מעתה עלה בידינו שמהני לשכור מן המלך גם רשותם של הישראלים, אפי' לדעת הפוסקים דלא מהני שכירות גבי ישראל, מ"מ מהני לשכור מן המלך רשותם, כמ"ש הגינת ורדים ות"ל ישבתי כל השגות העצי אלמוגים מעליו, אמנם ברשותם של השומרי תו"מ המוחים בעירוב אם מועיל שכירות מן המלך, תלוי בהטעמים של ההיתר, אם ההיתר הוא משום שהמלך נעשה שכירו ולקיטו של בעה"ב ודאי לא מהני אם מוחה, כמ"ש האבני נזר הנ"ל וכן הפרי מגדים סימן שס"ז, דדוקא גבי נכרי מהני בע"כ, אבל גבי ישראל לא עדיף שכירו ולקיטו מבני ביתו, דלא יוכלו לערב רשותם בע"כ, וה"ה שכירות מן המלך לא יוכלו לעשות בע"כ של אלו [זולת לדעת הב"ח דדוקא כשמחה בפירוש, אם כן צריך שימחו בהמלך בפירוש], אבל לההיתר של העצי אלמוגים והשואל ומשיב והדברי חיים דהקרקע הוא של המלך, מטעם שמשועבד למס, אם כן יש להסתפק אפשר דמהני בע"כ של בעה"ב כיון שהבתים הם באמת של המלך, אם כן איך ימחו הבעה"ב בהמלך, אך י"ל כיון דמכל מקום זכות הדירה יש להבעה"ב בבתים שלהם, וביארתי דנעשים כאורחים רק מצד תקנת חז"ל של שכירות וביטול, אם כן באופן דלא מהני בע"כ אינם נעשים כאורחים, דבכהאי גוונא לא תיקנו חכמים.

אמנם נלענ"ד דזה אינו, דאף שכתבו המג"א והפמ"ג, דלא מהני שכירו ולקיטו בע"כ גבי ישראל וכמ"ש האבנ"ז, היינו דלא עדיף מבני ביתו דלא מהני בע"כ, דלעולם צריך דעת אשתו, אבל לדעה הב' בש"ע שהוא דעת הרמב"ם, דברגיל לערב יכולים בני החצר ליטול ממנו בע"כ, ובביאור הלכה כתב שיש לסמוך על דעה זו להקל, א"כ ה"ה בשכירות יכולים לשכור משכירו ולקיטו בע"כ של בעה"ב, כיון שהבעה"ב אינו יכול לעכב, וא"כ חוזר וניער כח השכירו ולקיטו, וכן כח הממשלה בהבתים, ונראה דלענין שכירות אינו צריך רגיל, דמה שצריך רגיל ביאר המ"מ וז"ל, וכשאינו רגיל אין יכולין לבא לביתו ולרדת לנכסיו, אבל כופין אותו בבית דין להשתתף וכו', או שבית דין יורדין לנכסיו עכ"ל, והיינו דאין להם רשות ליכנס לביתו וליטול הפת, אבל עצם העירוב יכולין לעשות בע"כ, אם כן גבי שכירות משכירו ולקיטו דא"צ ליקח מנכסיו כלום, סגי באוסר וא"צ רגיל. וכן ביאר הט"ז סימן שס"ז בסופו וז"ל ודומה לזה הוא לסברת היש אומרים דכאן שהוא הרמב"ם דס"ל דהב"ד כופין ליתן והן מערבין עיי"ש.

ובאמת אף לדעה הראשונה דלעולם צריך דעת אשתו, מ"מ לפי מה דהעלו האחרונים שבמשנ"ב ס"ק כ' דהיכא שהפת כבר מונח בידם, א"צ דעת אשתו בגוונא דיכולין לכופו, כגון ברגיל וה"ה באוסר כמ"ש בשעה"צ אות ט"ו, וכ"כ בנתיב חיים שם, ועיין בקרבן נתנאל פרק חלון סימן ט' אות נ' ואות פ' דביאר כן באריכות וכן ביאר בספר בגדי ישע, א"כ גבי שכירות רשות דא"צ ליתן את הפת, א"כ א"צ דעת אשתו, ובני החצר יכולין לכופו, א"כ ה"ה ששוכרין משכירו ולקיטו בע"כ, כיון דאינו יכול לעכב על בני החצר, והפר"מ שכתב דלא מהני משו"ל בע"כ הוא משום דמיירי מעירוב דצריך פת, ואפשר גם בשכירות ס"ל כן כדעת המג"א דגם שיש הפת בידם צריך דעת אשתו, אבל להאחרונים במשנ"ב ס"ק כ' הנ"ל מהני שכירות בע"כ משכירו ולקיטו כשאוסר.

ומה שכתב הב"י בסימן שפ"ב דהא דהקילו בשכירות משכירו ולקיטו של נכרי בע"כ, הוא משום דדירתו כדירת בהמה, ולכאורה למ"ש הרי גם גבי ישראל יכולין בני החצר לערב בע"כ לדעת הרמב"ם, ולהאחרונים הנ"ל אף לדעת הרא"ש, נראה לישב, דדוקא גבי ישראל ראוי שיהני בע"כ כמ"ש הט"ז סימן שפ"ב ס"ק י"ב דאנו יכולין לכוף את ישראל לקיים דבר מצוה, משא"כ בעכו"ם, א"כ היה מן הדין דגם משכירו ולקיטו אין יכולין לשכור כיון שהעכו"ם אינו רוצה והרשות שלו הוא, להכי איצטרך הב"י לומר דמ"מ הקילו משום שאינו אוסר מעיקר הדין, אבל גבי ישראל באופן שיכולין לכוף אותו לקיים המצוה, יכולין לשכור משכירו ולקיטו שלא לרצונו, היכא דלא צריך דעת אשתו.

לכן נראה דגם המג"א ס"ל דהא דצריך דעת אשתו הוא משום הפת כהאחרונים הנ"ל, רק ס"ל דאף שכבר עירבו כיון דחוזר בו הוי הפת גזול, כיון דליכא דעת אשתו, ומשו"ה ס"ל דלא מהני לדעה ראשונה, אבל הב"ד דיכולין לכפותו ולירד לנכסיו, שוב אין חשש ומהני עירוב בע"כ אף בלא דעת אשתו, וא"כ גבי שכירות גם להמג"א וכ"ש להא"ר יכול הב"ד לשכור משו"ל בע"כ של הבעה"ב, ואפשר דאף ב"ד א"צ דלפמ"ש הא דצריך ב"ד הוא משום הפת, א"כ גבי שכירות דליכא פת
א"צ ב"ד.

והנה בשו"ת דברי יציב חאו"ח סי' קע"ג כתב, דהיכא דיש רבנים ות"ח אחרים שס"ל שאין העירוב כשר מחמת טעמים ע"פ הלכה, א"א להב"ד לכופם לערב, מאחר שהם ס"ל דאין לערב, ולענ"ד נראה כוונתו דוקא כשצריך ליתן פת לעירוב, דכיון דאם אין העירוב כשר אין יכולים לכוף ליתן פת לעירוב, א"כ כשת"ח ס"ל דאין יכולין לערב א"א לכופם ליתן פת, דהמוציא מחבירו עליו הראיה, וכיון דלידדהו אין העירוב כשר, אין דין כפיה, ויש חשש פת גזולה, אבל גבי שכירות שאין אנו כופים אותן ליתן כלום, אלא ששוכרים את רשותם בע"כ, א"כ יכול הב"ד לכופם להשכיר את רשותם, והב"ד האחר אינו יכול לעכב, דכיון דאין מוציאין מהם כלום, א"כ ממ"נ אם העירוב כשר הרי יש דין כפיה עליו אף שהוא ת"ח, ואי נימא דאין העירוב כשר א"כ הרי לא חל השכירות ולא לקחו מהם כלום, א"כ מאן דסומך על העירוב דכשר, א"כ ממילא יש דין כפיה ויכול לסמוך על מה ששכרו הב"ד בע"כ.

וכן מוכח מדבריו שהאריך בדין אם מהני
שכירו ולקיטו גבי ישראל, משמע מדבריו דבאופן שמהני גבי ישראל, היה מהני בעובדא דידיה, אף שהיה בע"כ, והוא מטעם שכתבתי, כיון דאין לוקחין פת מידם.

ובענין השכירות, אף שהדברי יציב ס"ל כדעת המשיב דבר שהבאתי שלא מהני גבי ישראל, הרי מבואר בדבריו שם דזה דוקא לענין שכירו ולקיטו ע"י הנחת כלים, או כשיכול לסלקו רק בשעת מלחמה ושלא בשעת מלחמה אין לו שום כח, וכמבואר בחכם צבי דכשאין ביד השר לעורר מדנים, אין לו כלום בהבתים שלא בשעת מלחמה. אבל אם יתברר ששר
העיר יכול לסלק בכל עת הצורך לצרכי העיר אפילו שלא בשעת מלחמה, ואין צריכין לימלך בבני המדינה [כמו שנתברר לאחרונה דכן הוא במדינתנו], משמע מדבריו שם דהיה מודה דמהני גבי ישראל.

וכן ס"ל בשו"ת מהר"ם בריסק סי' קי"ט שדעתו כדעת המשיב דבר דלא מהני שכירו ולקיטו ע"י הנחת כלים אלא גבי עכו"ם ולא בישראל, אפ"ה כשיכול לסלקו מן הבתים לצורך העיר, ס"ל דזה מהני גם לגבי ישראל [דהוא החמיר שם שמומר דינו כישראל ואוסר מדינא].



ביאור דברי הגינת ורדים דהמלך עדיף הרבה משכירו ולקיטו לענין בע"כ


עוד נלענ"ד, דהנה הגינת ורדים כתב, דבתיהם של צדוקים מושכרות אצלינו בדינא דמלכותא ושוב אינם אוסרים עלינו, והעצי אלמוגים נתקשה בכוונתו, אם ס"ל דמהני שכירו ולקיטו גבי ישראל למה הוצרך לומר שמשועבד בדינא דמלכותא, ומה מהני דינא דמלכותא על זה.

והנלענ"ד כוונת הגינת ורדים דהנה מה שא"א לבני ביתו ושכירו ולקיטו לערב בע"כ של הבעה"ב היינו משום שהם כפופים תחתיו, והרי דעת הב"י סימן שס"ז בדעת הרמב"ם דאשתו גרע אפי' מבני החצר, והיינו דכיון דאשתו כפוף תחתיו אין לה לערב בע"כ של בעה"ב, וה"ה שכירו ולקיטו כפוף תחת הבעה"ב, משא"כ בני החצר יכולין לכופו, כיון שאינם כפופים תחתיו, [ועיין מ"א ס"ק ד' שחולק על הב"י] ומעתה ס"ל להגינת ורדים דאף דכח המלך להשכיר נלמד מדין שכירו ולקיטו, מ"מ בדין בע"כ ודאי עדיף הרבה כח המלך מכח השכירו ולקיטו, דהשו"ל הרי הוא כפוף תחת הבעה"ב, ומשו"ה א"א לו לערב בע"כ של הבעה"ב, משא"כ המלך אינו כפוף כלל תחת הבעה"ב, אדרבה הרי יכול לגזור גזירות מצד דינא דמלכותא בע"כ של בני המדינה, א"כ ה"ה שיכול להשכיר בע"כ של הבעה"ב, ולענין בע"כ הוא עדיף הרבה מאשתו ושכירו ולקיטו ומהני בע"כ.

Part 1: Rav Eliyahu Henkin zt”l and an Eruv in New York City

There has been much confusion disseminated on the topic of Rav Henkin’s position regarding an eruv in Manhattan and Brooklyn. Because of Rav Henkin’s stature as one of the preeminent poskim in America, the significance of his position cannot be underestimated. It is therefore understandable that the anti-eruv camp would try to deceive the public into believing that he was opposed to an eruv in New York. In the following post, I will set out Rav Henkin’s positions as they appeared in print.

Rav Henkin’s first mention of a Manhattan eruv was in 1936 (Luach HaYovel Shel Esras Torah, p. 62). He declared that Rav Yehoshua Seigel zt”l’s eruv of 1905 could no longer be relied on because Rav Seigel had only enacted sechiras reshus for ten years. However, the main reason Rav Henkin asserted that the eruv is problematic was because of the establishment of bridges that negated Manhattan’s waterfront. This letter was later reprinted in Edus L’Yisroel, 1949 [1] (p. 151) where Rav Henkin added a paragraph in which he stated that although someone mentioned to him that most of the bridges in fact comprise an integral tzuras hapesach, he refutes this claim (see note 3). He added that there is an additional matter of asu rabbim u’mevatlei mechitzta since the borough of Manhattan contains shishim ribo. However, he admitted that Rav Seigel had already paskend regarding this issue [that we do not say asu rabbim because Manhattan is encompassed by mechitzos and that the shishim ribo would need to traverse the street itself] (Oznai Yehoshua, siman 18).[2]

In 1949, the Amshinover rebbe zt”l urged Rav Tzvi Eisenstadt zt”l to establish an eruv that included the whole Manhattan. In 1959, the Shotzer rebbe, Rav Yosef Dovid Moskowitz zt”l, published his sefer Kuntres Tikkun Eruvin Manhattan with a haskamah from Rav Henkin (November 24, 1958). The Shotzer rebbe mentions (Kuntres Tikkun Eruvin Manhattan, p. 45) that he investigated the Manhattan waterfront and its bridges in 1954 and again in 1959 and found that they were enclosed with tzuras hapesachim. However, Rav Henkin stated in his haskamah that he was still not clear regarding the validity of these tzuras hapesachim. Half a year later (March 26, 1959), at a meeting in Rav Henkin’s house regarding the issue of the Manhattan eruv (Divrei Menachem, O.C. vol. 2, p. 38), the bridges and tunnels were discussed and it was agreed upon that they were sufficiently enclosed. By March 15, 1960, Rav Henkin signed on a kol korei of the Vaad L’Maan Tikkun Eruvin B’Manhattan (ibid., p. 10; see below) that stated the need to investigate how to bring to fruition the plan for a Manhattan eruv. On November 3, 1960, Rav Henkin wrote a letter to Rav Menachem Kasher zt”l (ibid., p. 14) stating that while he agreed with the rabbanim who supported an eruv regarding certain points, he still had some doubts regarding other issues, particularly if all the pirtzos were closed. He went on to say that one could rely on the rabbanim who suppored the eruv and particularly on the Shotzer rebbe who expounded on the [heter for the] bridges and tunnels.[3] Rav Henkin then stated that he couldn’t pasken for the whole city, which contained many great rabbanim until there was some consensus on the issue. He reiterated that the main point was that the pirtzos should be built up, and that there should be a person in charge of making sure that the pirtzos are closed. In a following letter to Rav Kasher (ibid., pp. 14, 135), Rav Henkin stated that since there were many rabbanim in Manhattan, he was not the person in charge of this matter. He continued that he would follow Rav Moshe Feinstein’s lead and not join those who supported an eruv, but he would also not object to those who allowed one.

On July 12, 1961, Rav Henkin wrote his final letter regarding eruvin to the Vaad L’Tikkun Eruvin B’Manhattan (ibid., pp. 14-15; Hapardes 36th year, vol. 4, and Kisvei Hagriah Henkin, pp. 32-33). He stated that there was a sound basis to establish an eruv in Manhattan and that the borough was no different than other cities that had erected eruvin and was even superior to them [because of its mechitzos]. He continued that the Vaad was comprised of prominent rabbanim, admorim and baal habattim, under the auspices of Rav Kasher, Rav Eisenstadt and the Shotzer rebbe, who were all working on obtaining the support of other rabbanim after which they would call a meeting of the rabbanim to conclude the matter of establishing the eruv. Rav Henkin declared that it was his belief that they should not wait until this meeting of the rabbanim to proceed, because from experience, he knew that it would take a great deal of time until it would come together, and it was a pity to wait so long. Rav Henkin recommended that instead they should immediately rectify what needed to be corrected and then publicize that there were rabbanim who were responsible for the kashrus of the eruv. However, until the Vaad would receive the written support of most of the rabbanim of Manhattan, the heter for the eruv would only be for times of great need. On the other hand, once they had garnered the necessary support from most of the rabbanim, they could publicize that the heter was for all. Rav Henkin gave some examples of what he considered a great need; Women and children who felt a need to leave their apartments on Shabbos, particularly during the summer, doctors who needed to carry for a choleh shain bo sakana, the need to carry on Shabbos that falls on Succos. Rav Henkin added, among other things, that the Vaad should place advertisements in the newspapers stating that only the borough of Manhattan is included in this eruv. The Vaad should establish a fund to pay the salaries of two masgichim, and that the rabbanim should expedite the establishment of mechitzos for the boroughs of Brooklyn, Bronx, and Queens, since they do not have a general eruv. He also suggested that the Vaad designate two talmidei chachamim who are experts in hilchos eruvin to answer people’s questions regarding eruvei chatzeiros in the other boroughs.

It’s important to note that besides for what is stated above, Rav Henkin’s grandson has mentioned as well that he was supportive of an eruv in Manhattan (see the comment to this post Flatbush Eruv on Hirhurim here).

From Rav Rav Henkin’s final letter we see that he supported an eruv in Manhattan and Brooklyn (and all the boroughs). Additionally, it is important to note that in the end, his final issue was not regarding the halachic feasibility of erecting an eruv but only that there should be some consensus. The next post regarding Rav Henkin and a New York eruv will address the claims made by the anti-eruv group.

[1] The date of the publishing of Edus L’Yisroel is unclear. JNUL claims a date of 1949, but in Kisvei Hagriah Henkin (1981) they maintain 1946 (see the hakdamah) or 1952 (see title page). JNUL probably relied on the fact that there is a letter dated 1949 from Rav Yitzchok Isaac HaLevi Hertzog zt"l (p. 19) therein. Nevertheless, this only gives us the earliest date it could have been published by. However, I found that the copy of Edus L’Yisroel in the New York Public Library had an acquisition stamp dated 1949. An additional proof that Edus L’Yisroel was published sometime in 1949 is that the luach printed in the back starts from 1950.
[2] It is important to note that Rav Henkin referred to Rav Seigel’s sefer Oznai Yehoshua and not Eruv V’Hotzaah because the former deals with the issue of Manhattan being a reshus harabbim whereas the latter mainly deals with the matter of being able to carry in Manhattan (more about this issue when I detail the history of the first Manhattan eruv).
[3] With this letter (1960), Rav Henkin came full circle from the time he wrote in Luach HaYovel Shel Esras Torah (1936) that the bridges were problematic. In this letter, he allowed that one could rely on the Shotzer rebbe who described in detail the tzuras hapesachim that closed the bridges. Since the Shotzer rebbe did not actually build tzuras hapesachim, but utilized the integral tzuras hapesachim of the bridges themselves, the integrity of the bridges was never really an issue to begin with, and these bridges were sufficiently closed. In essence this meant that when someone mentioned to Rav Henkin in 1949 (Edus L’Yisroel, p. 151) that most of the bridges comprise of an integral tzuras hapesach this in fact was correct, and those who carried when the Third Avenue El was standing (until 1955; see Part 1: The Truth About the Satmar Rebbe and a Williamsburg Eruv) were, besides for the issue of sechiras reshus, actually using a kosher eruv (more about this issue when I detail the history of the first Manhattan eruv). [It’s important to note, as mentioned above, that by 1949 there was a movement to establish an eruv for the whole Manhattan.]

Part 6: Things You Have Always Wanted to Know About the Flatbush Eruv (But Were Never Told)

Q. Isn’t it stated in the anti-eruv brochure [65] that some Gedolei Eretz Yisroel such as the Gerrer Rebbe shlita and Hagaon Harav Shmuel Wosner shlita endorsed the position of the anti-eruv signatories?
A. In The Community Eruv kuntres [66] there is a letter from Hagaon Harav Berish Schapiro shilta, the Naroler rav, in which he recounts discussing with Hagaon Harav Shmuel Wosner shlita the supposed claim that he had aligned himself with these emissaries from Brooklyn against his son Hagaon Harav Benzion Y. Wosner shlita, the Baal Machsher of the Flatbush eruv. Rav Wosner senior asserted that chas v’shalom he would never say anything against his son who is a major talmid chachom and that the Naroler rav could publicize this fact. This is contrary to what the anti-eruv brochure reported and thus calls into question the veracity of the responses of any of the other Gedolei Eretz Yisroel to these activists. Additionally, it is well known that the Gerrer rebbe refers all halachic issues to the poskim and doesn’t involve himself with matters of halachah. Consequently, despite what the brochure alleges, the Gerrer rebbe refrained from commenting on this matter. The Gerrer rebbe shlita, however, did question Hagaon Harav Benzion Y. Wosner shlita about the Flatbush eruv and was pleased when Rav Wosner answered that it consists of mechitzos.

Additionally, if a Brooklyn eruv is so severely prohibited these activists should have returned with letters of substance from these Gedolim in Eretz Yisroel instead of merely statements that the Gedolim supported their position? Can these statements be accepted at face value when until now there have been so many questionable kol koreis from the anti-eruv group?[67] [Sadly enough, when they finally do publish a letter of some substance, e.g. from Hagaon Harav Dovid Feinstein shlita, it is obvious from its contents that Rav Dovid has been misinformed.[68] Another example is the letter from Hagaon Harav Shmuel Aurbach shlita where we see that he was told that laypeople had erected the eruv even though the anti-eruv group themselves admitted that there were rabbanim supporting the eruv.[69]] Furthermore, isn’t it unlikely that Gedolim in Eretz Yisroel would oppose eruvin in large cities when every city in Eretz Yisroel has eruvin? In Eretz Yisroel, eruvin are maintained in Yerushalayim and in the Gush Dan [Bnei Brak with all the interconnected neighborhoods] even though these regions have more than shishim ribo?[70]

In the interest of fairness, however, it would have been appropriate for the anti-eruv delegation to invite the Flatbush rabbanim who are supportive of the eruv [or even Hagaon Harav Yechezkel Roth shlita who is asked many shailos by Flatbush residents] to join them to ensure that both sides would be equally represented when they consulted with the Gedolei Eretz Yisroel.

Q. But didn’t Hagaon Harav Berish Schapiro shlita the Naroler rav retract his support of the Flatbush eruv in a letter published in the anti-eruv brochure?[71]
A. The Naroler rav was pressured to issue a letter, which was left unsigned. This letter now boasts a signature that is identical to the signature on a letter printed in the The Community Eruv [72] where the Naroler rav wrote that Hagaon Harav Shmuel Wosner shlita never said a word against his son’s hechsher on the Flatbush eruv. This original letter was addressed to the Muszay rav shlita and the Naroler rav’s signature included the familial title of cousin [shaar bsari] and the time of year, shana tovah u’msuka [5765]. This greeting was lifted from the original letter printed in the The Community Eruv and incongruously reprinted along with the signature on his letter in the anti-eruv brochure [Iyar 5765].[73] Tampering with signatures and other acts of deception have unfortunately been associated with the anti-eruv campaign in the past — such as the forged signature of Hagaon Harav Moshe Feinstein zt”l on the 1981 Boro Park kol korei and the purported signature of Hagaon Harav Eliyahu Henkin zt”l on the 1979 Flatbush kol korei.[74]

Moreover, the Naroler rav’s letter printed in the anti-eruv brochure does not contradict his original letter in the The Community Eruv,[75] where he explained that Hagaon Harav Shmuel Wosner shlita never said a word against his son’s hechsher on the Flatbush eruv. Apparently the Naroler rav told the anti-eruv activists that he couldn’t contradict his first letter since it’s the straightforward truth.

What Is a Reshus HaRabbim: Part 2


... and has 600,000 people traversing it daily [shishim ribo (sixty myriads) [11] ovrim bo [12] b’chol yom [13]].

Since all four criteria have to be met for the area to be classified as a reshus harabbim, if even one criterion is not met, an eruv of tzuras hapesachim can be erected (Shulchan Aruch HaRav, O.C. 364:4; Bais Ephraim, O.C. 26, and Mishnah Berurah, 364:5).

[11] The text of Shulchan Aruch reads:
“What is a reshus harabbim? A street or marketplace that is sixteen amos wide, … and there are those who say that if it [the street or marketplace] does not have 600,000 people traversing it daily, it is not a reshus harabbim.”
Rashi is the original source of this criterion that the street requires shishim ribo traversing it in order that it be classified as a reshus harabbim, and not all of the Rishonim are in agreement with him. [The Bais Av (2:5:2) brings proof that the majority of Rishonim accepts shishim ribo as a fundament of a reshus harabbim (see also Shemiras Shabbos K’Hilchasa, perek 17, note 21, and Toldos Shmuel, 3:86:8; see also The Overwhelming Majority of Rishonim Maintain that Shishim Ribo is a Criterion of a Reshus Harabbim).] Since there is no unified opinion among the Rishonim, when the Shulchan Aruch (O.C. 345:7) mentions the criterion that the street requires shishim ribo it prefaces it with a qualifier, “vyeish oimrim,” there are those who say. Nevertheless, nearly all of the Achronim consider the criterion of shishim ribo an accepted fundament of a reshus harabbim (Taz, 345:6 and Magen Avraham, 345:7). The Aruch HaShulchan (Choshen Mishpat 162:1) maintains that shishim ribo is an accepted fundament to the extent that if one does not want to join his neighbors in their eruv chatzeiros because he wants to be stringent and not rely on the criterion of shishim ribo, his neighbors can compel him to join them.
However, since some of the Rishonim do not accept shishim ribo as a requirement for a reshus harabbim, there is a difference of opinions among the Achronim whether or not a Baal Nefesh should adopt the stringent position if there is no shishim ribo present. Most Achronim mention the requirement of shishim ribo traversing the street without stating that a Baal Nefesh should adopt the stringent position. This omission signals that the requirement of shishim ribo traversing the street is an accepted fundament in the laws of reshus harabbim and even a Baal Nefesh can rely on it. Additionally, some Achronim state that once we utilize a tzuras hapesach for a street that is sixteen amos wide it is accepted that a Baal Nefesh could rely on the fact that the street does not have shishim ribo traversing it (Kanah V’Kanamon, 5:56; Livush Mordechai, 4:4, and Bais Av, 2:9:3). Other Achronim maintain that a Baal Nefesh should adopt the stringent position and not rely on the fact that the street does not have shishim ribo traversing it. However, that is only where the sole basis for leniency is that the streets are lacking shishim ribo (Mishnah Berurah, 364:8).
It is important to recognize that when considering the basis for leniency there are two levels: a fundamental factor in the din of reshus harabbim such as mefulash or mechitzos and a tzad l’heter such as using questionable mechitzos. The Mishnah Berurah (Bi’ur Halachah, 345:23), quoting the Elya Rabah, states that even in conjunction with a tzad l’heter, a Baal Nefesh can be lenient and rely on the fact that the street does not have shishim ribo traversing it. How much more so, if we were relying on fundamental mitigating factors like the streets not being mefulash and the area having mechitzos, there is no doubt that the Mishnah Berurah ― and all the other poskim as well ― would agree that a Baal Nefesh could be lenient and utilize an eruv of tzuras hapesachim, since we have not met all the requirements of a reshus harabbim.
It should be noted that had the Mishnah Berurah (345:23) seen the Bais Ephraim (O.C. 26) in conjunction with the Mishkenos Yaakov (O.C. 120-122), there is a possibility he would have paskened like the Bais Ephraim that shishim ribo is an accepted fundament of a reshus harabbim, and he would have agreed that even a Baal Nefesh could be lenient and rely on the fact that the streets are lacking shishim ribo. See Bi’ur Halachah (208:9, s.v. Eino M’Vorech), where he states that he does not have the sefer Bais Ephraim (see also Toldos Shmuel, 3:81:7, 3:86:8; Bais Av, 2:5:2; Divrei Yatziv 2:173:1, and Even Yisroel, 8:36).
It is significant to note that Rav Moshe Feinstein zt”l considered the criterion of shishim ribo an accepted fundament of a reshus harabbim (Igros Moshe, O.C. 3:94, 5:19, 5:24:10); however, he had chiddushim in how to apply it.
[12] The poskim concur that the shishim ribo must actually traverse the street. Therefore, just the possibility of shishim ribo traversing a street is not sufficient grounds for the street to be classified as a reshus harabbim (Bais Ephraim, O.C. 26; Mishkenos Yaakov, siman 121 as he explains the shitos of the Shulchan Aruch; Michtam L’David, siman 2; Divrei Chaim, Addendum 3; Zivchei Tezdek, siman 102; Maharsham, 3:188; Sefas Emes, Shabbos 6b; Yeshuos Malko, siman 27; Minchas Elazar, 3:4; Tuv Yehoshua, p. 8, and Igros Moshe, O.C. 1:139:5, 4:87; see also The Overwhelming Majority of Achronim Maintain That the Shishim Ribo Has to Traverse the Street Itself).
Since the Shulchan Aruch uses the term shishim ribo ovrim bo it implies a thoroughfare in continuous use and not merely the presence of 600,000 people in the vicinity who would have the ability to utilize the street. Even Rav Moshe zt”l (ibid.) interpreted the criterion of shishim ribo ovrim bo to mean a thoroughfare in continuous use, such as an intercity road, which he maintained would need to have 600,000 people traversing the same section of the road (ibid., 5:28:16) on a daily basis in order it be classified as a reshus harabbim. Additionally Rav Moshe stated (ibid., 1:139:5, 4:87, 5:28:5, 5:29) that the criterion of shishim ribo ovrim bo when applied to a city would necessitate a population of at least 3,000,000 inhabitants (see Part 1: Shishim Ribo According to Hagaon Rav Moshe Feinstein zt”l). Only a city with such a sizable population could physically satisfy the condition of shishim ribo ovrim bo, 600,000 people collectively traversing its streets at one time. [However, Rav Moshe acknowledges that it is difficult to interpret shishim ribo ovrim bo as applying to a city (ibid., 1:139:5).]
[13] There are poskim who maintain that in order to classify the street as a reshus harabbim it is sufficient that the shishim ribo traverse the street most days of the year (Maharsham, 3:188; Minchas Elazar, 3:4, and Minchas Yitzchok, 8:32:1). However other poskim accept the simple reading of the Shulchan Aruch that the shishim ribo must traverse the street every day of the year, otherwise it would not be considered a reshus harabbim (Zivchei Tezdek, siman 102; Aishel Avraham, 345:3; Kinyan Torah, 4:40:7, and Igros Moshe, O.C. 1:139:5, 4:87-88, 5:28:16).
Rav Moshe zt”l also understood the literal interpretation of the Shulchan Aruch as meaning shishim ribo traversing the road itself on a daily basis (ibid., 1:139:5, 4:87, 5:28:16). Rav Moshe posits that when the Shulchan Aruch states as one of the criteria of reshus harabbim that the street has to have 600,000 people traversing it daily, the Shulchan Aruch was also referring to an intercity road where the shishim ribo would have to traverse the same section of the road every day. Additionally, Rav Moshe states (ibid., 4:88) that although at times Brooklyn’s beaches might be host to a million people, this in itself is not reason enough to prohibit an eruv of tzuras hapesachim because according to the Shulchan Aruch the requirement is that the shishim ribo has to traverse the streets on a daily basis.

Part 6: Birur HaShitos ─ Regarding Shishim Ribo

וכן מוכח גם בדברי הפנ"י המובא בב"א בסוף סי' כ"ו, שעד שעת נדבת המשכן לא היתה כלל רה"ר בדגלי מדבר אפילו במחנה לוי', ואשר לכן לא הזהיר משה על ההוצאה, כי לא הי' צורך להזהיר על ההוצאה שלא הי' שם רה"ר, ורק כאשר שמע שהמלאכה היתה דים ויש מאת ככר כסף, ואשר מזה ראה שיש ס"ר עוברים במחנה לוי' ע"י חשבון המאת ככר כסף עיי"ש, אז הזהיר על ההוצאה, דאז הוא שנעשה רה"ר, וכדיוק לשון הב"א שם דנעשה רה"ר "מעתה", כלומר בתקופה ההוא נעשה אותו המקום לרה"ר, אבל לפני זה לא הי' רה"ר כלל, ומוכח דמה שיש ס"ר מצורף ברחובות העיר אינו כלום, שזה הי' בודאי ידוע למשה גם קודם נדבת המשכן.
[ב] וכן עי' משכנ"י סי' קכ"א שביאר להדיא שיטת הטור והשו"ע דבעינן ס"ר עוברים כל יום שלמדו זאת מהמבואר בגמ' (שבת צ"ו ע"ב) דמחנה ישראל לא הי' רה"ר, וכתב המשכנ"י דע"כ הטעם משום דדוקא מחנה לוי' היו ס"ר עוברים כל יום אצל משה כדי להביא נדבת המשכן כל יום, משא"כ במחנה ישראל לא היו הולכים ס"ר בכל הרחובות, כי לא היו מצויין אלו לאלו, ומבואר להדיא דאע"ג שמחנה ישראל הוא עיר שדרים בו ס"ר, והי' גם ס"ר בצירוף בכל הרחובות וכנ"ל, לא מהני זה שיהי' רה"ר, אלא בעינן ס"ר עוברים באותו רחוב דוקא, לפי שיטת הטור והשו"ע, (ועי' גם רשב"ם ב"ב דף ס' להדיא דמחנה ישראל לא הי' רה"ר, וכן עיי"ש נמוק"י) הרי בפירוש דס"ל להמשכנ"י שגם בעיר בעינן שיעברו הס"ר בכל רחוב בפנ"ע ובעינן שיעברו בו כל יום.
ונראה שמדויק כן בלשון המחבר, שבכל הסעיף נקט לשון רבים, "רחובות ושווקים" ואין "להם" חומה וכו', ובשיטת הי"א נקט לשון יחיד דייקא "כל שאין ס"ר עוברים "בו" אינו רה"ר, ועפ"י המשכנ"י נתיישב כמן חומר, כי אלו נקט לשון רבים גם כאן הי' משמע שיש בצירוף כל הרחובות ס"ר הוי רה"ר, ולכך נקט לשון יחיד דייקא להדגיש דבעינן באותו רחוב בפנ"ע ולא מצרפינן כל הרחובות.
[ג] וכן מוכח נמי דעת הב"א בדף מ"ו שמפרש לשון רש"י שכתב עיר שמצויין בו ס"ר, וז"ל: "ופשיטא דמצויין ממש בעינן דהיינו שיהא עלול לכך שיבואו לשם אלה מפה ואלה מפה, דוגמת דגלי מדבר דאמרינן דמחנה לוי' רה"ר לפי שהי' הכל מצויין אצל משה" עכ"ל, והנה ממ"ש "דוגמת דגלי מדבר דאמרינן מחנה לוי' רה"ר", מוכח דס"ל דוקא מחנה לוי' ששם הי' באין אלה מפה כו' שהיו הכל מצויין אצל משה, משא"כ מחנה ישראל, ששם לא היו מצוי ושכיח שיעברו בו ס"ר, וזה כמוש"כ המשכנ"י.
ועוד משמע שלא פירש כוונת רש"י עיר "שמצויין" שם ס"ר היינו שיש שם "בנמצא" ס"ר, כלומר שדרים בו ס"ר, אלא פירש כוונת מצויין בו, "כמו במחנה לוי' שהכל "מצויין" אצל משה", ומשמע שהב"א מפרש הלשון מצויין שם ס"ר דהכוונה, שיהא "מצוי" שיעברו ברחוב שלה ס"ר, ולא שנמצאים שם ס"ר תושבי העיר, ודו"ק.
וכן מוכח עוד בהב"א שהבאנו לעיל שהביא דברי הפנ"י שמחנה לוי' לא נעשה באמת רה"ר עד שעת נדבת המשכן שהלכו שם ס"ר כל יום, ועד אז לא הי' רה"ר כלל בכל דגלי מדבר, והב"א קלסי' לדברי הפנ"י, וש"מ דהכי נמי ס"ל.
[ד] וכן עי' ערוה"ש בסי' שמ"ה סעי' כ' וכ"א וז"ל: דבדגלי מדבר לא היו מבואות אלא רחובות רחובות כשלנו, וכל שבט ושבט יצא דרך מקום אחר מהשבט השני, לפיכך לא הי' מקום בתוך המחנה שיקרא רשות שכל הרבים הולכים שם זולת מחנה לוי' שכל ישראל היו צריכים לילך אצל משה רבינו, ונמצא דרק מחנה לוי' הי' רה"ר" עכ"ל, ומבואר דעת ערוה"ש דאפילו עיר שיש בו ס"ר אינו רה"ר רק באותם הרחובות שהכל פונים עליהם, כמו במחנה לוי' שהכל מצויין אצל משה, אבל לא מצרפינן הס"ר מכל הרחובות (וכ"כ האג"מ בח"ד סי' פ"ח שמהערוה"ש הנ"ל מוכח דלא נחית לסברתו בחשבון הס"ר).
[ה] וכן עי' בס' בית יעקב למס' עירובין דף ו' ע"א וז"ל: "אמנם כן בכל מקום ובזמן הזה לא מקרי עיר רה"ר אלא כשיש בקיעת ס"ר ואף אמנם נוכל לומר שהיינו טעמא ממאי שדוקא מחנה לוי' הי' רה"ר ולא מחנה ישראל כנ"ל, משום דבמחנה לוי' הי' מצויין ס"ר, ולא כן במחנה ישראל, שלא הי' עוברים ושבים ס"ר" עכ"ל הרי להדיא כנ"ל דאע"ג שהי' מקום חניית ישראל נחשב כעיר כמוש"כ שם הבי"ע לעיל "שהגם שהישראל היו במדבר יושב אוהלים אפ"ה מקרי מקום חנייתם בשם עיר" ומוכח דאע"ג שהי' עיר שהי' של ס"ר דיירים, מ"מ אינו רה"ר רק מחנה לוי' שעברו בו הס"ר.

Part 5: Things You Have Always Wanted to Know About the Flatbush Eruv (But Were Never Told)

Q. If local Flatbush rabbanim are against the eruv, why should we erect an eruv?
A.
1) Many local rabbanim want an eruv. At a meeting called by a group of local prominent rabbanim in the Flatbush Bais HaMedrash of the Muszay Rav shlita [one of the most senior rabbanim of Flatbush] on March 20, 2004, it was resolved to establish an eruv and to bring in a world-renowned expert in hilchos eruvin, Hagaon Harav Benzion Y. Wozner shlita to oversee the kashrus of the eruv. The fact is countless rabbanim who are in favor of the eruv are fearful to say so publicly because they have been intimidated by individuals who are against erecting an eruv. [We know of some instances where individual congregants have threatened not to daven in their rav’s shul or to support their rav if he were to sign a proclamation in support of an eruv. This interference in a rav’s right to pasken as he sees fit is unprecedented.]

2) There is no such halachah that a local rav can claim exclusive authority over a neighborhood when there are other rabbanim in the neighborhood. Hagaon Harav Moshe Feinstein zt”l states that one can follow the minhag of his ancestors and there is no such halachah of bais din kvua or rav ha'ir today.[59] To claim that certain rabbanim have the absolute right to decide the minhag of Flatbush, when there are many other poskim who disagree with them, is presumptuous. [Hagaon Harav Yechezkel Roth shlita who has given shimush to many Flatbush rabbanim is a supporter of the Flatbush eruv.[60] Additionally, since Flatbush residents ask Rav Roth many shailos, his p’sak should be respected in the community.]

3) Just as it is the responsibility of each individual rav to insure that there be a kosher mikveh in his community, it is incumbent on each rav to erect an eruv as well.[61] In light of this, even if only one rav would want to erect an eruv, he has a right and a responsibility to erect one.

In response to those who argue that only the rabbanim who live in Flatbush have a right to express an opinion regarding an eruv in Flatbush, the question arises: Why then did the very same rabbanim have no qualms when they signed a proclamation forbidding an eruv in Boro Park; they obviously don't live in Boro Park? Evidently these rabbanim must feel that there are no geographical limitations for a posek and every rav in New York has a right to express his opinion on the matter.

Q. But isn’t it stated in the anti-eruv brochure [62] currently circulating Flatbush that, “there were a number of meetings between Rabbonim including some who were supportive and some who were opposed to the notion [of a Flatbush eruv],” and there was even an, “exchange of letters between the Rabbonim,” and it was agreed upon that an eruv should not be established?
A.
Ever since The Community Eruv kuntres published letters from rabbanim supporting the eruv,[63] the editors of this anti-eruv brochure were left in a quandary, as their official line had always been that no local rabbanim support the eruv. The mention of meetings makes it seem as if both sides agreed not to establish an eruv. In truth, there unfortunately never was a meeting, and there never was any exchange of letters. If there had actually been an exchange of letters wouldn’t they be extant? Why haven’t any of these letters been published?

While there was no meeting between the two sides, there appears to have been a unilateral decision, without any halachic debate whatsoever, by the rabbanim who were against the eruv not to allow the eruv to be established, even if it were erected with a first-rate hechsher. This was in stark contrast to their position before the eruv was established when it was understood that if the rabbanim who supported the eruv were to find a Baal Machsher the other rabbanim would not object to the eruv as long as there was a reliable hechsher.[64] However, after Hagaon Harav Benzion Y. Wosner shlita agreed to become the Baal Machsher, the resistance became vocal and fierce. Apparently they had not believed a rav would be able to withstand the pressure from the anti-eruv camp and agree to give a hechsher.

וראוי לציין מ"ש באג"מ ח"ד סי' פ"ז ע"ד תיקון עירובין בעיר פלעטבוש וז"ל: "עכ"פ אני סובר כן לדינא, (הביאור בשיטת רש"י בתנאי ס"ר) אבל לא רציתי לומר זה לפס"ד ברור, מאחר שלא הוזכר זה בפירוש בדברי רבותינו האחרונים, ובערוך השלחן משמע שודאי לא נחית לזה כו' אבל בזה טעם למה שלא אמרתי למה שאני סובר לפס"ד ברור, אבל מאחר שיצא קול שאני הוא המתיר, שהוא בעצם נגד מ"ש ונגד מה שאני סובר כן לדינא הוכרחתי לכתוב מכתבי זה" עכ"ל.

והנה עי' בהשמטות לח"ד (בעמוד תכ"ח) "וגם כתבתי באור על חשבון הס"ר שכל אלו הם חדושים שאף שברור לענ"ד שהוא אמת שייך למיפלג אחר שראו כל מה שכתבתי אם יש להם טעמים, אבל על ברוקלין שתלוי בדין הס"ר אם נמצאו בשטח דלא יותר מי"ב מיל, וכיון שנתברר שפלעטבוש יש שם הרבה יותר כו' וכן בארא פארק הוא אסור מדינא בלא דלתות עכ"ל, וכוונתו בזה צ"ב דכד דייקת שפיר תראה שלא מסיק לענין ברוקלין להדיא שדינו שונה ממנהעטען, (עי' ח"ד סי' פ"ט שכתב לענין מאנהעטן שאין למחות ביד המקילין), ושכאן צריך למחות ביד המקילין, אלא מסיק שבברוקלין הוא סובר לדינא שאסור, וגם צל"ע לפימ"ש הוא עצמו בס' פ"ז לענין עירוב בפלעטבוש, שהגם שהוא סובר כן לדינא מ"מ אינו אומר כן בתורת פס"ד ברור, כי לא הוזכר כדבריו בדברי האחרונים, א"כ צ"ב בכוונתו בההשמטה, ואם חזר ממ"ש בהתשובה הנ"ל, ורצונו מעתה לפסוק בתורת פס"ד ברור, הו"ל לפרושי כן להדיא, וצ"ע.

ודע שיש עוד שיטה המובא בראשונים בהיפך ממש מסברת האג"מ, והוא מ"ש הרמב"ן במס' עירובין דף נ"ט ע"א וז"ל: "ושמא דעת הראשונים לומר שהאיסרטיא שהיא כבושה חוץ לעיירות והולכים ממנו מעיר לעיר וממדינה למדינה עד סוף כל העולם אין מדקדקין בה בעוברין עלי' ס"ר דהא דכולי עלמא הוא, אבל בתוך העיר אין שם רה"ר בלא ס"ר דתהוי כדגלי מדבר" עכ"ל, ובשו"ת ישועות מלכו סי' כ"א וסי' כ"ב החזיק בשיטה זו, וכ"כ גם בספר בית יעקב עמ"ס עירובין דף ו' ע"א מסברא דנפשי', ואמנם בשו"ת אבני נזר סי' רע"ג הביא דברי הי"מ ודחאו, וז"ל: "סוף דבר מוכח בראשונים התוס' ומרדכי וריא"ז שאינם מחולקים בכך והרמב"ן שרצה לחלק בכך תברי' לגזיזי' וכתב שאינו מחוור" עכ"ל, וכן עי' שו"ת מהרש"ם ח"א סי' קס"ב שדחה שיטה זו.

ונראה לישב קושית הב"ח על הב"י בפשיטות, לפי מה שביארתי לעיל דאינו נחשב כאורח, אלא ע"י תקנת חז"ל של שכירות, אבל בזה עצמו שי"ל אחיזה בהבתים, אינו פוטר מעירוב דאינו נחשב כאורח משום זה, ודברי הב"י אינו אלא לומר שיוכל להשכירו, וממילא נעשים העכו"ם כאורחים ע"י השכירות של תקנת חז"ל, ולא מצד עצם בעלות המלך על הבתים, ולא קשה כלום מאחין שהיו דרין בחצר וכו', דבלא שכירות רשותם אינם אורחים לאביהן, עכ"פ זה מבואר בפשיטות מדברי הב"ח כדעת האבנ"ז, דהנחת כלים מהני גבי ישראל.

הנה כל זה צריכין אנו לענין שכירו ולקיטו ע"י הנחת כלים, אבל עצם שו"ל דמהני גבי ישראל מבואר להדיא מדברי המג"א סימן שס"ז ס"ק ב' דציין למש"כ בסימן שע"א סעיף ד', דגבי ישראל אין בני הבית יכולין לערב אם אינו רוצה, ובעכו"ם מהני. ושם בס"ק ו' הביא את דברי התוס' וז"ל, אבל אין להביא מהא דאמר שכירו ולקוטו נותן עירובו, דדילמא הני מילי בעכו"ם דאין דירתו חשובה כ"כ, אבל בישראל לא, ערס"י שס"ז עכ"ל בשם התוס'. משמע דכל הטעם דלא מהני גבי ישראל הוא כשאינו רוצה לערב, אבל בסתמא ודאי מהני שכירו ולקיטו אף בישראל כמו בני ביתו, משו"ה ציין המג"א לסימן שס"ז, דשם מבואר דלא מהני בע"כ וכן דעת הב"ח להדיא בסימן שס"ז (ד"ה אבל בני החצר) דמייתי ראיה דבני ביתו יכולין לערב שלא מדעתו, מעובדא דהמן בר רסתק, הרי דבני ביתו ושו"ל שוין, וכ"כ להדיא הפמ"ג בא"א סימן שס"ז אות ב' דהא דלא מהני שו"ל גבי ישראל, דוקא כשמוחה ולא בסתמא, וכן כתב במ"ז שם בסופו, דשו"ל כבן בית דמי.



ביאור דברי התוס' דדוקא גבי עכו"ם שכירו ולקיטו נותן עירובו


ומ"ש העצי אלמוגים מדברי התוס' דף ע' דלא מהני שו"ל גבי ישראל, וכ"כ לעיל (בד"ה ועיין בב"ח) שכתב השיג על הב"ח דס"ל דמהני שו"ל גבי ישראל, מדברי התוס' דף ע', והנה כבר כתבתי מדברי המ"א דכוונת התוס' דוקא כשהוא בע"כ אדרבה מדברי התוס' מוכח להדיא דשו"ל ובני ביתו שוין, ואין זכר בדברי התוס' דשו"ל גרע מבני ביתו, דבתחילה מספקא להו אם בני ביתו של אדם יכולין לערב, אם נותנין פת משלהם ולא זיכו הפת לאביהם, כיון שבן הוא רק טפל, גרע משותפים, וע"ז כתבו דאין להביא ראיה משכירו ולקיטו שיכול ליתן פת שלו, א"כ ה"ה בן בית, ע"ז כתבו דילמא דוקא גבי נכרי, א"כ אין ראיה שגבי ישראל יכול בן בית ליתן פת שלו, זת"ד, א"כ היכן נזכר בדברי התוס' דשו"ל גרע מבן ביתו, אדרבה הרי רוצים לומר כמו דלא מהני שו"ל גבי ישראל, כמו"כ לא יהני בן ביתו, אבל להאמת דמהני בן ביתו, כמש התוס' דאינו דומה לחלק, וכמ"ש בשו"ע סימן שע"א, ה"ה דמהני שו"ל. וכן יש לתמוה על גליון הש"ס דף פ' על התוס' (ד"ה אתי) דהקשה למה צריכין להא דשמואל אשתו של אדם מערבת לו שלא מדעתו, הלא יש ללמדו משו"ל, וכתב דזה ראיה גדולה לפשוט ספיקו של התוס', דלא מהני שו"ל גבי ישראל, ומשו"ה צריך דוקא אשתו, דשמואל מיירי בישראל, עיי”ש. וצ"ע הלא התוס' כלל לא נסתפקו בזה אם שו"ל של ישראל יכול לערב בע"כ, דלזה פשיטא דצריך אשתו דוקא, דודאי שו"ל לא עדיף מבן בית, ושם מיירי התוס' כשלא מחה, והספק הוא אם יכול ליתן פת שלו, אבל כשמחה פשיטא דצריך אשתו דוקא, כמ"ש כל הפוסקים, ומה שהביא המג"א סימן שס"ז ושע"א את דברי התוס' לענין בע"כ, היינו רק ללמוד מיניה דהא דאמרינן דשו"ל נותן עירובו מיירי דוקא גבי עכו"ם, דהרי באמת שם מיירי בע"כ, ולענין זה צ"ל דיש חילוק בין עכו"ם לישראל, אבל לענין ספיקות התוס' אם יכול ליתן פת שלו, הרי קי"ל בש"ע סימן שע"א דאף גבי ישראל מהני.

כן כתב להדיא ברשב"א ובריטב"א דף ס"ד דשכירו ולקיטו של ישראל נותן עירובו ודיו, אלא שהקשו דזה דוקא כשיש לו שם מקום פיתא ולינא, וע"ז הוצרכו לתרץ דגבי עכו"ם הקילו והיינו דליתן פת לעירוב, א"א אלא כשדר שם, אבל אם אינן דרים שם לא גרע מדירה בלא בעלים, דלא שייך בה ענין עירוב, אבל לענין שכירות משמע ממה שהביאו בשם הראב"ד דא"צ לשום קולא, אף אם אינו דר שם, דמ"מ כיון דחשוב כבעלים יכול להשכיר, ומשמע דזה מהני גם גבי ישראל, למאן דס"ל דמהני שכירות גבי ישראל, ודברי הגינת וורדים מיושבים היטב, דלענין שכירות מישראל מהני שו"ל אף שאינו דר שם.



ביאור דשכירות מן המלך עדיף משכירו ולקיטו


ובאמת מדברי הגינת ורדים נראה דס"ל כדעת הישועות מלכו סימן ל"א דהמלך עדיף הרבה משו"ל, וחשוב כבעה"ב עצמו, וכמ"ש הב"י בסימן שצ"א בשם דודו הר' יצחק קארו, דשו"ל אינו אלא ראיה דא"צ לשכור מבעה"ב ממש, אבל באמת חשוב יותר משו"ל. ונראה טעמו, דשו"ל הוי כטפל לבעה"ב שדר שם מחמת שהוא משמשו, אבל כשיש לו תפיסה בהבית ואינו טפל לבעה"ב, עדיף הרבה משו"ל. וז"ל הגינת ורדים ואע"פ שקרקע ארץ מצרים אינה קנויה למלך, ואין פורעין מס וכו' מ"מ כיון שלעת הצורך עושה כרצונו, ואין מוחה בידו, נמצאת אומר שיד המלך שייכא ואגידא בקרקעות, עיי"ש. ולא הזכיר כלל מטעם שו"ל אלא עדיף מזה כיון שיש לו שייכות בהקרקעות עצמן, א"כ אפילו אם נימא דלא מהני שו"ל גבי ישראל, אין מזה ראיה לנידון דידן.

Primer on Hilchos Reshuyos and Eruvin: Part 4a

What Is a Reshus HaRabbim: Part 1


The Shulchan Aruch (O.C. 345:7) gives four defining conditions of what constitutes a reshus harabbim: a street or marketplace that is at least sixteen amos wide,[7] that is not roofed [mikorim],[8] that is open and runs straight [9] from city gate to city gate [mefulash m’shaar l’shaar],[10] ...

[7] According to Rav Avrohom Chaim Noeh zt”l, that is approximately 24 feet and according to the Chazon Ish, about 32 feet. As a snif l’heter there are poskim who maintain that our streets themselves, even those that are very wide, would not meet the criterion of a reshus harabbim. There is a requirement that the whole 16 amos must be suitable for people. Since the streets are designated for cars, the streets and the sidewalks on either side of the street are not considered connected to form one contiguous 16 amos (Tikvas Zechariah, p. 40 and Divrei Yatziv, 2:172:13; see also Oim Ani Chomah, siman 63). Additionally, the parked cars themselves serve as mechitzos as they separate the sidewalk from the street, and therefore, the streets are not considered 16 amos wide (Nesivos Shabbos, 3:1:2).
[8] The Aishel Avraham (siman 345) maintains that streets are not considered mefulash if they are intersected by roofed [mikorim] roadways. As a snif l’heter there are poskim who maintain that since elevated train tracks and overpasses ― the equivalent of roofed roadways ― circumscribe our communities we can utilize the heter of the Aishel Avraham and our streets would not be considered mefulash. It is interesting to note that Rav Moshe Feinstein zt”l (Igros Moshe, O.C. 1:140) also maintained that a street would not be considered mefulash if it is intersected by a roofed area. So it would seem that if Rav Moshe had known our neighborhoods, he would agree that our streets are not mefulash and therefore our communities would not be classified as a reshus harabbim. [See also Igros Moshe (O.C. 5:28:20) where Rav Moshe posits that while elevated train tracks do not bisect an area of shishim ribo into separate parts of less than shishim ribo, he admits that the intersected street is not considered mefulash.]
[9] Most poskim understand mefulash m’shaar l’shaar as meaning mefulash u’mechuvanim m’shaar l’shaar, open and running straight from city gate to city gate (Bais Yosef, 345:8; Magen Avraham, 345:6; Pri Megadim, Aishel Avraham, 364:2; Bais Ephraim, O.C. 26; Tiferes Yisroel, introduction to Shabbos; U’Bacharta B’Chaim, siman 123; Shoel U’Maishiv, 2:87; Yehudah Yaleh, O.C. siman 54; Mahari Slutsk, O.C. siman 11; Minchas Elazar, 3:4, and Mishnah Berurah, 345:20). Rav Aharon Kotler zt”l states (Mishnas Rav Aharon, 6:2), that for a street to be classified as a reshus harabbim it is accepted that it would need to be mefulash u’mechuvanim m’shaar l’shaar ― although he personally maintains that it is dependent on a walled city.
[10] The text of Shulchan Aruch reads:
“What is a reshus harabbim? A street or marketplace that … is not walled and even if they are walled but they [the street or marketplace] are open from city gate to city gate, they [the street or marketplace] would be considered a reshus harabbim ….”
Even though the Shulchan Aruch cites the criterion of mefulash m’shaar l’shaar in conjunction with a walled city, the Tur does not differentiate between a walled city and an open city and the Bais Yosef (siman 345) does not disagree with the Tur. Therefore, mefulash would be considered a criterion of a reshus harabbim even in a city that is not walled (see Bais Av, 2:9:1 for a detailed explanation). See Part 1: Why Brooklyn Is Not a Reshus HaRabbim that most poskim maintain that concerning the criterion of mefulash there is no difference halachically whether or not the city is walled. The Gra offers a different perspective (Bi’ur HaGra, O.C. 345:7) and explains that the words of the Shulchan Aruch, “is not walled,” refers to a street [sratya]. The Dmesek Eliezer clarifies the Gra that a sratya is a road which does not have a wall around it. The Gra explains further that, “even if they are walled,” refers to a marketplace [platya]. The Dmesek Eliezer explains that a platya is a city street that is walled on two sides and the remaining two sides are open straight from city gate to city gate. What we see from this Dmesek Eliezer is that what the Shulchan Aruch refers to as, “walled,” pertains to the streets of the city and not the city walls. Therefore, it is understandable why the Gra (Sh’nos Eliyahu, introduction to Meseches Shabbos and Chidushi HaGra, Shabbos 6a) when discussing the criterion of mefulash m’shaar l’shaar does not attribute it to a walled city. It follows that our streets which are lined with houses would be classified as walled streets and would have to be mefulash u’mechuvanim m’shaar l’shaar to be categorized as a reshus harabbim. Note that since the term city gate [shaar] does not always pertain to the gate of a walled city (Rashi, Yoma 11a), mefulash m’shaar l’shaar can refer to a city that is not walled as well.
