Louis on a get is with a samech instead of a zayin and the Mississippi River with a double samech and peh (see Kuntres HaShemos HaChadash, pp. 12, 17). Rav Sholom Rivkin, the current Chief Rabbi of St. Louis, states that the way that the gitten are written today is based on the previous Chief Rabbis of St. Louis, going as far back as Rav Yissachar Dov Illowy (Kuntres HaAretz L’Areha, p. 39).
The other contentious issue according to Eisenstein (Ozar Zikhronothai, p. 350) was regarding a shochet who forgot to mark an animal kosher after slaughter; Rav Jaffe did not want to rely on the fact that the shochet can distinguish that he slaughtered this particular animal. While Rav Jaffe doesn’t give a date on this teshuvah (Sho’el Ka’inyan, pp. 47-68) his letter of support from Rav Shmuel Salant regarding this issue is dated April of 1892 (Sho’el Ka’inyan, p. 68). Therefore, it is not possible that Rav Jaffe was disagreeing with Rav Rosenfeld who first came in late 1893. The fact that Rav Rosenfeld is not mentioned by name lends support to this conclusion as well. Additionally, when this argument broke out, Chief Rabbi Yaakov Yosef Joseph, of New York wrote a scathing letter regarding Rav Jaffe. Actually, I have proof that this disagreement was also with Rav Rudinsky. I will write more about all of this at a later date.
