Part 4: Things You Have Always Wanted to Know About the Flatbush Eruv (But Were Never Told)

Continued from part III

Q. But what about the brochure circulating Flatbush containing a letter from Hagaon Harav Dovid Feinstein shlita [44] stating that his father Hagaon Harav Moshe Feinstein zt”l did not allow an eruv to be erected in Flatbush?
A.
A careful reading of Rav Dovid’s words in the original Hebrew [45] [since the loose English translation could be misleading] shows that he is in fact referring to his father’s position on the 1979 eruv and not his father zt”l’s theoretical position on the current eruv. Rav Moshe based his p’sak regarding the 1979 Flatbush eruv on information that had been related to him at the time. Since the facts on the ground have been otherwise confirmed ― such as the fact that the population of Boro Park and Flatbush is less than shishim ribo and the verified presence of mechitzos encompassing Brooklyn ― one can only extrapolate from Rav Moshe’s teshuvos how he would paskin regarding an eruv today. In light of the current situation, Hagaon Harav Tuvia Goldstein zt”l Rosh Yeshiva of Emek Halacha and a Talmid/Chaver of Hagaon Harav Moshe Feinstein zt”l, has said on numerous occasions that Rav Moshe himself would allow an eruv.[46]

Rav Dovid shlita in his letter was taking issue with what he had been told, that some had claimed that his father zt”l would have allowed an eruv in 1979. In truth no one has ever claimed that Rav Moshe would have allowed an eruv in 1979 since he stated clearly that he was of the opinion that an eruv should not be erected then.[47] Additionally, those who have read The Community Eruv kuntres know that what was actually stated was that if Rav Moshe would know the facts as they are today, he would allow an eruv to be established. This conclusion is based on Rav Moshe’s rationale why he prohibited the Flatbush eruv in 1979 [see page 34 of the The Community Eruv kuntres where we state, “Rav Moshe’s personal approach to eruvin prohibited an eruv in Boro Park and Flatbush, because it was based on information that was provided to him at the time”]. Nowhere is it stated in the kuntres that Rav Moshe personally allowed an eruv in Flatbush in 1979.

As explained in The Community Eruv kuntres,[48] Rav Moshe concurred that if Brooklyn’s population is less than 3,000,000 it’s only prohibited to establish an eruv there because of a personal gezeirah and not because it is a d’Oraysa.[49] [It’s important to note, Rav Dovid maintained that his father zt”l would allow an eruv if the population of a city is less than 3,000,000;[50] therefore, according to Rav Dovid the issue in Flatbush is definitely no longer a matter of a d’Oraysa.] Consequently, when Rav Dovid stated in his letter that he heard from his father zt”l that since, “there are over 2.5 million people living in Flatbush and its environs … it is impossible to build this Eruv,” Rav Dovid must be alluding to his father zt”l’s gezeirah and not that his father maintained that the matter is a d’Oraysa. [Additionally, it’s not clear what Rav Dovid intended with this statement that “there are over 2.5 million people living in Flatbush and its environs.” According to his father zt”l, the boundaries of a city aren’t measured as one unit but rather in blocks of twelve mil by twelve mil. Since Brooklyn encompasses an area of a little more than twelve mil by twelve mil,[51] the entire population of Brooklyn would not be included in the calculation to evaluate if it’s a reshus harabbim. Furthermore, the latest census figures indicate that the population of the entire Brooklyn is less than 2.5 million.[52]]

It’s important to note, Rav Dovid in his letter is taking issue with only one of the three independent reasons to allow an eruv in Brooklyn according to his father zt”l.[53]

Q. But aren’t there some other halachic reasons, besides for reshus harabim, not to allow an eruv in Flatbush.
A. According to Hagaon Harav Moshe Feinstein zt”l there is no other halachic reason [such as sechiras reshus [54]] not to allow an eruv. All these other claims are just proof that the anti-eruv forces are selectively choosing from unrelated shitos yachidos with an objective to asser eruvin even without valid reasons. Many people do not know much about hilchos eruvin, and they unfortunately approach the subject with a closed mind. Thus when a permissible eruv is constructed, they are quick to issue a blanket statement and declare that Rav Moshe would not have approved of the eruv in any form. In truth, Rav Moshe maintained otherwise, and he is often misquoted or misinterpreted in an attempt to validate misconceptions about eruvin. [For example, some have claimed in the name of Rav Moshe that pirtzos esser is me’d’Oraysa.[55] Some go to such lengths to prohibit eruvin that they state things in Rav Moshe’s name that were never mentioned in any teshuvah. For example, in a speech given a while ago about the eruv in Flatbush, there was a claim made that the reason Rav Moshe allowed an eruv in Kew Gardens Hills, Queens was that the area is encircled with mechitzos. This is a fabrication, as Rav Moshe never refers to mechitzos in any teshuvah concerning Kew Gardens Hills.[56] Nor does anyone else mention mechitzos regarding Kew Gardens Hills.[57] More so, since Brooklyn is encircled with mechitzos as well, why should it be any different than Kew Gardens Hills? If Brooklyn would require delasos at it’s pirtzos, Kew Gardens Hills would require delasos as well.[58] See The Community Eruv, page 37 for Rav Moshe’s real reason to allow an eruv in Kew Garden Hills.] Shouldn’t hilchos eruvin and Rav Moshe’s teshuvos be studied before an opinion is rendered? Shouldn’t the goal be to seek the truth instead of collecting all sorts of objections from disparate sources? Why must the objective always be to forbid eruvin?

הנה באבנ"ז סימן מ"ה אות י' כתב, דכוונת הב"י אינו אלא מה שזה מהני בע"כ של בעה"ב, זה לא מהני אלא גבי נכרי, אבל עצם שכירו ולקיטו מהני גם גבי ישראל שלא מחה בפירוש, אך בתשובת משיב דבר סימן כ"ו העיר, דמדברי הריב"ש סימן תכ"ז מבואר להדיא דההיתר שהמלך יכול להניח חפצים בבתי העיר לא מהני אלא גבי עכו"ם, דדירתו אינו דירה אלא משום שמא ילמוד ממעשיו, משמע דבישראל שאוסר מעיקר הדין לא מהני
היתר זה.




ביאור דברי הריב"ש דמודה דמהני שכירו ולקיטו גבי ישראל


הנה אמנם נראה מוכרח דאין זה כונת הריב"ש שהרי הוסיף שם וז"ל, וגם ענין עירוב עצמו דרבנן ואמרו הלכה כדברי המיקל בעירוב בזה יש לדון ולהקל וכו'. ולכאורה הרי בעכו"ם עכ"פ ההיתר פשוט מדין הגמ', כמו שהביא עצמו מעובדא דהמן בר ריסתק, וכמ"ש מדברי הרשב"א, א"כ למה הוצרך להא דהלכה כדברי המיקל בעירוב, ובסוף תשובתו כתב דטוב שלא להכניס ולהוציא מן המבוי לבתי העכו"ם וכו', שיספיקו שני הטעמים, ולכאורה מה עוול מצא בטעם הראשון שמבואר להדיא בגמרא.

ע"כ נראה דשם היה המעשה שלא היה
יכול האדון להניח הכלים בבתי העיר מצד דינא דמלכותא, אלא מעצמו נהג כן, וז"ל שם שדבר ידוע שהאדון יכול להניח כלים בבתי אנשיו ואין מוחה בידו, ואין זה שלא כדין שכן נהגו, עכ"ל. ע"כ שם היה ההיתר רפוי מאד, דבאמת לא היה להאדון זכות גמור להניח כלים, אלא שלא מחו בו, משו"ה הוצרך הריב"ש לומר שסומך ע"ז מחמת שדירת עכו"ם לא חשובה, וגם הלכה כדברי המיקל בעירוב, אבל ודאי באופן שהמלך יכול להניח הכלים מצד דינא דמלכותא, מודה הריב"ש דיכולים לסמוך ע"ז בלבד, ובכה"ג אין לנו ראיה מהריב"ש דלא מהני גבי ישראל, וי"ל כהאבנ"ז דמהני. (שוב מצאתי כן בב"ח סימן שצ"א דמה שלא סמך הריב"ש על טעם הראשון בלבד, הוא משום דלא היה כן מצד דינא דמלכותא, אלא שלא היו אנשי העיר מקפידין בכך, וברוך שכוונתי.) שוב מצאתי במרדכי פרק מי שהוציאוהו אות תק"ב שכתב וז"ל, מיהו נ"ל דאפשר דאפטרופא של קטן, יכול לערב ולהקנות, דלא גרוע משכירו ולקיטו דלקמן דפרק הדר. הרי להדיא דס"ל דמהני שו"ל גבי ישראל, ומשמע דאף שאין לו שם מקום פיתא ולינא, מדילף אפטרופא מזה, אלא סגי שיהיה לו תפיסה בהרשות.

Primer on Hilchos Reshuyos and Eruvin: Part 3

What Is a Tzuras HaPesach


Given that a house can have more than one door and still be classified as a reshus hayachid, an area totally enclosed by doorways would be considered a reshus hayachid as well. In effect, a tzuras hapesach,[4] two posts one on either side of the opening with a crossbeam [or a string] running across the top of them, forms the doorway[s] necessary for an area to be termed a reshus hayachid (Eruvin, 11b and Shulchan Aruch, O.C. 362:11). [5]

A tzuras hapesach would reclassify a karmelis as a reshus hayachid. However, regarding a reshus harabbim, the Shulchan Aruch (O.C. 364:2) states that only delasos [doors to close the breaches] would rectify it and not a tzuras hapesach.[6] Therefore, it is essential to establish the classification of an area ― is it or is it not a reshus harabbim? ― in order to ascertain what kind of enclosure would reclassify the area as a reshus hayachid where it would then be permissible to carry.

[4] There are those who claim that the term eruv refers to eruvei chatzeiros and not to a tzuras hapesach. However the Gemara (Eruvin, 6a) calls a tzuras hapesach an eruv; see also the Piskei Rid (Shabbos 6a) for further proof that the term eruv applies to both the physical construct and the brachah.
[5] The Rambam considers a tzuras hapesach a valid mechitzah only when utilizing at the minimum two mechitzos that are omed merubeh al haparutz (Shulchan Aruch, O.C. 362:10). Where this is not the case, each pole can be no more than ten amos apart from the other. The Kaf HaChaim (362:92) quotes the sefer Minchas Yehudah (siman 26) that states if a city has omed merubeh of its houses, they can be used to qualify the tzuras hapesachim as a Rambam eruv. Since the proximity of property lots in Brooklyn is such that they are omed merubeh al haparutz ― particularly the fences that surround the property lots ― any eruv in Brooklyn would be considered a Rambam eruv. Additionally we have determined that Brooklyn is encircled with three mechitzos that are omed merubeh al haparutz (see Part 3: Why Brooklyn Is Not a Reshus HaRabbim); therefore, any eruv in Brooklyn would definitely be considered a Rambam eruv.
[6] Most poskim maintain, me’d’Oraysa, a tzuras hapesach would reclassify a reshus harabbim as a reshus hayachid; however, me’d’rabbanan there is a requirement of delasos (Rosh Yosef, Shabbos 6b; Shulchan Aruch HaRav, O.C. 364:4; Tzemach Tzedek, Eruvin the end of Perek 5; Aishel Avraham, siman 345; Gaon Yaakov, Eruvin 11a; Yeshuos Malko, O.C. 21; Aruch HaShulchan, O.C. 364:1, and Kaf HaChaim, O.C. 364:12; see also Part 1: Delasos – Me’d’Oraysa or Me’d’rabbanan). Since the requirement of delasos is me’d’rabbanan, we can be lenient [safek d’rabbanan l’kulla] and apply any additional heter to remove the requirement of delasos (Kanah V’Kanamon, 5:56; Livush Mordechai, 4:4, and Bais Av, 2:9:3).

History of City Eruvin − Part 3: The Eruv in St. Louis

The First City Eruv in North America – St. Louis 1894

The first mention of a city eruv in America[56] was in 1894, in regards to St. Louis.[57] Shortly after Rav Rosenfeld came to St. Louis, he set to work on establishing an eruv for the city.[58] However, before Rav Rosenfeld published his arguments for the eruv in 1896, Rav Jaffe wrote an opposing argument on January 9, 1894,[59] based solely on Rav Rosenfeld’s public suppositions.[60] Rav Jaffe then had his sefer Sho’el Ka’inyan published in Yerushalayim in 1895,[61] and included this teshuvah regarding eruvin among other teshuvos.


The Controversy

Rav Jaffe stated in his introduction to his teshuvah[62] that a rav [Rav Rosenfeld] who had recently come to St. Louis allowed carrying on Shabbos based on empty premises. He claimed that Rav Rosenfeld had built an entire framework of leniencies that would permit carrying on Shabbos in all American cities.[63] Rav Jaffe continued that violators were rampant in this generation and those in America would hang on to his coattails, arguing that the power of permissibility is preferable. He declared that since this issue concerned the entire America, how could we be assured that there would not be other rabbanim who would learn to invent heterim in order to placate the masses and to gain favor in their eyes. In the same vein, he predicted, these people would pride themselves that Rav Rosenfeld would find them a heter to allow their stores to be open on Shabbos through its sale to the non-Jewish workers. The state of Orthodoxy in America was so weak, Rav Jaffe declared, that the observant only sought leniencies while the non-observant Jews did what their hearts desired. Meanwhile, [by allowing all these heterim] he claimed, the Shabbos would be violated by the few extant observant Jews, and its essence would be altogether forgotten. Consequently, Rav Jaffe stated, he was compelled to publicly declare that all of Rav Rosenfeld’s empty premises for establishing an eruv were in error. He went on to say that he had related his misgivings regarding Rav Rosenfeld’s leniencies to many rabbanim in America, and they had answered justly, but that Rav Rosenfeld’s supporters claimed that these rabbanim were not of Rav Rosenfeld’s stature. Therefore, Rav Jaffe declared, he was left with no choice but to publish his rebuttal and to present it to the gedolim of Eretz Yisroel; if they would agree with him, the G-d fearing Jew would surely abide by their rulings.

[56] Rav Rosenfeld states that he desired a haskamah on his kuntres since he was the first to establish an eruv in America (Tikvas Zechariah, vol. 2 preface p. {5}). This may be one of the reasons why Rav Rosefeld only sought a haskamah on Tikvas Zechariah vol. 2 regarding eruvin and not on vol. 1 referring to mikvaos. He argued that Rav Jaffe was departing from the conventional standard of constructing mikvaos. On the other hand, regarding eruvin, since Rav Rosenfeld was establishing something new in North America, he saw a need for a haskamah (see below). I have not seen any mention of a city eruv in North America prior to the St. Louis eruv. See also The Earliest Reference to Carrying on Shabbos in New York City.)
[57] The earliest documented evidence of the establishment of the St. Louis eruv is Rav Jaffe’s exegesis against the eruv, January 9, of 1894 (Sho’el Ka’inyan, p. {12} 23). Hence, I have been stating all along that the date of the founding of the eruv was 1894. However, the actual date of the establishment of this eruv could be anytime from after Rav Rosenfeld immigrated to America on August 22 of 1893 (see note 32) to the period prior to Rav Jaffe’s teshuvah against the eruv on January 9 of 1894. As Rav Jaffe had already written his teshuvah in January of 1894 ― unless he wrote this teshuvah extremely quickly ― it is likely that the eruv had already been established by the end of 1893. Rav Jaffe mentioned (Sho’el Ka’inyan, p. 20) that Rav Rosenfeld had already contracted sechiras reshus from a policeman. The fact that Rav Rosenfeld would not have had to do any physical work to declare the eruv operable, since he was using existing structures, supports this premise that the eruv was in existence at that time. Nevertheless, since Rav Rosenfeld did not publish his rationale for his eruv until 1896 ― when he wrote his kuntres Tikvas Zechariah, vol. 2 ― Rav Jaffe in his Sho’el Ka’inyan could still be referring to Rav Rosenfeld’s theory for an eruv and not that the eruv was established at that time.
Additionally, Rav Rosenfeld seems to be referring to the 1890 US Census when he states (Tikvas Zechariah, p. 40) that the population of St. Louis three years prior to his establishing of the eruv was 460,000. According to the 1890 US Census, the population of St. Louis was 451,770. Consequentially, it seems from this that he had established the eruv by 1893. While Rav Rosenfeld’s tally is somewhat more than the 1890 census – hence I wrote that he seems to be referring to the census – it’s highly unlikely that Rav Rosenfeld was referring to anything but the census since the other tallies such as Gould’s St. Louis Directory (1892 p. 28) claimed that by 1890 the St. Louis population was 466,200. Additionally, why would Rav Rosenfeld stress a count that was made three years prior to his establishment of the eruv if not for the fact that it was from an authoritative benchmark such as the 1890 US Census.
The chronology above helps establish a plausible timeframe when Rav Rosenfeld arrived in St. Louis. It is possible that Rav Rosenfeld did not arrive in St. Louis until the beginning of 1894 since he spent some time in New York and possibly Baltimore before he appeared in St. Louis (see notes 33-34). However, since Rav Jaffe wrote his teshuvah in the beginning of January 1894 and an eruv on the scale of the one Rav Rosenfeld was proposing for the city of St. Louis would have required many days of planning and scouting, it stands to reason that Rav Rosenfeld must have come to St. Louis prior to end of 1893.

Q. What about the claim that there are no mechitzos surrounding Brooklyn?
A.
That there are mechitzos encompassing Brooklyn is verifiable as they are easily accessible to the general public.

These mechitzos were evaluated by the following rabbanim:

  • Hagaon Harav Yechezkel Roth shlita sent Members of his Bais Din.
  • Hagaon Harav Shlomo Gross shlita, Belzer Dayan of Boro Park.
  • Hagaon Harav Tuvia Goldstein zt”l sent a select group from his kollel Emek Halacha.
All were in agreement that these mechitzos are valid mechitzos, even according to Hagaon Harav Moshe Feinstein zt”l.[37]

Q. Some declare that the mechitzos have pirtzos [gaps], some of which are even ten amos wide, and therefore the mechitzos are not sufficient.
A.
These three groups of rabbanim who took the time and effort to evaluate every segment of these mechitzos know about all these issues and unequivocally declare that these mechitzos are halachically valid. Their reasoning is that we paskin that mechitzos which are omed merubeh al haparutz [that is, at least 50 percent of the length of each side must actually consist of an unbroken wall] are considered whole for halachic purposes, lo asu rabbim u’mevatlei mechitzta.[38] Our mechitzos are more than 95 percent omed [closed] and are definitely halachically valid. Additionally, even if there are a few pirtzos that are ten amos wide, since most poskim including Hagaon Harav Moshe Feinstein zt”l [39] paskin that a pirtzos esser is only a rabbinical proscription, they do not invalidate the mechitzos.[40] This misplaced concern regarding the kashrus of our mechitzos is disingenuous. Most other eruvin in large cities don’t even have mechitzos, relying only on tzuras hapesachim, and the few cities that do have mechitzos [such as Toronto] have many more pirtzos than we have. Perhaps the reason why these individuals are questioning our mechitzos is because their objective is to forbid eruvin. Shouldn’t the objective be to hear the truth, even if it would allow an eruv?

Q. But what about the kavod of Hagaon Harav Moshe Feinstein’s zt”l?
A.
The above-mentioned rabbanim took the time to inspect the mechitzos only because they were concerned about the kavod of Rav Moshe. After examining the mechitzos, they were all in agreement that with these mechitzos Rav Moshe would have allowed an eruv in Brooklyn. Moreover, Rav Moshe did not consider it a slight to his kavod if others disagreed with him.[41] Rav Moshe was once asked [42] if it was disrespectful to disagree with the shitos of the Chazon Ish, the Moreh D’Asra, in his hometown Bnei Brak. Rav Moshe stated that it’s unquestionably allowed, and he added that it was even a kavod for him [the Chazon Ish] when one debated Torah in his name. By extension, Rav Moshe would definitely permit and consider it a kavod for us to debate his piskei halachah in his name.[43]

Part 4: Birur HaShitos ─ Regarding Shishim Ribo


ב. וי"א שאם אין שם בקירוב מקום ששים רבוא, העוברים ושבים שמה בכל עת, שדרכם לצאת ולבא באותו דרך, עד שאפשר שביום אחד יעברו כולם בדרך ההוא, אינו רשות הרבים.[17]

וז"ל הב"א שם: "ומה שהאריך [המשכנ"י] בדברי רש"י עפ"י דברי הריטב"א שכתב דאינו מצריך שיתיישבו בעיר ס"ר כאלו הכרכים והעיירות שהם פתוחים למקומות הרבה כו' והנה ידידי החכם נ"י האריך בהרצאת דברים להעמיס בכוונת רש"י שכל שהדרך מופקר והוא מעביר לס"ר אף שאין באין לתוכה ס"ר כיון שמתוקן ומוכן ומופקר לבא לתוכה אנשים מכל הארץ כו' ואומר אני אף שירבה כל היום מוכן ומופקר ומתוקן אין שומעין לו להוציא דברי רש"י מפשטן, שכתב עיר של יחיד שלא היו נכנסים בה תמיד ס"ר של ב"א, וכן כתב בדף ו' ועיר שמצויין בה ס"ר ואין בה חומה שהי' רה"ר שלה מפולש משעל"ש, כו' ופשיטא דמצויין ממש בעינן, והיינו שיהא עלול לכך שיבואו לשם אלה מפה ואלה מפה, דוגמת דגלי מדבר דאמרינן דמחנה לוי' רה"ר לפי שהי' הכל מצויין אצל משה רבינו, וכן אמרינן עגלות תחתיהן וביניהן רה"ר, ופי' ר"י לפי שהי' דרכם לבוא באותו דרך, והיינו כדברי ריטב"א כו' ובסו"ד שם סיים אך לרש"י בעינן שיהא דרך סלולה לס"ר המצויין שם בקירוב מקום ועוברים ושבים שם בכל עת עד שאפשר שביום אחד יעברו כולם בדרך ההוא, ועי' גם לעיל דף מ"ד ע"ב, וז"ל: דודאי גם בדגלי מדבר לא היו עוברים בין העגלות ותחתיהן כל שעה רק כיון שהיו חונים סביב לה ס"ר ודרכם הי' לצאת ולבוא באותו דרך כמוש"כ התוס' בעירובין, אבל אם [אין] שם במקומו וסביב לה כמספר הזה וגם אינה רוכלת העמים אשר אלי' יבואו מאפסי ארץ ס"ר אף שהוא לרבים הוכן לעבור שמה כשיבואו השתא מיהא ליתנייהו ואולי במספר שנים לא יעלה למספר הזה אף שהוא דרך סלולה ומעבר לרבים מ"מ הזמנה לאו מילתא עכ"ל.

ועי' מאירי בריש מס' עירובין שמשמע כהב"א, וז"ל : "רה"ר הוא דרך שיש ברחבה ט"ז אמה כו', וכן הצריכו בו גדולי הרבנים שיהא בו דריסת רגל לס"ר, ולא שיהא ס"ר יכולים לעבור שם ביחד, אלא שיהא דרך מצוי לס"ר ורגילים לעבור בו, ומשמע דקאי כשיטת הריטב"א שיהא דרך מצוי לס"ר, ואמנם הוסיף דבעינן "ורגילים לעבור בו" ולפי המשכנ"י הלא די בזה לחוד דהוי דרך מצוי לס"ר, ומוכח כהב"א.

והנה המשכנ"י בתשובתו השנית להב"א (דף קכ"ו בד"ה ומה) נתקשה בכוונת דברי הב"א במה שכתב "עד שאפשר שביום אחד יעברו" וז"ל: "גם מה "האפשר" הזה שכתב מעכ"ת, ואם הכוונה שאף שמעולם לא יעברו כיון שאפשר כו', מנא לי' למר הא לדעת המפרשים בדעת רש"י ז"ל וכמה פוסקים כתבו בפירוש דבעינן שיהי' ס"ר בוקעין בכל יום כמש"ל מזה, והיינו זה נכנס וזה יוצא כו' אבל מחנה ישראל לא הי' דריסת רגלם מצוי' תמיד אלו לאלו, לכן לא הוי רה"ר לדעתם, אף שאפשר לס"ר שבקירוב מקום לעבור אין זה כלום לדעתם, ואם הכוונה שעכ"פ באיזה יום יעברו כולם מה גבול יש בדבר אם יום או יומים לשנה, ואין לנו פשרה בזה אלא או דבעינן ס"ר בוקעים בכל יום כדעת המפרשים בדעת רש"י, או דלא בעינן רק שתהא דריסת רגל ס"ר מצוים שם אף בימים רבים, כיון שעכ"פ רגלם מצויים שם הוי רה"ר, וזו דעת ריטב"א וריא"ז בדעת רש"י עכ"ל.

ואמנם עי' שו"ת מהרש"ם ח"ג סי' קפ"ח שתפס בפשיטות בכוונת הב"א דבעינן שיהא שכיח ומצוי שיעברו ס"ר ביום אחד, וכתב וז"ל: דכיון שהדגלים היו סמוכים מסביבות העגלות הי' מצוי שיבואו אלה מפה ואלה מפה, והי' שכיח שיעברו ביום א' ס"ר כו' וכל עיר שאין מצוי שיעברו בה ס"ר ביום אחד אין לה דין רה"ר עכ"ל, והנה המהרש"ם מיירי הכא מדגלי מדבר, שהי' עיר של ס"ר, והי' הס"ר בקירוב מקום, ומ"מ כתב הטעם שהי' רה"ר משום שהי' שכיח שיעברו ס"ר ביום אחד אלה מפה ואלה מפה, הא לאו הכי אף שיש שם בקירוב מקום ס"ר, ואפשרי המציאות שיבואו לא מהני זה כלל, ונראה בעליל שהמהרש"ם פי' מ"ש הב"א "אפשר" "ועלול" שיעברו ס"ר ביום אחד, הכוונה שהוא שכיח ומצוי שיהי' כן ודו"ק, ולא רק אפשריות בעלמא.

וכן מוכח בשו"ת מנחת אלעזר (ח"ג סי' ד' הביאו האדמו"ר ממונקאטש שליט"א בתשובתו אודות היתר טילטול) שכתב לענין עיירות הגדולות, שיש בהם ס"ר, שרחובות הגדולים מקום המסחר ביותר, שם הוא רה"ר, דבודאי בוקעין בו ס"ר ביום, ומשמע להדיא אבל בשאר רחובות אינן רה"ר, ובהמשך דברי המנח"א שם כתב להדיא שדבריו בזה הם עפ"י "הב"א אשר העמיק הרחיב בזה בארוכה", ומבואר שהבין המנח"א בדעת הב"א שרק אותן הרחובות ששכיח בהן ס"ר הם רה"ר ולא שאר הרחובות העיר, ואע"ג שנמצאים ס"ר בקירוב מקום לכל הרחובות, והרי "אפשר" במציאות שיבואו שם ס"ר, אלא מוכח דבעינן דרך דשכיח שיעברו בו ס"ר, ולא מהני אפשריות בעלמא, וכמוש"כ מהרש"ם.

ונראה שהביאן לפרש כן בדברי הב"א, כי מאחר שכתב הב"א דבעינן שיהא "הס"ר מצויין שם בקירוב מקום", וגם הצריך שיהא הס"ר "עוברים ושבים שמה בכל עת", מה הי' חסר שהוצרך להוסיף עוד "עד שאפשר שביום אחד יעברו כולם בדרך ההוא", הלא בודאי אם הם שם בקירוב מקום, וגם עוברים ושבים בהדרך, הא ממילא גם אפשרי במציאות שיעברו שם ביום אחד, וכי איזה מניעה יש בדבר, וכן לעיל הדגיש "והיינו שהוא עלול לכך שיבואו לשם אלה מפה ואלה מפה", ומזה משמע שכוונת הב"א להוסיף ולפרש שיעור בה"עוברים ושבים שמה בכל עת", והיינו דבעינן שיהא דרכם של הס"ר לצאת ולבא בהדרך ברגילות ובתמידות כל כך, עד שאפשר מתוך זה הרגילות, שיזדמן שיבואו ס"ר בהדרך ביום אחד, (ורק בכה"ג נחשב שרשות הס"ר שולטים שם) ולאפוקי אם נמצאים שם בקירוב ס"ר, ומשתמשים באותו דרך באופן שלפי השתמשות הרגילה לא יזדמן כלל שילכו כולם ביום אחד (דאז לא נחשב שהס"ר שולטים על הדרך ההוא).

ודבר זה אפשר לבחון אם שכיח ומצוי שעוברים שם ס"ר ביום אחד, דאם אינו שכיח שיעברו הס"ר ביום אחד, מוכח דאינם משתמשים הס"ר בהדרך כ"כ, וזהו ביאור מ"ש מהרש"ם דבעינן שיהא שכיח ומצוי שיעברו שם ס"ר ביום אחד, ונראה ברור לפי המהרש"ם והמנח"א, אפילו אם יתברר שבאיזה ימים בשנה עוברים שם ס"ר, מחמת סיבה צדדית, לא מהני זה על כל השנה שיהי' רה"ר בעבור זה, דאנן בעינן שיהא עוברים ושבים כל עת כ"כ עד שבכל יום יהי' אפשר לספוקי דילמא יהי' עוברים שם ס"ר.

ונראה שכן מדויק נמי בלשון הב"א בדף מ"ה ע"ב וז"ל: לפי שהי' מצוי שם כמה עיירות גדולות במדינות אשכנז וצרפת ואינגלטירא שהי' בו ס"ר כגון עיר גדולה פאריז לונדון ווינא פפד"מ ועוד רבים כהנה כרכים גדולים אשר המה רוכלי העמים ומרובה באוכלסון מאד והיו בו גם ישראל הרבה דרים שם ועי' בשו"ת ח"צ סי' ס"ז לענין אינגלטירא שכתב איך יתכן כו' ויש בה כמה סרטיות ופלטיות דדשו בה רבים ואולי ס"ר כו', עכ"ל, ומשמע להדיא שגם בעיירות הגדולות ההם שהי' בהם ס"ר, עיקר הנידון בהם הוא רק סרטיות ופלטיות שבהם דדשו בי' רבים ואולי ס"ר, אבל הרחובות שבעיר שלא דשו בו רבים, אינם רה"ר.

וכן מוכח עוד בדברי הב"א בדף מ"ד ע"ב במה שכתב לפרש הא דאיתא במס' שבת דף ו' ע"א, לענין מדבר בזה"ז שאינו רה"ר, וכתב וז"ל: "דודאי לאו במדבר שמם לגמרי מיירי, רק איכא שיירתא טובא דאזלי ואתו כו' מ"מ כיון שהרבים אינם מצויין שם כל שעה, אע"ג דלפי רוב ההולכים שם לפרקים, יעלו למנין ששים רבוא לא איכפת לן, כיון שאין מצויין שם כל שעה עכ"ל, וכן ביאר מזה עוד להלן מ"ו ע"א וז"ל: "ומה שכתב מדברי רש"י בשבת שפי' כאן בזה"ז דהולכי מדבריות לא שכיחי, כבר כתבתי בזה לעיל דכוונתו דאע"ג דאיכא שיירתא טובא דפרשי בהברא ומאן מפיס אם לא יעלו לחשבון ס"ר, מ"מ כיון דעכ"פ לא שכיח כולי האי, ואנן בעינן שיהי' מצויין ס"ר עכ"ל, הרי כתב להדיא, דאע"ג שיש באמת ס"ר המשתמשים והולכים בהמדבר לפרקים, "ומאן מפיס אם לא יעלו לס"ר" מ"מ אינו רה"ר בשביל כך, והטעם בזה כתב "דעכ"פ לא שכיח כולי האי ואנן בעינן שיהי' מצויין ס"ר", ומזה נראה ברור בכוונת הב"א דלא מהני אפשריות בעלמא, אלא בעינן שכיח שם ומצוי ס"ר עוברים, וכמוש"כ המהרש"ם והמנח"א.

ואמנם עי' שו"ת אחיעזר ח"ד סי' ח' שכתב אודות פאריז שכיון שיש בה ס"ר הוי רה"ר, אע"פ שאין בכל רחוב ורחוב ס"ר, מכ"מ מקרי רה"ר, ועיי"ש שסיים וז"ל:" שו"ר בשו"ת בית אפרים חאו"ח סי' כ"ו כו' ושם חשיב לה פריז רה"ר מה"ת עכ"ל, ולפום ריהטא משמע לכאו' שמוכיח מהב"א לכל מ"ש לעיל היינו דלא בעינן ס"ר בכל רחוב ורחוב, ולפי"ז ע"כ צ"ל דס"ל להאחיעזר דכוונת הב"א דסגי באפשריות בעלמא, ודלא כמהרש"ם והמנח"א.

אלא דאיכא למידק קצת בדברי האחיעזר, במ"ש דחשיב לה הב"א לפאריז רה"ר מה"ת, דקשה לכאו' דהא הב"א כתב להדיא להיפך, וז"ל: "ואמנם עיירות שבמדינות אלו (פאריז לונדון ווינא ופפד"מ, שכתב שם שיש בהנך עיירות ס"ר) רחובותי' קצרים ואין בהם רוחב ט"ז אמה" עיי"ש, הרי להדיא כתב דאינם רה"ר, וע"כ צ"ל כוונת האחיעזר, דמשמעות הב"א שלולי זאת שרחובותי' קצרים וכו' הי' רה"ר מצד שיש בהם ס"ר, אלא דעכ"ז עדיין אין הכרח בדברי הב"א דהי' כל העיר רה"ר, ואדרבה הרי מדיוק לשונו משמע שלא דן אלא לענין פלטיות שבה, שדשו בו ס"ר וכמושכ בשם הח"צ וכנ"ל, ויותר נראה שעיקר כוונת האחיעזר במה שציין להב"א אינו אלא שהב"א ג"כ כתב שיש בפאריז ס"ר ושמצד זה צ"ל שם רה"ר, אבל לא להוכיח מהב"א לענין מ"ש דלא בעינן בכל רחוב ורחוב ס"ר, שלזה אין משמעות כלל בהב"א, (וראיתי בספר אחד שהרחיק לכת באמרו שמסתבר לו שמעתיק התשובה השמיט מלה אחת "לא", וצ"ל שבב"א "לא" חשיב לי' פריז רה"ר, ודבריו אינם אלא דברי תימה) ובגוף דברי האחיעזר במ"ש דלא בעינן בכל רחוב ורחוב ס"ר ג"כ לא ברירא כוונתו כולא האי, אי ר"ל כשיטת האג"מ המבואר להלן סעי' ג' או סעי' ח' עיי"ש, או דילמא ר"ל כשיטת הא"א המובא להלן סעי' ז', דעכ"פ בעינן רחוב א' שהולכים בו ס"ר ואז ממילא כל רחובות הנמשכים ממנו הוי רה"ר, ואפשר שזה כוונתו במ"ש דלא בעינן "כל רחוב ורחוב" רק עכ"פ רחוב א' שפיר בעינן.

והמורם מכל האמור, שהמהרש"ם והמנח"א תפסו בכוונת הב"א דבעינן שיהא שכיח ומצוי שיהא ס"ר עוברים בהדרך, ולא מהני כלל מה שהם בקירוב מקום והוא אפשרי במציאות שיבואו, וכן מוכח באמת בדברי הב"א, ובכוונת האחיעזר אין הכרע לכאו'.

ומן הראוי להדגיש, אשר כל עיקר דברי הבית אפרים האלו, אינן אמורים אלא בביאור שיטת הריטב"א אליבא דרש"י, וכמו שהזכיר כמה פעמים במפורש עי' לשונו לעיל , אבל אין הכרח כלל בכוונתו אם זה גם שיטת הטור והמחבר בשיטת רש"י, שהרי כתבו להדיא דבעינן ס"ר עוברים כל יום, ולא סגי במצויין בקירוב מקום ואפשר וכו', וכמוש"כ המשכנ"י דפליגי הראשונים בשיטת רש"י, ושמוכרח כן בריטב"א עיי"ש, ובשו"ת מהרש"ם שם, הביא מהרב השואל האבדק"ק חיראב, שהי' רוצה לפרש דברי המחבר מ"ש עוברים שם כל יום שאין הכוונה עוברים ממש אלא ראוי לעבור, וכעין שיטת המשכנ"י, והמהרש"ם האריך לדחות פי' זו, דא"א לפרש הכי בכוונת המחבר, בפרט שכתב הלשון כל יום, אלא הפירוש הוא כפשוטו דבעינן שיהא ס"ר עוברים בו כל יום עיי"ש, ובאמת שכן פי' נמי המשכנ"י בכוונת המחבר, וא"כ מהיכי תיתי שהב"א חולק על זה, דהא זהו פשטות לשון המחבר, אלא ודאי שכל דברי הב"א אינם אמורים אלא בביאור שיטת הריטב"א, ובזה י"ל דסגי בשכיח שיעברו ס"ר ביום אחד, אבל לפי המחבר בעינן שיעברו ס"ר במציאות כל יום.

ועי' ב"א דף מ"ו שכתב לחלוק על המשכנ"י וז"ל: "ועליו המשא הזה להוציא דברי רש"י ופוסקים ראשונים מפשוטן, דאנא מצא שצריך שיהי' ס"ר בוקעין כאחד, שגם במדבר לא היו בוקעין כאחד במחנה לוי' רק זה נכנס וזה יוצא", הרי מבואר כוונתו להדיא שעיקר דבריו לחלוק על מה שהבין בכוונת המשכנ"י דמצריך שיהא הס"ר בוקעין כאחד, ועל זה השיג שזה ודאי אינו, אלא סגי בזה נכנס וזה יוצא, (ובאמת גם המשכנ"י בתשובתו השנית הדגיש שבודאי מודה דסגי בס"ר עוברים ביום אחד, זה נכנס וזה יוצא, ולא בעינן ס"ר כאחד, עי' לשון המשכנ"י לעיל), אבל על עיקר דברי המשכנ"י אשר מוכח בריטב"א שיש כאן מחלוקת ראשונים בביאור שיטת רש"י, הנה על זה לא פליג הב"א כלל, ונראה עוד כי מה שהאריך הב"א בשיטת הריטב"א, אינו הכרח דס"ל דהכי קיי"ל, אלא ר"ל שגם עפ"י הריטב"א שהוא חומרא בשיטת רש"י, מ"מ לא שכיח רה"ר בזה"ז, אבל אין ר"ל דקיי"ל להלכה כהריטב"א נגד הכרעת הטור והשו"ע.

ואמנם יתכן לפי מ"ש מהרש"ם והמנח"א, דבעינן שיהא שכיח ס"ר עוברים, אפשר הגדר שכיח הוא הרבה פעמים וכמעט כל יום, וא"כ אפשר שזהו גם הפירוש בדברי המחבר, וכמוש"כ המנח"א עי' לשונו להלן הערה כ"א, דבודאי לא בעינן כל יום ממש ואם יחסר יום א' אינו רה"ר, רק הרבה פעמים בתמידות, וממילא לפי"ז יתכן שהכל עולה בקנה אחד, ואין כאן אלא שיטה אחת בדעת רש"י והוא דבעינן ס"ר עוברים ברגילות, וכמעט כל יום, עד שבכל יום איכא לאיסתפוקי אפשר היום עברו ס"ר.

Part 1: The Truth About the Satmar Rebbe and a Williamsburg Eruv

Part of an ongoing commentary on the bias against city eruvin.

One of the recent controversies regarding eruvin has been the establishment of an eruv in Williamsburg. This eruv is not the first one to have been erected in Williamsburg; one was previously established in 1981 by the Ratzferder rav (see below). In order to prove that the Satmar rebbe zt”l was against establishing an eruv in Brooklyn, the anti-eruv group published a work full of inaccuracies and half-truths titled Yalkut Michtavim (first edition 2002, second edition 2003). Over the past few years this book has grown in stature despite the fact that a book was published to refute it (Chai Anochi LeOlam), and it is quoted as an authoritative source of the Satmar rebbe’s opinion regarding eruvin. According to the Yalkut Michtavim, the Satmar rebbe was extremely resistant to an eruv in Brooklyn, on par with his strong feelings regarding all matters critical to the continuation of yidishkeit. This actually is the most damming evidence against this book. The fact is the Satmar rebbe, who was never known to mince words, did not write or publicly state that he was opposed to an eruv in Brooklyn. If the Satmar rebbe’s antipathy towards a Williamsburg eruv was as intense as this book would have us believe, the Satmar rebbe would have written at least one letter regarding his opposition to eruvin in Brooklyn just as he wrote regarding all other critical matters? Additionally, all members of the Hisachdus Harabbanim supported the Ratzferder rav’s eruv in Willamsburg (this eruv was immediately destroyed by some kanaim) and granted letters of support between the years of 1972-1981 (Otzros Yerushalayim, 298-300 and Al Mitzvas Eruv, p. 159-194). These letters were written by the most respected members of the Hisachdus Harabbanim who knew the rebbe’s opinion better than all the contemporary rabbanim and who would not go against his wishes. They are testimony that the rebbe was not opposed to an eruv in Williamsburg. More so, these letters were published during the lifetime of these rabbanim and there was never a retraction from any of them. When the anti-eruv group is confronted with these letters, they claim that all the rabbanim withdrew their support after they learned of the rebbe’s opposition (Yalkut Michtavim, p. 59-69). My question to these tale spinners is this: when did these rabbanim learn of the rebbe’s opposition and when did they retract their support for an eruv in Williamsburg? According to the anti-eruv group, the Satmar rebbe had already voiced his extreme opposition to a Williamsburg eruv by 1950 (Yalkut Michtavim, p. 26; see also the account below). Wouldn’t these rabbanim have known the Satmar rebbes’s opinion regarding eruvin in 1972-1981 when they showed their support for the Ratzferder rav’s eruv? More so, the Sharmasher rav, who knew of the Satmar rebbe’s opposition to a Manhattan eruv in 1966 (HaPardes, 40th year, vol. 8), gave a letter of support for a Williamsburg eruv in 1973 (Al Mitzvas Eruv, p. 163). Why would the Sharmasher rav retract his 1973 letter after he was already apprised of the Satmar rebbes opinion regarding eruvin in 1966? Wouldn’t the Sharmasher rav have known the Satmar rebbe’s opinion regarding eruvin better than the contemporary rabbanim?

The fact is many Satmar Chassidim know the truth that their rebbe was not opposed to an eruv in Williamsburg and that he definitely did not subscribe to Brooklyn being a reshus harabbim.

Some are under the impression that if the Satmar rebbe had wanted to establish an eruv, he would have done so himself. However, they do not realize that until 1985 ― when the court decided that it was permissible for the city to allow the Manhattan Beach eruv ― the legality of erecting eruvin was uncertain. Erecting tzuras hapesachim for city eruvin up until that time was more complicated then one would believe. It is evident that when Rav Chaim Michoel Dov Weissmandel zt”l wanted to establish a Williamsburg eruv in 1949-51, he tried to utilize as many existing structures as possible in order to minimize the need for tzuras hapesachim (see his maps on p. 149-51 in Chai Anochi LeOlam).

The method employed by all the anti-eruv campaigns has been to use all available means to obstruct eruvin, even from contradictory sources, as long as the end result would be no eruv. This book is a perfect example of this phenomenon. Many of the narratives are based on anecdotes that were pieced together to form one coherent account and this is why the stories do not always follow chronologically. If one were to read it with a critical eye, one would find that it is full of fictional tales concocted way after the fact, and that the dates do not jive (some examples were mentioned above). One of the fundamental accounts quoted in this book illustrates how they fabricated these tall tales but messed up on factual details, which, we will see, proved to be this tale’s undoing.

I will quote the pertinent points and for the readers edification I will post a facsimile of the complete account below. They state (Yalkut Michtavim, pp. 34-35) that many people claimed to have heard the following story from Rav Avraham Chaim Spitzer shlita. In the year 1949 or 1950, the Satmar rebbe was at a bris in the Yeshivah of Nitra. Later the Satmar rebbe locked himself in the Yeshivah’s seforim room with Rav Chaim Michoel Dov Weissmandel and debated the merits of a (Williamsburg) eruv the entire night. Rav Spitzer relates that at approximately three o’clock he awoke and overheard the discussion. After some debate regarding a Tosfos in Eruvin, the Satmar rebbe declared that he would never permit an eruv here (Williamsburg) since roughly sixty years ago an eruv was established (in Manhattan by Rav Yehoshua Seigel zt”l) with approbations from Gedolei Yisroel that utilized bridges (elevated train tracks). These elevated tracks were later demolished, but nevertheless people continued to carry (in Manhattan). Following this, the Satmar rebbe repeated that he would never agree to an eruv here (Williamsburg).

Dear reader, this story is fiction. Rav Seigel utilized the natural riverbanks for three sides of the boundaries of the eruv and on the fourth side, the Third Avenue El. The only mechitzah that the Satmar rebbe could have been referring to that was later demolished was the Third Avenue El. However, the Third Avenue El was not demolished prior to 1950 as this story charges but actually August 3, 1955, as reported by the New York Times (see below; see also The Subway, p. 249). This is clear evidence of the speciousness of the stories contained in Yalkut Michtavim.

As the anti-eruv group has shown time and time again, they couldn’t care less about the details because their most important objective is to negate the eruv; it is therefore explicable that a cursory reading of the particulars would suffice for them. These are some of the possible sources that led them astray.

  • They did not even bother to read Rav Seigle’s Eruv V’Hotzaah where he clearly states many times that he was making use of the Third Avenue El and, not as they thought, the Second Avenue El which was removed much earlier in 1942 (see Yalkut Michtavim, p. 147, 2003 and Mishmeres Chomoseinu, Erev Shavuos 2003; they even got the demolition date of the Second Avenue El wrong; they write circa 1920). The Third Avenue El was actually the last elevated train to be demolished in Manhattan, and even before the removal of the tracks the proposition to establish a new eruv in Manhattan was in the works (more about this important piece of information when I post a full treatment of the history of the first and second Manhattan eruv).
  • Rav Eliyahu Henkin zt”l mentioned (Edus L’Yisroel, p. 151, 1949) that they relied on the natural riverbanks and the elevated tracks for the Manhattan eruv, but since there were many modifications to the city such as the erection of bridges over the riverbanks, one cannot rely on the eruv anymore. If one were to read Rav Henkin’s letter carefully, he would see that he never mentioned that the changes were made to the elevated tracks since they were removed at a later date. Additionally, it is important to note that Rav Henkin later agreed that one can rely on the Shotzer rebbe zt”l who claims that the bridges of Manhattan were closed with tzuras hapesachim (Kisvei Hagriah Henkin, p. 33, 1961).
  • Rav Moshe Feinstein zt”l wrote a letter mentioning that not long ago some of the mechitzos utilized for the Manhattan eruv were demolished (HaPardes, 33rd year, vol. 9). However, the anti-eruv group overlooked the date on Rav Moshe’s letter, which was 1959, which is why Rav Moshe stated that the tracks were removed only lately.

In closing of this post I think the most appropriate words are from the Satmar rebbe himself, “Many things are said in my name publicly that I never said and that I would not have thought of saying (introduction to Al HaGe'ulah Ve’al HaTemurah).” The authors of Yalkut Michtavim should have considered the Satmar rebbe’s words before they produced this work of fiction in his name.

Part 2: Things You Have Always Wanted to Know About the Flatbush Eruv (But Were Never Told)

Continued from part I

Q. Isn’t it true that halachically an eruv cannot be erected in a large city such as Brooklyn?
A. No. According to the vast majority of poskim, an eruv can be erected in Brooklyn since it's not considered a reshus harabim d'Oraysa.[19]

Most poskim maintain that Brooklyn is not classified as a reshus harabbim because of the following three reasons:

  • The streets of our community do not run straight from one end of the city to the other ― they are not mefulash u’mechuvanim m’shaar l’shaar.
  • None of the streets in our community, including Ocean Parkway, are traversed daily by 600,000 people ― there is no shishim ribo ovrim bo b’chol yom.
  • As Brooklyn is circumscribed by more than three mechitzos at its waterfront, it is fundamentally a reshus hayachid.

Even one of the above conditions would be sufficient ground to permit an eruv of tzuras hapesachim. Additionally, as there are many reasons to allow an eruv in Brooklyn, even a Baal Nefesh can utilize the eruv with certainty.[20] Furthermore, since Brooklyn is bounded on three sides by mechitzos, any eruv in Brooklyn would be considered a Rambam eruv.[21]

Q. Doesn’t Ocean Parkway have more than shishim ribo passing through it every day?
A.
No. The statistical records of the Department of Transportation [DOT] show that Ocean Parkway, one of Brooklyn’s main thoroughfares, has fewer then 55,000 vehicles traversing it daily in both directions [22] [with an average of 1.5 occupants per vehicle [23]]. Therefore, even Ocean Parkway, the largest thoroughfare included in the parameters of the eruv, would not pose a problem for the establishment of an eruv of tzuras hapesachim. Some claim that since Ocean Parkway merges with other roadways, the collective traffic should be factored into the total count. Consequently, since almost all roads are connected at some point, they would then all be considered as one roadway. Following this illogical line of reasoning further, it would be impossible to erect eruvin in any city because all roadways would have, collectively, shishim ribo traversing them.

More so, this issue is a moot point according to most poskim since Ocean Parkway doesn’t continue straight [mefulash u’mechuvanim] into these other roadways and they are therefore not halachically considered as one. Furthermore, Hagaon Harav Moshe Feinstein zt”l maintained that in order for any section of an intercity road to be considered a reshus harabbim, shishim ribo would have to traverse that particular section of the road on a daily basis.[24] Accordingly, we would not include vehicles entering the roadway at different points in the total count, as they are each traveling along different segments of the roadway. Since Ocean Parkway has much fewer than shishim ribo traversing it at any point, there is no question that Rav Moshe would not classify it as a reshus harabbim. Additionally, the poskim maintain that people traversing the road in both directions are only counted traveling in one direction and so the total for a roadway like Ocean Parkway is actually much less.[25] Hence, we can conclude that Brooklyn does not have a street that has shishim ribo traversing it.

[Even more so, most poskim maintain that cars are not tallied in the shishim ribo.[26] The reason is either because a vehicle in itself is considered a reshus hayachid and therefore its occupants are not part of the total or because we only include pedestrians (holchei regel) who traverse the street in the tally. Consequently, it is clear that there is no street in Brooklyn that has shishim ribo traversing it.] Moreover, since Brooklyn is encircled with mechitzos, notwithstanding how many people traverse Ocean Parkway, it’s nonetheless classified as a reshus hayachid.

Q. Didn't Hagaon Harav Moshe Feinstein zt"l categorically forbid the establishment of an eruv in Brooklyn?
A. Rav Moshe permitted an eruv to be erected in Kew Gardens Hills, Queens and in Detroit.[27] In regards to Brooklyn, Rav Moshe acknowledged to the rabbanim of Flatbush that as there were many opinions on the topic of reshus harabim, he did not want to join them in the matter; however, he did not forbid them to construct an eruv.[28] [Concerning Rav Moshe’s signature on the kol korei of 1979 and 1981 which prohibit the Boro Park and Flatbush eruvin, see The 1981 Boro Park Kol Korei Exposed and The 1979 Flatbush Kol Korei Exposed for evidence that both are spurious documents and cannot be relied on.]

Moreover, Rav Moshe's reservations regarding erecting an eruv in Boro Park and Flatbush was based on misinformation provided to him at the time, such as: Brooklyn’s population was more than 3,000,000 [29] [the population required according to Rav Moshe to classify the area as a reshus harabim of shishim ribo] while in fact, according to census figures, Brooklyn only has 2,465,326 residents.[30]

Rav Moshe was incorrectly informed, as well, that Boro Park and Flatbush each have a population of more than shishim ribo [31] [if the eruv included a population of less than shishim ribo an eruv could be established just as Rav Moshe allowed an eruv in Kew Gardens Hills, Queens] when, in fact, the Boro Park eruv encompasses a population of under 100,000 residents, and in Flatbush, the eruv includes a population of less than 200,000 people.[32] Additionally, Rav Moshe wrote that he was not certain if Brooklyn had mechitzos [33] [if in fact Brooklyn did have mechitzos, it would not be considered a reshus harabim d'Oraysa [34]]. It has now been established that Brooklyn is bounded by man-made mechitzos on three sides, hence an eruv can be erected in Brooklyn even according to Rav Moshe’s shita.[35]

It is important to note, Hagaon Harav Tuvia Goldstein zt”l Rosh Yeshiva of Emek Halacha and a Talmid/Chaver of Hagaon Harav Moshe Feinstein zt”l, said on numerous occasions that even after the 1979 kol korei against the Flatbush eruv was printed, he spoke with Rav Moshe who agreed that if the rabbanim wanted to erect an eruv they could do as they saw fit. [Moreover, he stated that even Rav Moshe himself would have allowed an eruv in its present construction.[36]]

כבר נתבאר לעיל (פרק ב') שנתפשט המנהג ברוב ערי ישראל להקל כדעת הי"א שהוא שיטת רש"י, שכל שאין בו בקיעת ששים רבוא אינו רה"ר, ואמנם בביאור שיטת הי"א, כלומר איך ובאיזה אופן יהי' בקיעת הס"ר, הנה נחלקו בדבר רבותינו הראשונים והאחרונים, ועיקר מה שנחלקו הוא, ששים רבוא כיצד, שולטים בו או עוברים בו, אלא שבזה גופא מסתעף הדבר לכמה פרטים, ונבאר השיטות דבר דבר על אופניו .

ואמנם הב"א בתשובותיו להמשכנ"י, אינו משיב כלל על נקודה זו שיש כאן מחלוקת ראשונים בהבנת דברי רש"י, רק עיקר דבריו להשיב על פירושו של המשכנ"י בדברי הריטב"א ודעימי' דס"ל דסגי בס"ר שולטים, ובזה ס"ל להב"א, דאע"ג דסגי בזה שרשות הס"ר שולטים שם, מ"מ "הזמנה לאו מילתא היא" ובעינן שיהא שם הס"ר בקירוב מקום, ושיהא דרכם של הס"ר להשתמש באותו דרך כ"כ, עד שיהא אפשר ועלול שיעברו הס"ר ביום א', ובכן מכיון שזה לא שכיח הדרא דינא דאין רה"ר בזה"ז.

הוי אומר לא נחלקו הב"א והמשכנ"י בביאור שיטת הטור והמחבר, דלדידהו פשיטא דבעינן ס"ר עוברים בכל יום, לא נחלקו כי אם בפי' שיטת הריטב"א אליבא דרש"י, ובין להמשכנ"י ובין להב"א אין שום חילוק כלל בין רחובות העיר לבין דרכים שמחוץ לעיר, וכן תפסו בפשיטות הרבה אחרונים, ואמנם בשו"ת אג"מ סלל דרך חדש בביאור שיטת רש"י, וכן בביאור כוונת המחבר, ולדבריו יוצא חילוק גדול בין רחובות שבעיר, לבין דרכים שמחוץ לעיר ויתבאר שיטתו בזה בסעיף ג' וסעיף ח'.

שו"ת משכנ"י סי' ק"כ דף ק"ו, וחזר על הדברים ביתר ביאור בסי' קכ"א דף קכ"ד ואילך, ומקורו מדברי הריטב"א דף נ"ט במתני' עיר של יחיד עיי"ש שפירש"י שלא הי' נכנסים בה תמיד ס"ר של בנ"א ולא חשיבא רה"ר דלא דמיא לדגלי מדבר, ועי' ריטב"א שם שהקשה בשם ר"ת, וז"ל: "היכי משכחת לה עיר שהיתה של רבים בתחילתה, דהא ודאי מילתא דלא שכיחא הוא שנתיישבו שם בתחילתה ס"ר, ולעולם לא משכחת לה אלא בהיתה בתחילתה עיר של יחיד, ובטלת דין משנתינו בעיר של רבים," ותי' הריטב"א "כי רש"י אינו מצריך שיתיישבו בעיר ס"ר אלא שיכנסו בה ס"ר כאלו הכרכים והעיירות הפתוחים למקומות הרבה, ורגילין בה סוחרים וכיו"ב, ותדע שאף ירושלים לא הי' בה ס"ר תדיר, ואעפ"כ יש בה משום רה"ר אלמלא דלתותי' ננעלות בלילה, ומעתה כל שבתחילתה נתיישבה בכרכים ושווקים גדולים להיות רוכלת העמים זו היא של רבים" עכ"ל, וכתב המשכנ"י שהמעיין בדברי הריטב"א יראה להדיא שיש כאן מחלוקת הראשונים בביאור שיטת רש"י, דהר"ת ויתר הראשונים שהקשו קושיא זו על רש"י, ע"כ שפירשו בדעת רש"י כפשוטו דבעינן ס"ר הולכים בו תדיר, ולכן הקשו על רש"י היכי משכחת עיר של רבים מתחילתה, אבל הריטב"א פי' שדי בשליטת הס"ר, ובזה מיישב שיטת רש"י דכיון שמוכן עבור הס"ר, אע"ג שעדיין אינם עוברים בו בפועל מ"מ הוי רה"ר, וכן לענין ירושלים כיון שהיתה רוכלת העמים, ומוכן לס"ר תמיד לעבור בה, הוי תמיד רה"ר אפילו בזמן שלא עברו בה.
ויל"ע בכוונת המשכנ"י, אי בעינן שיהא נעשה העיר לשם זה, להיות רוכלת העמים ולקבל ס"ר, או אפילו אינו נעשה כלל בכוונה זו, כל שיש לה דרך לס"ר, והם יכולים ורשאים להגיע שם, ע"י זה בלבד מקרי רשות ס"ר שולטת עליו והוי רה"ר, והנה בדף קכ"ה בד"ה ועוד קשה כתב וז"ל: "אלא ע"כ שנידונת ע"ש סופה כיון שנתיישבה באופן זה, ובודאי יוקבעו בו שווקים גדולים, ומקומה ומעשי' מוכיחין עלי', הרי מעכשיו היא של רבים, כיון שהיא מוכנת להם, והם עתידים להתאסף לתוכה, ויש להם דריסת הרגל בה" עכ"ל, ולכאו' משמע דבעינן שיהא נעשה באופן זה שיהא מתחילתה מוכנת לס"ר וכמוש"כ "ומעשי' מוכיחין עלי."

אמנם עי' להלן דף קכ"ז ע"א וז"ל: "דוקא שיש לעיר דרך ומעבר שכל באי עולם באים לתוכה מקצה הארץ, הוא דרך לס"ר, אבל כל שאין לעיר דרך ומעבר מארצות הרחוקות, רק בסביבותי', אז בעינן עכ"פ שיהא מספר אנשי העיר עצמה או עם הסביבות הנמשכים לתוכה ורגילים בה עולים למספר ס"ר" עכ"ל ומלשון זה משמע דתליא רק בזה, אם יש מעבר ודרך שיגיע לתוכה ס"ר הוי רה"ר ואם אין דרך שיגיעו לשם ס"ר אז אינו רה"ר, והטעם בזה שכיון שיש יכולת ורשות לס"ר לעבור בה, נחשב דשלטי בה ס"ר והוי רה"ר, וכן נקט הערוה"ש בדעת המשכנ"י עי' סי' שמ"ה סעי' י"ח שהביא שם שיטת המשכנ"י וז"ל: "אלא כוונת רש"י שתהא דרך מפולש לרבים, שיהא "ביכולת" לעבור בה גם ס"ר לאפוקי הדרכים הקטנים שאינם רק לעיר אחת ולא לכל העולם וא"כ כל הדרכים שלנו הם רה"ר" ומוכח שהערוה"ש הבין בכוונת המשכנ"י שהעיקר שיהא יכולת ורשות לס"ר לעבור בה, וע"כ צ"ל דהא דנקט תחילה מעשי' מוכיחין עלי' וכו', לא שזה מעכב בדבר, אלא דבכה"ג פשיטא טפי דהוי רה"ר, אבל לעולם גם בלא"ה הוי רה"ר.

ונראה דלפי שיטה זו כמעט כל העיירות בזמנינו הם רה"ר, (אם יהי' בהם שאר תנאי רה"ר), ואפילו עיירות קטנות ביותר, שהרי עפ"י רוב יש דרך ומעבר (הייווע"י) ההולך עד להעיר, וממילא יש בה תנאי של ס"ר שולטים בה, ובאמת כן כתב כבר הערוה"ש הנ"ל בזמנו "וא"כ כל הדרכים שלנו הם רה"ר" וכוונתו מבואר, דכמעט כל העיירות שלהם, הי' להם דרך ומעבר מארצות הרחוקות, וכמו שמוזכר בפוסקים שהי' דרך המלך ההולך מעיר לעיר, וממילא נמצא שיש יכולת ורשות לס"ר לעבור בו.

בשו"ת משכנ"י לא פירש להדיא שכל רחובותי' הם רה"ר, אבל כן מוכח ממ"ש המשכנ"י שלפי שיטה זו היתה כל מחנה ישראל רה"ר, אע"ג שגם שם הי' רחובות הפרטיים אצל האוהלים עשויים בעיקר להדרים שם, וכמו כל רחובות העיר, ומוכח דבכה"ג מקרי ס"ר שולטים בה והוי רה"ר, ועי' הערה הקדום, ולפי מ"ש מהערוה"ש דהעיקר שיהא היכולת והרשות לס"ר לעבור שם, פשיטא דהה"נ כל רחובות העיר.

The Earliest Reference to Carrying on Shabbos in New York City

Writing in his memoirs, Judah David Eisenstein mentioned a debate regarding traveling on the elevated trains on Shabbos in New York circa 1878 (Ozar Zikhronothai, p. 352). He states that those who allowed traveling on Shabbos if the tickets were bought in advance maintained that since the trains were elevated more then ten tefachim it was as if one was traveling in a reshus hayachid. However, Rav Avrahom Yoseph Asch zt”l (1821-1887) declared that it was prohibited because of maris ayin and uvda d’chol. Nevertheless, if one was traveling on behalf of the community for a great need or on behalf of a mitzvah Rav Asch would allow it covertly (I will IY”H have more to say about Rav Asch ― the most important rav of American Orthodox Jewry at the time ― when I post the complete history of the New York City eruv of 1905).

The date and account given by Eisenstein is inaccurate. To the contrary, I found a published statement from Rav Asch regarding this matter in the Yudishe Gazeten of August 19, 1881 (see below). The account relates how some weeks prior, a rav from New York finagled a heter from Rav Yitzchak Elchanan Spektor (1817-1896) to travel on Shabbos on the elevated trains. Rav Spektor wrote Rav Asch a letter relaying the sequence of events. He stated that this New York rav had warned him in a letter that if a heter to travel with the locomotives on Shabbos was not found the fundamentals of yiddishkeit could disintegrate. Additionally, this rav mentioned that Rav Yoseph Saul Nathanson (1810-1875) allowed carrying in New York City on Shabbos. Therefore, Rav Spektor wrote, taking the above into account, he allowed traveling on the train providing that the tickets were bought prior to Shabbos, the traveling was within the techum Shabbos, and that the traveling was on behalf of a mitzvah. Rav Asch wrote that after he had informed Rav Spektor that as this would not cause the collapse of yiddishkeit and there was no heter to carry in New York, there is no heter on Shabbos to travel on the trains at all. Consequently, it is clear that Eisenstein is mistaken that Rav Asch would allow traveling on Shabbos on the train as long as it was not done overtly and it was on behalf of a mitzvah.

הנה בעצי אלמוגים הנ"ל מסתפק בזה, בתחילה כתב דההיתר שכתב לעיל, היינו דארעא לטסקא משתעבד לא שייך אלא בנכרי דמצינו כמה קולות, ולא לענין רשות הישראלים, ואח"כ כתב לבאר דברי הריב"ש שס"ל שגם גבי ישראל שייך ההיתר שהקרקעות משועבדות לטסקא, ולהכי הוצרך לומר שלא מהני משום שאין הרבים נעשים אורחים אצל היחיד. ובאמת קשה להבין מה שכתב דלא שייך היתר שלו אלא גבי נכרי שהקילו בו כמה קולות, דהרי הוא לומד ההיתר שלו מירושת הבכור שהוא דאורייתא, ומתרו"מ שאין מפרישים בחו"ל מטעם ששייך להמלך, ולמה יהיה עירוב של ישראל חמור מתרו"מ, שלא
מצינו בו קולות יתירות.

ונראה שהעצי אלמוגים כתב כן בעיקר, לתרץ מה שהכריח דא"א דמהני שכירות מהמלך לגבי הישראל אף לדעת הרא"ש, דא"כ נעקור ח"ו תקנת עירוב לגמרי. ומזה הכריח דלא מהני שכירות משו"ל גבי ישראל, ולזה הוסיף
דמטעם זה מוכרח דלא מהני ההיתר של ארעא לטסקא משתעבד גבי ישראל, דאל"כ נעקור ח"ו תקנת עירוב לגמרי. אבל אח"כ כשהביא בשם הריב"ש דאין הרבים נעשים אורחים אצל היחיד, א"כ נסתר ההוכחה, וע"כ חזר ממה שכתב לעיל וס"ל דבאמת שייך הא דארעא לטסקא משתעבד גם גבי ישראלים, ואפ"ה לא נעקר תקנת עירוב בזה, דלא סגי בשכירות כיון שאין הרבים נעשים אורחים אצל היחיד כמ"ש הריב"ש. ועכ"פ נראה דעת העצי אלמוגים לבסוף, דגם גבי ישראל שייך הא דארעא לטסקא משתעבד, [ובפרט למה שאבאר דגם שו"ל מהני גבי ישראל כ"ש דארעא לטסקא שייך גבי ישראל].

ומה שערער הריב"ש דלא סגי בשכירות, כיון שאין הרבים נעשים אורחים אצל היחיד, נראה פשוט דזה דוקא לענין האנשים שלא עירבו רק השכירו רשותם, הם אסורים להוציא כיון דאינם יכולים ליעשות אורחים אצל היחיד, אבל אותו היחיד שהשכירו לו ודאי מותר להוציא כמו שהדין הוא כשרבים ביטלו אצל היחיד, שאותו היחיד מותר להוציא והרבים אסורים, ולפי"ז אף דמהני שכירות גבי ישראל לא נעקר תקנת עירוב, דהרי יצטרכו לערב כדי שיהיו רשאים להוציא, דבשכירות גרידא רק היחיד מותר להוציא ולא הרבים, אבל גבי צדוקי שפיר קאמר הגוור"ד דמהני שכירות לענין הישראלים שעירבו יהיו מותרים להוציא, כיון שהצדוקים הוין כאורחים אצלם, ואף שהצדוקים באמת אסורים להוציא, כיון שאינן כאורחים שהם רבים, מכל מקום במה שמוציאים באיסור אינם יכולים לחזור ולהחזיק, דהרי בדנקט דמי א"א לחזור ולהחזיק, כמ"ש רש"י בריש הדר, ולזה גם הריב"ש מודה דמהני שכירות לאותם שעירבו, ולא קאמר הריב"ש דלא מהני, אלא לאותם שלא עירבו, וסרה תלונת העצי אלמוגים מעל
הגוור"ד.



בדברי השו"מ דמהני גבי ישראל הא דארעא לטסקא משתעבד וביאר דבריו



הנה גם שואל ומשיב כתב דמהני במה שהמלך הוא הבעלים על הבתים, שיכול להשחית ולקלקל הבתים בכדי לתקן העיר וליפותה, וס"ל שם דזה מהני גם גבי ישראל שאינו מודה בעירוב, וס"ל שם דדינו כישראל וצריך ביטול דוקא, ואפ"ה מהני השכירות של המלך, דכיון ששכרו מן המלך גם בבתיהם יש לו רשות להמלך, ובסוף תשובתו שם כתב דבאופן ששייך להמלך מחמת שנוטל הקרקע בעד המס, הוא מכ"ש ממה שמהני במה שיכול לקלקל ולהשחית הבתים לצורך העיר, נראה מזה דגם לענין הישראל דדירתו דירה מעיקר הדין מהני שכירות מהמלך מחמת זה.

אמנם דבריו שם צריך ביאור, דמתחילה כתב דמהני שכירות מהמלך לבתיהם של אלו, ואח"כ כתב וז"ל, ואין לומר דסוף סוף כיון דהם אינם מודים בעירוב א"כ הם אוסרים עלינו, ומה מועיל השכרת רשות סוף סוף אינם מודם בעירוב, ואינם משתתפים בעירוב שלנו, נלפענ"ד ברור לפמ"ש הרשב"א בחידושיו וכו' וה"ה כאן דכל שנותן עירובו ומזכיהו, והוא זכות גמור לו דבאמת צריך עירוב רק שאינו מודה בו, אין מועיל אף אם היה עומד וצוח שאינו רוצה, ובפרט שלא יוכל בעקשותו לאסור על אחרים מלהשתמש ע"י העירוב, עכ"ל. ולכוארה תמוהין דבריו דמתחילה כתב דמהני שכירות, ואח"כ כתב דסוף סוף לא נשתתפו בהעירוב, הנה אם מחמיר כדעת האומרים דלא מהני שכירות גבי ישראל, למה האריך דאינם משתתפים בהעירוב, הלא כבר כתב בתחילה דצריך ביטול רשות דוקא, וע"ז כתב דמהני שכירות במקום ביטול רשות, א"כ מה איכפת לן במה שאינם משתתפים בעירוב, ואיך חזר בו תוך כדי דיבור, דבתחילה כתב ומן האמור נוכל למצוא היתר וכו', היינו מטעם שכירות מן המלך, ואח"כ היתחיל לומר דברים אחרים מטעם זיכוי העירוב
בע"כ.

ועוד קשה מה שכתב שם דלא מהני עומד וצוח כיון שהוא זכות גמור, ובפרט שלא יוכל בעקשותו לאסור על אחרים להשתמש על ידי העירוב, אינו מובן, דהרי בשו"ע כתב דצדוקי שאינו מודה בעירוב לא מהני עירוב אף שנותן הפת לעירוב ברצונו, אפילו הכי לא מהני כיון שאינו מכיר בה, וכ"כ התוס' דף ס"ט גבי עכו"ם כיון שאינו מכיר בה אינו יכול לערב, א"כ במה שכופין אותו ודאי לא עדיף ממה שנותן העירוב ברצונו, ואפ"ה לא מהני, וגם מה שכתב שלא יוכל בעקשותו לאסור על אחרים להשתמש בהעירוב, אינו מובן, דזהו דבר הנעשה ממילא דכיון שלא זכה בהעירוב, ממילא אחרים אסורים להשתמש, ולא שהוא אוסר
על אחרים.

אמנם נראה כוונה עמוקה בדברי רבינו
השו"מ, דלפי מה שכתב לחשוש לדברי הט"ז והח"צ, דכשמת אדון העיר בטל השכירות שהשכירו ממנו, והעלה יסוד חדש דדבריהם אמורים דוקא כשהשכירו ממנו הרשות גרידא, אבל כשהשכירו מאדוני הארץ הזכות שיהיה שייך להם הכח שיוכלו לערב, זכות זה לא פקע במיתת האדון, ונראה סברתו דדוקא שכירות נפקע במיתת המשכיר, אבל קנין אינו נפקע במיתת המקנה, והכא קנו מאדוני הארץ הזכות שבכל פעם שירצו לערב שיהיו בתי העכו"ם משועבד להעירוב, ויהיו העכו"ם כאורחים אצל אצל הישראלים, ע"כ אינו נפקע במיתת האדון, כיון שאינו שכירות, אלא קנית הזכות שיש לו להמלך להשכיר, קנו הישראלים, זה נראה שורש כונתו, והשתא נפל חששא על אותם שאינן מודים בעירוב, איך יהיו בתיהם מושכרים לאותם המערבים, הלא המלך לא השכיר לאיזה איש פרטי, אלא לכל היהודים בכללם, א"כ גם אותם שאינם מודים בעירוב בכלל, וגם להם חל שכירות הבתים, א"כ נהי דרשותם הפרטי אין אוסר כיון שהוא בכלל השכירות, מ"מ הלא גם הם זכו ברשות שהשכיר המלך, א"כ לא חל השכירות להשותפות של העירוב בלבד, כ"א גם להם, ומצד זה הלא יכולין לאסור, בשלמא בשכירות דעלמא שהעכו"ם משכיר לאיש אחד, ורק אותם שעירבו עמו זוכין ממנו, כמ"ש בגמ' אף שוכר אחד שוכר ע"י כלם, ואותם שאינם בכלל העירוב אינם זוכים רשותם של העכו"ם, משא"כ הכא שהשכיר המלך להיהודים בכללם, וע"ז חידש השו"מ דכיון דיכולים לזכות להם העירוב בע"כ, א"כ הוא בכלל השותפות, א"כ נהי דרשותו הפרטי אינו ניתר בכך, כיון שאינו מודה בו, מ"מ שותף מיהא הוי, א"כ כשזוכה בהשכירות שמשכיר המלך, הוא אינו יכול לחלוק הזכות שזכה בו להיות רשות בפני עצמו ולאסור, ואינו זוכה אלא להיות חלק מהשותפים, וע"כ מהני השכירות, אבל ודאי לענין רשותו הפרטי נשאר השו"מ כדמעיקרא, דניתר מטעם שכירות מהמלך, כיון שאינו מודה בעירוב.

ובזה מובן היטב מש"כ השו"מ בסוף
דבריו, שלא יוכל בעקשותו לאסור על אחרים להשתמש בהעירוב, כוונתו דאינו צריך לזכות בהעירוב, אלא לענין שלא יאסור על אחרים להשתמש בה, ואינו צריך ע"ז אלא להסכים להיות שותף בעלמא, ודוק. ויהיה איך שיהיה, נראה מדבריו שמחמיר על האינם מודים בעירוב שדינם כישראל, ואפ"ה מתיר מצד שכירות מהמלך.



דעת הגינת ורדים דמהני שכירות מן המלך אף לגבי ישראל


וכן נראה משו"ת גוור"ד כלל ג' סימן כ"ב (ד"ה עוד יפה) דיפה כח שכירות מן גזבר המלך ממה ששוכרים מן העכו"ם עצמן, כיון שיש בינינו צדוקים דלא מהני שכירות אלא ביטול, ואינם רוצים לבטל וגם עירוב לא מהני בהם כיון שאינם מודים בה, אמנם כששוכרין מן הגזבר גם רשותם מושכרת אצלינו בדינא דמלכותא ואינם אוסרים עלינו, הרי דהחמיר דדינם כישראל, ואפילו הכי מהני שכירות מגזבר המלך.




ביאור דלכל האחרונים דמהני שכירות מן המלך לגבי ישראל ה"ה דמהני לגבי המוחים בעירוב גבי ישראל


שכירות לענין רשותם, ה"ה לענין ישראלים שומרי תו"מ שאינם רוצים לזכות בעירוב, מהני להשכיר רשותם מהמלך, רק חילוק אחד איכא ביניהם, דאם ההיתר לשכור מן המלך הוא מחמת שכירו ולקיטו, שיכול להניח אנשי המלחמה בבתי העיר, א"כ זה מהני רק בסתמא כשאינו מוחה וזהו בכל המומרים, אבל הישראלים המוחים בפירוש, לא מהני שכירו ולקיטו כמ"ש באבנ"ז (סימן מ"ה אות י') (ולקמן אבאר בכמה צדדים דמהני אפי' כשמוחה באופן שיכולים לכפותו). אך מאחר שבלאו הכי היתר דידן אינו מחמת הנחת כלים שהרי אין המלך מניח אנשי המלחמה בבתי העיר, ויש לסמוך על הע"א מטעם דהקרקע משועבד להמס ושייך להמלך, ובזה לא איכפת לן מה שמוחה הבעה"ב, וכן למה שבזמנינו יש כח להממשלה לסלק את הבעה"ב מן הבתים י"ל ג"כ דמהני השכירות אף בע"כ א"כ כמו שמהני על האינם מודים בעירוב, ה"ה דמהני על השומרי תורה ומצות שאינם זוכים בהעירוב.
