Part 4b: The Permissibility of a Brooklyn Eruv According to Rav Moshe Feinstein zt”l

Does Brooklyn Require Delasos at Its Pirtzos


At first Rav Moshe zt”l questioned if Brooklyn had mechitzos at all, adding that even if Brooklyn was surrounded by mechitzos, delasos would be required at the pirtzos (Igros Moshe, O.C. 5:28:5).

Rav Moshe maintained (ibid., 1:139:3) that even if an area such as a walled city ― which is classified me’d’Oraysa as a reshus hayachid ― has pirtzos which are open to an unenclosed area containing shishim ribo, these pirtzos would nevertheless require delasos, me’d’rabbanan. This requirement is Rav Moshe’s own chiddush. [On the contrary, the Shulchan Aruch HaRav (364:4); Bais Ephraim (O.C. 26); Bais Meir (O.C. 364:2); Mishnah Berurah (364:5), and the Achiezer (4:8) maintain that only when the area meets all the classifications of a reshus harabbim is there a requirement of delasos.]

Rav Moshe mentioned this originally about Manhattan which had shishim ribo and nevertheless was classified, me’d’Oraysa, as a reshus hayachid because it was enclosed by mechitzos ― sea walls that encompassed the island. Since Rav Moshe had seen Rav Tzvi Eisenstadt zt"l's teshuvah he knew that there were some pirtzos in the Manhattan mechitzos (Kuntres Tikkun Eruvin Manhattan, pp. 68, 168-69; Divrei Menachem, O.C. vol. 2, p. 76; Rav Tzvi Eisenstadt in his Hatzaah L’Tikkun Eruvin B’Manhattan, and in his recently published sefer Minchas Tzvi, siman 4). Nevertheless, because Manhattan is an island, the pirtzos opened to the water, which obviously did not contain shishim ribo, and therefore posed no problem to Rav Moshe since a tzuras hapesach would then be adequate. However according to Rav Moshe’s chiddush, the bridges leading from Manhattan ― which were open along their sides ― possibly would have needed to be rectified with delasos. Rav Moshe questioned (Igros Moshe, O.C. 1:139:5) whether the bridges were considered part of Manhattan, in which case the city’s population would in effect cause the bridges to be classified as a reshus harabbim and they would require delasos. Alternatively, if the bridges were not considered part of the city, but an intercity road (sratya), they would require shishim ribo crossing them in order to be classified as a reshus harabbim. As this was not the case, a tzuras hapesach would then be sufficient.

According to Rav Moshe, in a Brooklyn neighborhood, a tzuras hapesach would suffice for the following reason:
Since the tzuras hapesachim we erected in our neighborhoods are established in an area encompassed by mechitzos, the area is classified as a reshus hayachid, and the tzuras hapesachim are sufficient and delasos are not required (ibid., 1:139 see the end of anaf 3 where Rav Moshe states clearly that if the tzuras hapesach is erected in a reshus hayachid, it is sufficient; see Is There a Requirement of Delasos According to Rav Moshe Feinstein zt”l).

בענין שכירות רשות בזמה"ז ובדין ישראל המוחה בהעירוב



בשו"ע (סימן שצ"א סעיף א') ואין מספיק במה שישכור משר העיר, במה דברים אמורים בשר שאין הבתים שלו, וגם אין לו רשות להשתמש בבתי העיר כלל אפי' בשעת מלחמה, אבל במקום שכל צרכי העיר אינם נעשה אלא ע"פ השר או הממונה שלו, ודאי ששכירות מהשר ההוא או משכירו ולקיטו מהני, שהרי יש לו רשות להושיב אנשיו וכלי מלחמתו בבתי בני העיר בשעת מלחמה שלא מדעתם.


והנה בזמנינו לפי השקפה ראשונה לכאורה יהיה רפוי היתר זה, כמבואר בדברי האחרונים דבזמנינו יש לאנשי המלחמה מקומות מיוחדים להם, ואינם משתמשים כלל בבתי בני העיר.(שוב הראו לי בכתבי הממשלה שבזמה"ז אדרבה יש זכיות יתרות להממשלה יותר מימים הראשונים לענין שיוכל לסלקו, ושייך טעם הריב"ש הב' לא רק על הדרכים אלא גם על הבתים עצמן וכמו שיבואר להלן.)


סימן א'


ביאור דברי העצי אלמגים דמהני שכירות מן המלך מטעם שהקרקע משועבד להמס



והנה בספר עצי אלמוגים (סימן שצ"א) כתב היתר חדש, ובתשובת דברי חיים יו"ד (סימן מ"ב) כתב דהיטב אשר דיבר, ע"כ מן הראוי להרחיב הדברים ולבארם.


הנה מבואר בגמ' ב"ב (דף נ"ה ע"א) והני זהורורי ארעא לטסקא זבונינהו זבוני וכו' אמר ליה הונא בר נתן קשי בה אמימר, א"כ בטלת ירושת בנו הבכור דהוי ליה ראוי וכו', אלא מה אית לך למימר דיהיב טסקא ומית, ה"נ דיהיב כרגא ומית, וביארו התוס' דבשאר כל אדם אע"פ שהנכסים משועבדים אין ירושת בכור בטלה, כיון דמחוסר גביינא, אבל למס המלך אפי' קרקע שוה אלף זוז משועבד לדבר מועט, והקרקעות עיקר הן של המלך וכבר הוא מוחזק בהן.


וכתב
העצי אלמוגים דמש"כ הרשב"א והמרדכי דאין יכולין לשכור משר העיר אלא כשיש לו רשות להושיב שם אנשי המלחמה, מיירי דוקא באופן שאין המלך יכול ליטול הקרקעות כשאין משלמים המס בעדן, אבל כשיכול ליטול הקרקע בעד המס והקרקע שלו, ודאי יכולין לשכור מן המלך, דמה ירושת בכור שהוא דאורייתא בטלה בכה"ג, ור"ת בתוס' (ע"ז דף נ"ט וחולין דף ז' וקידושין דף ל"ו) כתבו דאהא סומכין דאין אנו מפרישין תרו"מ בזמה"ז אף שמדרבנן מחויבין גם בחו"ל, משום דהקרקע שייך להמלך ע"כ פטור מתרו"מ, א"כ כ"ש עירוב הקל שהוא מדרבנן, י"ל דהוא של המלך ויכולין לשכור ממנו.

והנה
צריך להבין הרי בגמ' אמרינן דביהיב טסקא ומית, בכור נוטל פי שנים, דלאחר שיהב הטסקא מוחזק הוא בהשדה, א"כ איך מהני שכירות רשות מן המלך, הלא כל בני המדינה פורעין המס מידי שנה בשנה, והם מוחזקים בהבתים שלהם ואין להמלך רשות בהם, וזה קשה גם על ר"ת שפוטר מתרו"מ גם לאחר שפרעו את המס.

אך
כשנדקדק בדברי הרשב"א שביאר את דברי התוס' ב"ב הנ"ל, שכתב וז"ל, וי"ל דלא דמי שעבוד חוב דעלמא לשעבודו של מלך וכו', הילכך הוי ליה מלכא כמאן דמוחזק בכלהו נכסי, ונחית ומזבין מנפשיה וזביניה זביני מן הדין, ומוכר כל קרקע על דבר מועט של טסקא שיש לו עליו, לפי שגוף הקרקע של מלך הוא וכל שאין פורעין לו חקו נוטלו, ואילו חוב דעלמא שעבוד בלחוד הוא ומשתעבדי ליה נכסי וכו' עכ"ל. מבואר מדבריו דמה שהמלך נוטל את הקרקע בעד המס אינו מטעם שעבוד, אלא באמת מעיקרא שלו הוא רק שמניח האנשים לדור בתוכו בתנאי שפורעין לו המס, וכשאין פורעין לו המס הוא נוטלו מחמת שהוא שלו, ולא משום שמשתעבד תחת המס, ועפי"ז מובן שפיר דברי ר"ת שפוטר מתרו"מ גם לאחר שפרעו את המס, והעצי אלמוגים שמתיר לשכור מן המלך גם לאחר שפרעו את המס, דהרי גם לאחר שפרעו את המס שייך להמלך, אלא אם פורעין את המס הוא מניח לדור בתוכו, ובאמת מלשון רבינו יונה שם שכתב וז"ל, אבל מי שנתחייב לשלם טסקא אין לו כלום בקרקע עד שיפרענה, משמע דלאחר ששילם המס הרי הוא שלו, אמנם מדברי ר"ת גבי תרו"מ מוכרח, דס"ל כהרשב"א דאף אחר שפרעו את המס שייך להמלך, אלא דמרשה לדור בו.

ובאמת
גם גבי תרו"מ לאו כל הראשונים הסכימו לדברי ר"ת, לכן אף אם ימצא איזה משמעות באיזה ראשון, דס"ל דלא מהני לשכור מן המלך אף באופן דארעא לטסקא משתעבד, אין זה ראיה לסתור, דאפשר גם גבי תרו"מ לא ס"ל כר"ת, ומ"מ לענין עירוב סמכו הע"א והד"ח והשו"מ על דברי ר"ת.



ביאור דהבעלים אין להם בהבתים רק זכות השתמשות לכך יכולין לשכור מן המלך ששייך לו


ואכתי צריך להבין הרי קי"ל בשו"ע (סימן שפ"ב סעיף י"ח) דעכו"ם שהשכיר ביתו לחבירו עכו"ם, אין יכולין לשכור אלא מן השוכר ולא מן המשכיר, אא"כ יכול לסלק את השוכר מן הבית בתוך הזמן, או שיש לו רשות להניח שם כליו, עיי”ש. א"כ לאחר שפרעו את המס להמלך, אינו יכול להוציא את האיש עד לשנה הבאה אם לא יפרע את המס, א"כ בני העיר הוי כשכרו הבתים מן המלך, והמלך המשכיר אינו יכול לסלקם, א"כ א"א להשכיר מן המלך בכה"ג, וכ"כ הריב"ש להדיא דאפי' אם הבתים הם של המלך, מ"מ כיון שהשכירם לבני העיר צריך לשכור מהם ולא מן המלך, ולכאורה העצי אלמוגים לא הועיל כלום במה שבתים הם של המלך, דהרי מ"מ כבר השכירם.

אמנם
נראה דז"א דהרי המלך לא השכיר את הבתים מעולם, דמה שפורעין את המס אינו לשם שכירות, אלא לשם מס, רק הקרקע משעבוד להמס, דאם אין פורעין את המס הוא לוקח קרקע שהוא שלו מעולם, ולא משום שלא פרעו השכירות, ומה שלגבי ירושת הבכור מיקרי מוחזק לאחר שפרעו המס, זהו משום שעכ"פ מוחזק הוא בהזכות לאכול הפירות בשנה זו, אבל זכות זה אינו כשכירות ממש שלא יוכלו לשכור מן הבעה"ב, דהרי הבעה"ב לא השכיר את גוף הקרקע מעולם.

[ועיין
בלשון תשובת מהרי"ק שורש ט"ז וז"ל, ואע"ג דפשיטא דלא דמי לשדה המשועבד למלך בשביל המס, וכו' דארעא לטסקא משתעבד, והמס כמו חלף הפירות שאוכל מקרקע המלך, שהרי הארץ של מלכי האומות העולם, עיי”ש. הנה דהמס אינו משום שכירות, אלא משום שאוכל מקרקע המלך צריך לשלם חלף הפירות, ועיין בש"ע הרב הלכות גזילה ואבידה וז"ל מפני שכל הארץ למלך הוא, ובידו לגזור שלא יהנה אדם מארצו אלא מדעתו, עכ"ל. והיינו דכשנותן קצבתו הרי הוא נהנה מדעתו ולא מחמת שכירות].

ונראה
דיש לדמותו למש"כ הנתיבות סימן קצ"ב בארוכה, שיש שני מיני קנינים גבי שוכר, יש ששוכר הגוף לפירות, ובכה"ג הוי כחצירו לענין קנינים, אבל יש שאינו שוכר אלא זכות השתמשות, והבית משעובד לו שיוכל להשתמש בתוכו, אבל אין לו בגוף כלום, וכמו שמבואר גבי חזקת תשמישים דקנה ע"י מחילה בלא שום קנין, ועיין בספר ברכת שמואל ב"ב (סימן כ"ה) שביאר דכשאיכא רק חזקת תשמישין, אינו שלו רק בשעה שמשתמש, אבל אח"כ יכול הבעה"ב להשתמש בו מטעם זה, דעצם הגוף לא קנאו מעולם, ולא קנה רק זכות ההשתמשות.

וככל
החזיון הזה י"ל בכל מקום שהקרקעות הן של המלך, [כמ"ש התוס' בב"ב נ"ה ובקידושין ל"ו ובחולין דף ז'] דמה שהבעה"ב יכול להשתמש בה כשיהבי טסקא, אינו משום דהמלך השכיר להם הרשות, דהמס אינו לשם שכירות כלל אלא שהמלך מניחו לדור בתוכו, ויש להבעה"ב רק זכות תשמישים [אמנם נראה דמ"מ הוי כחצירו לענין קנין חצר, דמאחר דהמלך נותן רשות להשתמש בה כשלו, הוי כהשאיל לו חצירו לענין קנין חצר דמהני, ובהא עדיף מחזקת תשמישים בעלמא] ומנא אמינא לה דאינו קנין הגוף מהמלך, דהרי אמרינן דהיכא דלא יהיב טסקא בטלה ירושת הבכור, ולכאורה אף אם נימא כהתוס' דהקרקע הוא של המלך, מ"מ הרי המלך מרשה לאכול פירות השדה, אף קודם שנתנו המס כמו אח"כ, ואדם אחר הלוקח פירות מהשדה הוי גזלן גמור, ואם נימא דקנוי לבעל השדה הקרקע לפירות, א"כ הרי זה דומה למשכנתא דאמרינן בב"מ דהיכא דלא יכול לסלוקי, בכור נוטל פי שנים, והיינו מטעם שגוף הקרקע הוא שלו לפירות כמ"ש הר"ן שם, והוי מוחזק בגוף השדה אף שהוא רק לפירות.

א"כ
ה"נ אף שהמלך יכול לקחתו בשביל המס, מ"מ אינו לוקח הפירות שאכל עד השתא, א"כ הרי עד שהמלך לוקחו הרי הוא מוחזק בהשדה לפירות, ולמה אין הבכור נוטל בה פי שנים, ולא דמי למשכנתא באתרא דמסלקי דחשוב ראוי כיון שאין לו בגוף הקרקע כלום, כיון דלעולם יכול לסלקו, אבל הכא גבי מס הרי המלך אינו לוקחו אלא אם אינו פורע המס, ובאמת מכאן ולהבא הוא גובה, א"כ נהי דגוף הקרקע הוא של המלך מכבר, אבל הקנין פירות שהוא לוקח רק מכאן ולהבא למה לא יחשב הבעה"ב מוחזק בזה, אע"כ מוכרח מזה דהמלך אינו נותן כלל להבעה"ב הגוף לפירות, אלא שהוא משעבדו להבעה"ב להשתמש בו בלבד, והוי כמשכנתא באתרא שמסלקי דחשוב ראוי, כיון שאין לו בגוף הקרקע כלום, אלא שעבוד בעלמא, ומה שמיקרי מוחזק לענין בכור היכא דיהבי טסקא אף שאין לו בגוף הקרקע כלום, נראה מטעם דביאר הש"ך (סימן רע"ח ס"ק ז') דאף שעבוד מיקרי מוחזק אם שעיבודו בידו, ומשו"ה אחר דיהבי טסקא כיון דמובטח בו שהמלך לא יסלקו באותו השנה, הוי שעבודו בידו, וחשוב מוחזק לענין פי שנים.


אבל לענין לשכור מן המשכיר לענין עירוב, נראה דכל שלא השכיר את הגוף לפירות להשוכר, אלא שעבוד לו להשתמש בתוכו, יכולין לשכור מן המשכיר אף שאינו יכול לסלק את השוכר ממנו, [והריב"ש מיירי כשהשכירו בשכירות מעליא, כמ"ש העצי אלמוגים והשו"מ דהריב"ש מיירי באופן שהקרקע אינו משעבוד להטסקא,] ומנא אמינא לה דהרי בכל ביטול רשות, הכוונה שמפקיר רשותו לבני החצר ולב"ש מקנה רשותו לבני החצר, ולכאורה הרי ודאי השאיר אצלו רשות לדור שם, וא"א לסלקו משם, אע"כ כיון דגוף הבית הפקיר ולא השאיר לעצמו, אלא הזכות לדור שם אינו אוסר, א"כ ה"ה כשהמלך יש לו גוף הבתים ורק זכות הדירה נתן להבעה"ב יכול המלך להשכירו לישראל, והבע"ב חשובים כאורחים בעלמא אף שלא מצי לסלקינהו, דלא גרע מביטל, וכ"כ הריב"ש דכשהמלך משכיר רשותם של הישראלים הוי כאורחים, אלא שאח"כ כתב דלא מהני. [שלא מצי לסלקינהו ונראה דזה דוקא בעובדא שלו כמ"ש.]

Fiction As Fact?

Part of an ongoing commentary on the bias against city eruvin.

From the book The Legacy of Maran Rav Aharon Kotler by R. Yitzchak Dershowitz, p. 395:
Reb L.C. [Leib Cywiak], one of the close aides of the Rosh Yeshiva in fundraising endeavors tells that: “The ‘Ish HaTorah’ was Neki Chapayim – his hands were clean in his rulings as well as his actions. He was against making an Eruv in Manhattan (where other rabbonim were lenient). He argued that it is a R’shus Harabbim – public domain – D’oraiso and an Eruv would not help.” [See Tshuvos Mishnas Rav Aharon for a lengthy “Tshuvoh” on this subject.] “I once said to him, ‘The wealthiest religious Jews live in Manhattan. Why is it necessary to battle with them and to prevent them from putting up an Eruv. Other rabbonim look for Heterim’. The great Gaon got very upset about what I said and responded emotionally ‘Let my yeshiva close, I won’t budge from my opinion about the Halocha!’” (from Sefer Yom Hazikoron HaRishon, 1964, submitted by Moshe Weissman)

This story is fiction and is an affront to Rav Aharon zt”l as well. In contrast to the author, Rav Aharon knew very well who the rabbanim supporting the Manhattan eruv were and would not have allowed a statement such as “Other rabbonim look for Heterim” to go unanswered. To suggest that the overwhelming majority of rabbanim who supported the Manhattan eruv would compromise their principles and would be swayed by financial considerations is the biggest affront to their kavod. The following rabbanim supported the Manhattan eruv: Hagaon Harav Tzvi Eisenstadt, Hagaon Harav Eliyahu Henkin, Amshinover Rebbe, Kapishnitzer Rebbe, Boyaner Rebbe, Novominsker Rebbe, Radziner Rebbe, Hagaon Harav Michoel Dov Weissmandel, Hagaon Harav Yonasan Steif, Hagaon Harav Tzvi Pesach Frank, Hagaon Harav Menachem Kasher, and the Shatzer Rebbe, zt”l (see The Hundredth-Year Anniversary of the First Eruv in New York 1905-2005). The ramification of Rav Aharon’s chiddushim in eruvin meant that no eruv established in European towns, large or small, was allowed. Therefore, disagreeing with Rav Aharon’s chiddushim does not imply that the rabbanim were seeking heterim at all.

It is very unfortunate that the submitter of this article (who has a personal agenda against eruvin and has already included this bubbe maseh in his work on issurei eruvin) managed to get this fictional episode published in a mainstream book where it would grow in status and soon become accepted fact.

This teshuvah demonstrates that if a tzuras hapesach is erected in a reshus hayachid, Rav Moshe zt"l would agree that there is no requirement of delasos. Since Brooklyn is circumscribed by mechitzos and is classified as a reshus hayachid, a tzuras hapesach in any section of Brooklyn would be sufficient.

Growing up on the Lower East Side was, for me, a mixed blessing. Sure, I had the benefit of growing up in the city, but I also grew up in a neighborhood in transition but uncertain of where it was heading. At times, I had to deal with neighborhood taunts and jibes by Uptown and suburban schoolmates. Now it is the turn of my children to grow up here. Despite the trials and tribulations of the neighborhood, the Lower East Side is where I consciously chose to raise them. I love this neighborhood. I am passionate about it and for it. I am committed to its future. What that future looks like, however, remains to be seen. Read on ...

ענינים חשובים במצות עירוב


ירושלמי עירובין פ"ג ה"ה: אמר רבי יהושע מפני מה מערבין בחצירות מפני דרכי שלום.[22] מעשה באשה אחת שהיתה דבובה לחבירתה, ושלחה עירובה גבי ברה, נסתיה וגפפתיה ונשקתיה, אתא ואמר קומי אימיה, אמרה הכין הוות רחמה לי ולא הוינא ידעה, מתוך כך עשו שלום, הדא הוא דכתיב 'דרכיה דרכי נועם וכל נתיבותיה שלום'[23].


בספה"ק בית אהרן מהרה"ק מוה"ר אהרן מקארלין זצ"ל כתב: "קבלה בידינו, שפת העירובי חצירות התלוי בבית שמירה גדולה הוא".



האר"י הקדוש בשער המצות פרשת בשלח דרוש ג מסביר ענין עירובין (עירובי חצירות מבואות ותחומין) וכתב וזה לשונו: ועל ידי כן יתבטל כח הדינין ותתבטל אחיזת הקליפות, ויוכל האדם להכניס ולהוציא בחצרות ומבואות או [לילך] בתחומין בלי פחד מהקליפות.



ובספר קרבן שבת פי"א כתב עפ"י האריז"ל, ד'חסד' עולה ע"ב ו'גבורה' עולה רי"ו, וביחד הם אותיות 'עירוב', וזהו ענין עירוב לחבר חסד וגבורה (תפארת), "ואז רשות היחיד נעשה רשות יחידו של עולם, שאין לחיצונים אחיזה,[24] כי בשיתוף חסד וגבורה יחד בטילים כל הדינים שבעולם, והמן נדחף אל ביתו והעיר שושן צהלה ושמחה, משא"כ קודם לכן הם בפירוד ונקרא רשות הרבים רשות חיצונים ואין לטלטל מזה לזה" עכ"ל הקדוש.



ובספר פניני המאור (להרה"ג מו"ה משה מאיר יאדלער שליט"א מירושלים) ח"ג עמוד שע"ג ד"ה והנה מתוך, מביא בשם זקנו הגה"צ ר' בן ציון יאדלער (הוא המגיד הירושלמי הנודע, והיה הממונה לפקח על העירוב בעיה"ק ירושלים במשך שנים רבות), שאמר בשם החתם סופר זצוק"ל, שעירוב הוא שמירה על העיר מכל מרעין בישין ומשונאים וכו'.



ועיין ברכת אברהם פרשת ואתחנן וזה לשונו: שמעתי שתלמידי הריב"ש (הרבי ישראל בעל שם-טוב) ז"ל היו יושבים ביחד ומתווכחים איזהו הדבר העקריי שראש ומנהיג הדור צריך להשגיח עליו. יש מהם אמרו שהעיקר הוא להשגיח על הזביחה, שיהיה השוחט ובודק ירא שמים, וכן בכל שאר ענינים השייכים לזה, כי ח"ו מאכלות אסורים מטמטמים את הלב. ויש שאמרו עירובין הוא העיקר, כי הלכות שבת כהררים התלויים בשערה (חגיגה י.) והאיסור חמור מאוד. ויש אמרו מקוה היא העיקר, להשגיח שהמקוה תהיה כשרה בלי שום חשש, כי אם יסוד בנין האדם הוא ח"ו בלי כשרות, קשה לו מאוד להתגבר על הרע רחמנא ליצלן. ואחר זה אמר להם מרן הריב"ש ז"ל בזה הלשון: תיתי לי כי בעת הזאת פלפלו גם כן במתיבתא דרקיע איזה מהם עיקר, ואמרו כמר וכמר, והסימן הוא במקרא (חבקוק ג, יב) 'בזעם תצעד ארץ' ראשי תיבות זביחה עירובין מקוה, כל אלה הם יסוד הארץ.

וז"ל הייטב פנים בדרשות שבת שובה (ח"א פה:) סוף אות יא: והנה מבואר בספרים כי בכל יום מז' ימי תשובה שבין כסה לעשור צריך לשוב ולתקן היום ההוא, והיום יום שבת קודש, צריך לפשפש במעשיו בענין שמירת שבת קודש, האם שמר שבת כהלכתו ובכלליו ופרטיו לבל עשות מלאכה על ידי עצמו או על ידי נכרים בשבילו, ולהתחרט על העבר ולקבל עליו מעתה קבלה גמורה לשמרו כהלכתו.



והמבחן אם תשובתו מאהבה או מיראה הוא, אם יפקח כל אחד ואחד גם על זולתו, היינו מי שבידו למנוע רבים מעון שבת בהוצאה והמשא בזדון ובשגגה, אשר המכשלה הזאת תחת ידו במקום שאין שם עירובי חצירות ותיקוני מבואות. על כן אשר לו הכח לעמוד בהיכל השרים והשלטונים, בעיניו יראה ובלבבו יבין כדת מה לעשות, להשתדל בזה להוציא הדבר מכח אל הפועל לתקן תיקוני עירובין בעיר להציל הרבים, ובזאת יכופר עונו ויעשה זכיות. ועל כן נקרא היום 'שבת שובה', כי היום צריך להשיב שבת למקומו, ולקיים 'קחו עמכם דברים ושובו', אמן כן יהי רצון.



ובספר גדלות יהושע אות לב כתב: שמעתי מפה קודש רבינו זי"ע (ה"ה הרה"ק רבי אברהם יהושע פריינד אבד"ק נאסויד זצוק"ל), שפעם אחת ביום שבת קודש פרצה שריפה בבית הרה"ח המפורסם מוה"ר יוסף ליב כהנא ז"ל ואכל כל מחמדיה ל"ע, ובשבת שלאחריו דרש כ"ק אדמו"ר הגה"ק רבינו בעל ייטב לב זיעוכי"א האבד"ק סיגוט יצ"ו ונשא מדברותיו בקודש בבית הכנסת דשם. ובין הדברים הזכיר מאמר חכמינו ז"ל (שבת קיט:) 'אין הדליקה מצויה אלא במקום שיש חילול שבת' וכו', ואמר ליהוי ידוע לכם שברור הדבר אצלי שאצל הרה"ח הנ"ל לא היה ח"ו חילול שבת קודש, והדליקה נפלה רק בעון של בני העיר שיש ביניהם חילול שבת קודש, היינו שיש שאינם נזהרים בהוצאה לרשות הרבים ר"ל, כי בימים ההם עדיין לא היה עירובי חצירות בעיר סיגוט יצ"ו. והמליץ הגה"ק בעל ייטב לב זי"ע הפסוק (תהלים קמז, יד) 'השם גבולך שלום', היינו אם יהיה עירוב בעיר אז יהיה עירנו בבחינת רשות היחיד שהוא כענין 'שלום' כגוף אחד, ומי שיעשה ויפעול עשיית עירוב לזה אני מבטיחו 'חלב חטים ישביעך' כלומר שלא יחסר לו דבר מעולם, ואני נותן לו את העולם הבא שלי.

Part 3: Misconceptions in the Los Angeles Eruv Guidebook

The LA Eruv Guidebook:
The only Halachically valid solution for a city that meets the criteria of 600,000 is suggested in a responsa of R’ Chaim Ozer Grodzenski ZT”L. He discusses the possibility of an Eruv in prewar Paris and proposes that if we have three walls of “Omed Merubeh Al HaParutz” (more wall than breach) and one seals off the breaches with a Tzuras HaPesach, there is no need for doors.

The responsa is based on the following: As mentioned, the Mishna Berurah states that we rely on the opinion of the Rambam that “Lo Ossei Rabim U’Mevatlei Mechitzta”. The Rambam states this explicitly in a case of “Shem Daled Mechitzos”. “A construction of four symbolic walls”; an area that is surrounded by four “corner posts” and thereby negating the necessity of doors. If an area is surrounded on three sides with true walls, it is at least equal to the “corner posts” and no doors would be required. This reasoning is explained in the Chazon Ish [107:5] and used by the Bais Ephraim [#26]. (It should be noted that the Bais Ephraim understands that both opinions [even if doors must be closed at night] hold that “Lo Ossei Rabim U’Mevatlei Mechitzta” thereby strengthening the responsa of R’ Chaim Ozer Grodzenski ZT”L.)

The leniency of R’ Chaim Ozer Grodzenski ZT”L is based on the Halacha following Rabbi Elazar that “Lo Asei Rabim etc.” In fact, the Mishne Berurah states that all Eruvin were primarily based on the opinion of Rabbi Elazar. If the Halacha would follow the opinion of Rabbi Yochanan, the only way to construct an Eruv in a big city would be to build a wall with doors that would be closed each night.

This is the basis of the Toronto, West Rogers Park, Chicago and the San Fernando Valley Eruvin.


Notwithstanding the Mishnah Berurah’s (and the Mishkenos Yaakov’s) assertion that the majority of Rishonim pasken asu rabbim u’mevatlei mechitzta, the fact is the overwhelming majority of Rishonim and Achronim maintain lo asu rabbim (see The Overwhelming Majority of Rishonim Maintain Lo Asu Rabbim U’Mevatlei Mechitzta and The Overwhelming Majority of Achronim Maintain Lo Asu Rabbim U’Mevatlei Mechitzta). Therefore, relying on omed merubeh al haparutz is not a leniency at all as this is the accepted halachah. Additionally, Rav Chaim Ozer clearly did not consider a Paris eruv a leniency as can be discerned from the way he accepts the halachic issues without any debate.

As mentioned previously, it is not just the Bais Ephraim and the Chazon Ish who do not differentiate between the two opinions of the Shulchan Aruch. The overwhelming majority of Achronim who maintain lo asu rabbim also do not make such a distinction (see The Shulchan Aruch Explained).

More so, the author is mistaken since all the Rishonim (besides for the Ritva) concur that Rav Yochanan would agree in a situation of mechitzos that are omed merubeh al haparutz we pasken lo asu rabbim (see Like Whom Does the Rif Pasken – like Rav Yehudah or the Chachamim?). Consequentially, if an area is encompassed by mechitzos, all are in agreement that there is no requirement of delasos. Eruvin that utilize mechitzos are clearly superior to those eruvin relying only on tzuras hapesachim, and even a baal nefesh can rely on them (see also Part 2: According to the Mishnah Berurah, May a Baal Nefesh Carry in an Eruv of Tzuras HaPesachim?).

Additionally, there is another valid halachic solution, namely mufulash that the author continuously omits. City streets are not mefulash u’mechuvanim m’shaar l’shaar and therefore are not classified as a reshus harabbim.

Some yeshivaleit persist on declaring that Rav Chaim Ozer Grodzenski zt”l’s heter to establish an eruv for Paris was a great leniency. This falsity comes from a misplaced antipathy towards city eruvin believing that being machmer in eruvin is a lofty goal. Therefore, they cannot accept that a posek of the stature of Rav Chaim Ozer would allow an eruv in a large city. In truth, if they would learn hilchos eruvin, they would realize that Rav Chaim Ozer was only relying on accepted halachah for Paris and not some novel approach to constructing an eruv (see Part 1: The Achiezer Explained).


The LA Eruv Guidebook:
In Halachic terms, the newly constructed Eruv is a substantial upgrade. Firstly, there are many intricate Halachos regarding the actual construction and placement of the Tzuras HaPesach. Our Eruv follows the more stringent opinion, while the former Eruv relied on various leniencies. Secondly, since most Poskim regard Los Angeles as meeting the criteria of “600,000”, a Tzuras HaPesach Eruv does not suffice, and an Eruv is only valid if constructed in a manner of “Omed Merubeh etc.” with the breaches closed by Tzuras HaPesach.

Most poskim would not agree that LA would be classified as a reshus harabbim even without mechitzos since there is no street that has either shishim ribo traversing it or a street that is mefulash. (Although it is wonderful that currently we are able to establish an eruv mehudar, it is important to note that our grandparents used eruvin that had nowhere near the level of enhancements we can integrate in the construction of eruvin today.)


The LA Eruv Guidebook:
Rav Moshe Feinstein zt”l was undoubtedly the recognized Posek of the United States. As such, it would be inappropriate, perhaps even forbidden, to construct an Eruv which he deemed to be invalid. This Eruv, however, does meet the Halachic requirements of Rav Moshe Feinstein zt”l, as attested to in writing by his son, Horav Dovid Feinstein Shlit”a.

The following is a synopsis of the Shita of Rav Moshe Feinstein zt”l: While Rav Moshe Feinstein zt”l followed the lenient interpretation that a street is only considered a Reshus HaRabim if 600,000 people traverse it daily, nevertheless he introduced a second manner in which a heavily populated city can become a Reshus HaRabim. According to Rav Moshe Feinstein zt”l, even if there is no single street that is traveled daily by 600,000 people, nevertheless, if an 80 square mile area of a city is populated by enough people that one can assume that there are 600,000 people out on the street during daytime hours, this entire area would be considered a Reshus HaRabim, even though no single street has a traffic of 600,000 people.

Accordingly, Rav Moshe Feinstein zt”l posits that if a city has a population density in this “square” of 2 ½ to 3 million people, we can assume that there are 600,000 people on the streets at any given time. Rav Moshe Feinstein zt”l [אג"מ או"ח ח"ה סי' כ"ח ענף ב' אות ה'] proves that merely having a population of 600,000 is not sufficient from the fact that Warsaw had an Eruv even though there were more than 600,000 residents. Since the relevant “square” in Los Angeles has a population of just approximately 700,000 people, even if we would combine commuter traffic, it would surely be permitted according to the guidelines of his responsa.

Rav Moshe Feinstein zt”l, in another responsa, restricts construction of an Eruv in a city that is densely populated and people would assume that there are 2 ½ to 3 million people in the “square” even though actually there are not that many people. Since Los Angeles is a very “spread out” city, one can reasonably assume that Rav Moshe Feinstein zt”l would not restrict construction of an Eruv in Los Angeles. His son, Horav Dovid Feinstein Shlit”a, in fact, has written to us that his father zt”l would permit construction of an Eruv in Los Angeles.

This is one of the most accurate synopses of Rav Moshe Feinstein zt”l’s shita regarding shishim ribo to date and the author deserves credit for it. However, there are a few issues that should be illuminated. First of all, it is wrong to suggest that if Rav Moshe would prohibit an eruv it would be forbidden to establish one. Every single rav has a right and a responsibility to establish an eruv if he maintains that one can be erected (see Eruvin: Who’s Obligation). Why should eruvin be any different then any other halachic issue? More so, Rav Moshe himself allowed the rabbanim of Manhattan to establish an eruv even though he was of the opinion that one cannot be erected (see Hagaon Rav Moshe Feinstein zt”l’s Reluctance to Pasken Against the Establishment of an Eruv).

Additionally, it is the Shulchan Aruch’s ruling that a street is only classified as a reshus harabbim if shishim ribo traverse it daily and that is whom Rav Moshe is following, not just any lenient opinion (see Shishim Ribo According to the Achronim: A Daily Requirement or Not). Furthermore, in Rav Moshe’s last teshuvos regarding the amount of people required to populate an area of twelve mil by twelve mil he clearly settles on the figure of 3,000,000 people. Only then would have Rav Moshe classified the area as a reshus harabbim (see Part 2: Shishim Ribo According to Hagaon Rav Moshe Feinstein zt”l).

Regarding Rav Moshe zt”l’s gezeirah – that people would assume that the twelve mil by twelve mil area contains 3,000,000 people – he mentions this even regarding Detriot proper (see Three Million: More or Less?). Detroit’s population at the time Rav Moshe wrote his teshuvah (1980) was approximately 1.2 million and nevertheless Rav Moshe maintained that Detroit is one of the cities that people would assume contained a population of 3,000,000. Therefore, Rav Moshe upheld that an eruv cannot be erected there. Thus, according to Rav Moshe, it is presumptuous to claim that LA is a city that one would not imagine contained a large enough population to be classified as a reshus harabbim. The question is why Rav Dovid Feinstein shlita did not declare that because of his father’s gezeirah an eruv cannot be established in Chicago and Los Angeles. It seems that this gezeirah was not considered by Rav Dovid a serious enough issue to impede the construction of eruvin, after all (see Three Million: More or Less?).

Part 4a: The Permissibility of a Brooklyn Eruv According to Rav Moshe Feinstein zt”l

Is Brooklyn Enclosed by Mechitzos?


Rav Moshe zt”l stated (Igros Moshe, O.C. 5:28:5) regarding Brooklyn’s mechitzos, “Until now they [the mechitzos] did not exist but that one can investigate” (see also ibid., Addendum to O.C. 4:89).

These are the facts:
That there are three mechitzos nowadays enclosing more than 95 percent of the Brooklyn waterfront, is obvious even to the most casual of observers (see Part 3: Why Brooklyn Is Not a Reshus HaRabbim). Therefore, according to Rav Moshe, Brooklyn is classified as a reshus hayachid and an eruv of tzuras hapesachim can be erected.

These mechitzos were evaluated by the following rabbanim to see whether they fulfilled Rav Moshe requirements:
Members of Rav Yechezkel Roth shlita’s Bais Din; see Emek HaTeshuvah (5:19) and Appendix 8.
Rav Shlomo Gross shlita, Belzer Dayan of Boro Park.
Rav Tuvia Goldstein zt”l sent a select group from his kollel Emek Halacha.

All were in agreement that these mechitzos exist and that they are valid mechitzos according to Rav Moshe zt"l.

Part 5: Various Issues Regarding Eruvin

לא תתגודדו



הנה בין הטענות נגד תיקון עירובין נשמעה טענה, דכיון שאין כל העיר מסכים לישא בהעירוב, למה אין בזה משום 'לא תתגודדו', שלא יעשו אגודות אגודות.



התשובה לכך כבר מבואר במג"א סימן תצ"ג ס"ק ו' ובש"ך יו"ד סוף סימן רמב אות י דכשיש שני בתי דינים בעיר אחת שאין מורין בשוה, אין בזה משום לא תתגודדו. וכאן אין שום ב"ד קבוע,[21] רק יש כמה רבנים וכל אחד שואל למי שרוצה, וכידוע אין כולם מורים בשוה בכל הד' חלקי שו"ע.



ועיין שו"ת אגרות משה ח"א סימן קנט שכתב וז"ל: "בכאן נוא יארק וברוקלין שנתקבצו אנשים מכל המקומות אשר היו המנהגים משונים, שבעצם יש לכל אחד לעשות כמנהג המקום שבא משם, משום דהוי כשני ב"ד בעיר אחת שליכא משום לא תתגודדו וכו', רק משום טעם מחלוקת יש לאסור, ולכן בנוא יארק וברוקלין וכדומה שכל המנהגים מכל העולם איתנהו, וא"כ לא שייך מחלוקת, שידוע זה לכל שיש בכאן כמה מנהגים". וכ"כ שם בסימן קנח, "שבפה ניו יורק נשאר כל אחד במנהגי עירו שביוראפ (-שבאירופה) בין לקולא בין לחומרא מטעם שהם כב' ב"ד בעיר אחת," וכ"כ באו"ח ח"ד סימן סב, ובאו"ח ח"ד סימן לג. וע"ע שם באו"ח ח"ה סימן טו שכתב "וברור שיש בלאנדאן שני בתי דינים וליכא משום לא תתגודדו."



ולרווחא דמלתא, עיין שו"ת פרשת מרדכי להגאון רבי מרדכי באנעט זצ"ל (חלק אורח חיים סימן ד') שאין איסור לא תתגודדו נוהג אלא בתחלת המחלוקת, ובבית דין אחד, שיש להם להשוות דעתם יחד, אבל בדבר שנחלקו בו הקדמונים וכל אחד נוהג כדברי רבותיו, אין בזה משום לא תתגודדו, וכל אחד צריך לקיים מנהג אבותיו ואפילו בבית כנסת אחד עי"ש. וענין תיקון עירובין נהגו מאז ומעולם עד היום הזה בכל השכונות החרדיות שבכל העולם.
